IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND

OPEN COMPETITION

10 USC 2304 (c)(1), as implemented by FAR 6.302-1(b)(1)(iii). Only One Responsible

Source and No Other Supplies or Services Will Satisfy Agency Requirements

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

The Air Force Institute of Technology, School of Systems and Logistics, Department of

Systems and Software Engineering Management (LSS) has a faculty requirement for a manufacturing readiness and quality assurance specialist with broad expertise. This requirement is the result of an emphasis within DoD on including manufacturing readiness as part of assessing an acquisition program’s overall risk and helping to ensure the program’s success.

This individual must be well versed in assessing manufacturing readiness and quality assurance and certified as level III in the Production, Quality, and Manufacturing field by the DoD Acquisition Professional Development Program. Expertise in assessing manufacturing readiness and quality assurance should include reviewing acquisition programs manufacturing plans and resolving manufacturing and quality assurance issues, speaking with technical authority as a member of working groups and similar teams, and preparing and conducting manufacturing readiness assessments for acquisition programs, to include physical inspections of contractor facilities and manufacturing and quality assurance procedures.

This individual should have demonstrated experience in professional continuing education instruction, instructional course development and management, presentation of course material before live audiences, leadership in a classroom setting to accomplish specific learning objectives, technical writing, and editing. Such experience should be supported by breadth and depth of knowledge, skills, and abilities. Therefore, this acquisition is for continued performance of a highly specialized service.

Mr. Lastoskie currently satisfies the faculty requirement under contract number FA8601-

12-P-0143. He is the only source known to AFIT/LSS who meets the requirements for manufacturing expertise and certification along with professional continuing education experience. He is also well versed in AFIT’s procedures and working environment, which will allow him to begin teaching classes immediately.

Considering efforts already taken to secure competition, as described in Section IV below, AFIT believes that further attempts to secure competition would be futile and would result in unacceptable delays in fulfilling the Air Force’s requirements. The first class is scheduled to begin April 16, 2013. It is inconceivable that a qualified faculty member, other than Mr. Lastokie, can be in place and ready to provide instruction by that date. Without the manufacturing readiness and quality assurance faculty, the required curriculum of courses cannot be professionally developed and delivered. Knowledge crucial to timely development of cost effective, sustainable weapons systems would not be imparted—a mission failure for AFIT/LSS. Accordingly, Mr. Lastokie is the only individual capable of providing the services described in Section III without the U.S. Air

Force experiencing unacceptable delays in fulfilling its requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

Sources Sought Synopsis (SSS): SSS FA8601-13-R-0029 was posted to FedBizOpps on 9 January 2013 with responses due on 25 January 2013. The SSS provided a description of the services required and the need for consistency throughout the entire curriculum management and delivery process. No firms responded to the SSS.

Other Actions: AFIT/LSS initiated actions to hire a full time government civilian over-hire to fulfill this requirement. The initial advertisement resulted in no qualified applicants (as determined by the Civilian Personnel Office) being forwarded to AFIT for consideration. AFIT/LSS refined the advertisement and re-advertised, but again received no qualified applicants.

AFIT/LSS also has professional relationships with other organizations within the DoD acquisition community (such as SAF/AQ, HQ AFMC, and the Joint Service/Industry

Manufacturing Readiness Level Working Group). AFIT/LSS inquired through these relationships about possible sources for qualified instructors. No other providers, within

DoD or the commercial realm, were found.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer determines that the anticipated price will be fair and reasonable based on the price analysis techniques described in FAR at FAR 15.404-1(b)(2)(ii), comparison of proposed to historical prices paid and FAR 15.404-1(b)(2)(vi), comparison of proposed prices with prices obtained through market research for the same or similar items.

Mr. Lastoskie previously provided essentially the same services as an AFIT faculty member from 16 April 2012 to 15 April 2013. During that time his duties consisted primarily of providing the services described in Section III above. His gross annual compensation for providing these services was $149,050.00, negotiated, which is consistent with the estimated price of the services to be provided under the contemplated follow-on contract. In addition, Mr. Latoskie is currently providing essentially the same services under contract FA8601-12-P-0143 whose annual value is $185,000.00. This price is consistent with the estimated price of the contemplated follow-on contract.

Market research revealed that compensation for professors with comparable levels of expertise and years of experience in their fields is comparable to the estimated price of the services required. Compensation for similarly credentialed professors at Ohio State

University is as high as $222,228.00. Miami University lists salaries for engineering professors as high as $259,320.00. Also, USA Jobs.com currently lists a position for a

Full Professor of Systems Engineering at AFIT with a maximum salary of $165,300.00.

Finally, in accordance with FAR 15.404-1(b)(2)(vii), the Contracting Officer will negotiate with Mr. Lastoskie and obtain data, other than certified cost or pricing data, as necessary to determine that the negotiated price is fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL

AND OPEN COMPETITION

None.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

See Section VI above.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE

TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

AFIT/LSS will continue to explore the feasibility of hiring actions and review the capabilities of commercially available sources for future requirements through market research. Such market research may include seeking sources through professional relationships (such as the OSD Manufacturing Technology Program and/or the Joint

Service/Industry Manufacturing Readiness Level Working Group) and market research conducted by other organizations (such as the contracting office).
