C. Type J&A: Individual
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED MEETING THE
AGENCY’S NEEDS:
A. Under the contemplated contract, NGC will provide a spectrum of Contractor actions needed to establish a POD Software (OFP and /or incidental Firmware and Hardware) suitable for installation and operation on all F-16 aircraft. NGC activities involved in creating these products include but are not limited to; engineering analyses, software integration, and new hardware prototypes and associated testing, source data and support of platform ground/flight testing required for producitonization.
B. Estimated period of performance and ordering periods will be 5 years.
C.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
10 USC 2304 (c) (1) as implemented by FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED
ABOVE (APPLICABILITY OF AUTHORITY):
A. The above authority was selected because this contract is for highly specialized products.
This acquisition is to procure enabling and upgraded POD OFP software to integrate with all F-16 BLK OFP software updates. The LITENING pod is the only pod that has Laser Targeting imaging Program (LTIP) capability. Lockheed Orlando was originally put on contract by Air Force Program Office at Electronic System Command (ESC) to incorporate LTIP into their pod and was unsuccessful. The assessment was made that the Lockheed pod would have to be completely redesigned to accomplish LTIP. NGC demonstrated their capability and the Air Force, through the POD SPO (PASPO) (located at Wright Patterson AFB), purchased LITENING TGP’s. The NGC manufactured PODs require software and hardware changes to integrate correctly with new platform OFP’s every time the U.S. Air Force upgrades F-16 OFP. PASPO is continuously procuring upgrades to the NGC PODs therefore NGC is the only source that can design, develop, test and release F-16 integrating OFP and BIT download software to operate the Air Force’s inventory of NGC PODs being flown with various F-16 platform OFPs. Therefore, this acquisition will be a follow-on contract for the continued integration of this highly specialized product.
B. The Program Office estimates award to any other vendor would result in unacceptable delays in fulfilling the agency’s requirements. The Program Office estimates it would take a minimum of five years to reverse engineer and gain subsequent intellectual property information, required to write LITENING TGP OFP source code to match that of NGC. By that time there would have been a number of upgrades performed on the POD and that intellectual property information would be obsolete.
a. The LITENING TGP OFP interfaces with virtually all of the avionic systems onboard the aircraft and the source code must match exactly to interface with the new F-16 OFP. To ascertain the amount of time required for the reverse engineering and software source code process, the Government examined the magnitude of the effort by analyzing major LITENING components.
b. The updated LITENING TGP OFP source code delivers enhanced capabilities in TGP target accuracy, position accuracy, and precision weapons cueing in both air-to-air and air-to-ground environments. Such improvements are vital in supporting the increasing level of coordinate accuracy needed to employ Precision Guided Munitions (PGM), in providing the pilot the “first-look, first-kill” opportunity, and in improving avionics system level accuracies. This capability directly correlates to an increase in blue force survivability, weapons effectiveness, and situational awareness across the board. Lack of this enhancement will result in a severe degradation in the pilot’s ability to; find, fix, target, track, kill, and assess weapons effectiveness on hostile targets. Likewise, pilots will not have the needed TGP accuracy improvements vital in building and maintaining Situational Awareness (SA) on blue forces positions needed to conduct “Danger Close” weapons employments, ensure safe Collateral Damage (CD) distances, coordinate and confirm targeting priorities/deconfliction, and provide improved PGM’s with minimal Target Location Errors (TLE) and highly precise coordinates.
C. The last attempt to obtain the data right from NGC was 08 Jan 2015 by Program Manager.
The vendor responded through their Program Director stating NGC does not intend to sell their data rights at this time.
D. Accordingly, NGC is the only firm capable of providing the supplies and services described in Section III above without the government experiencing unacceptable delays.
VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARE
