IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL

AND OPEN COMPETITION

10 U.S.C.2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii).

V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION

REQUIRES THE USE OF THE AUTHORITY CITED ABOVE

(APPLICABILITY OF AUTHORITY)

Unison has provided to the Government this highly specialized non-commercial item under the previous sole-source contract listed in Section II. This acquisition will be a procurement contract for new manufacturing of the thermocouple cable assembly. This item is a component of a major weapon system and provides an electrical signal to the digital electronic engine control for engine monitoring to the F100-229 in F-15 and F-16 aircraft. This Critical Safety Item must be acquired from a manufacturing source specified on source control drawing 4086982, as defined by the current version of DoD- STD-100. This item is classified as a Critical Safety Item because failure could lead to a Non-Recoverable In-Flight Shutdown (NRIFSD). In the F-16, a NRIFSD can cause an Engine Related Loss of Aircraft.

This item is source controlled and technical data is proprietary to the Original Equipment Manufacturer (OEM), United Technologies Corporation, Pratt & Whitney Spare Parts Division, CAGE Code 77445. To date, Pratt &Whitney has only given Unison, the supplier, the rights to use the data. Suitable technical data is not in the Government’s possession. Government data/data use rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application.

Unison possesses unique capabilities derived from knowledge and expertise gained during previous production of this item. This acquisition will be the continued production of a highly specialized part for a major system.

The 421st SCMS believes that an award to any other source would result in unacceptable delays in fulfilling the Air Force’s requirement. No other source can submit a Source Approval Request (SAR), because this part is source controlled to Unison. The engineer sent an email to a Unison representative on 31 Oct 17. The email requested Unison to provide the data rights or sell the data to the government. AFSC and LCMC followed up with a subsequent email and phone call. A negative response was received from the Unison representative on 9 Nov 17.

Accordingly, Unison is the only firm capable of providing the supplies described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements (see Section XI for further information involving reverse engineering and specific time delays).

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS

ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS

PRACTICABLE.

The Sources Sought Synopsis (SSS) was posted on the Federal Business Opportunities (FedBizOpps) website 11 Jul 17, under FD2030-18-00024 with a response date of 11 Aug 17. No responses were received; and as stated in Section V, there is only one qualified source at this time.

In accordance with FAR 5.201, this requirements shall be synopsized and the Request for Proposal will be posted to the in FedBizOpps website.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR

AND REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. A cost and price analysis will be performed.

The Defense Contract Management Agency and/or Defense Contract Audit Agency may be contacted to assist with the analysis, and may assist with inputs throughout the life of the contract.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND

THE RESULTS, OR A STATEMENT OF THE REASONS MARKET

RESEARCH WAS NOT CONDUCTED

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries form interested parties. Additionally, a multi-functional team consisting of the Item Manager, Equipment Specialist, Logistics Officer, and Engineer conducted further research between 14 Jul 17 - 19 Jul 17. This research included reviewing the AFMC Form 762, the subject NSNs procurement histories, and internet searches on websites such as SBA.gov, Google.com and JEDMICs. This research revealed that there is not a commercial process available to meet this requirement.

Based on this market research, Unison was found to be the only source able to fulfill the requirement described in section III.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN

FULL AND OPEN COMPETITION

No further information.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN

THE ACQUISITION

Unison Industries, LLC CAGE: 59501 7575 Baymeadows Way Jacksonville, FL 32256 904-739-4131

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY

TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS

FOR THE SUPPLIES OR SERVICES REQUIRED

The Thermocouple Cable Assembly is currently included in a reverse engineering project. The first prototype had manufacturing errors, which resulted in several failed attempts. Engineer is seeking other vendors to begin the process again. Estimated completion for this reverse engineering project is not expected until Feb. 2022.

As evidenced by the Approving Authority signature on the Coordination and Approval Document, he/she has reviewed the previous J&A and determined that any stated actions to remove barriers to competition have been accomplished.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document is evidence that the contracting officer has determined this document to be both accurate and complete to the best of the contracting officer knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

By their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein.
