II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This individual Justification and Approval (J&A) authorizes the use of Other than Full and Open Competition procedures to obtain a new firm-fixed-price, requirements-type contract.

The contemplated contract is for repair service of the applicable printer from AstroNova Corporation, Commercial and Government Entity (CAGE) code 54318. In accordance with FAR Part 16, a 3-year basic contract with two 1-year options is considered to be appropriate for this acquisition. The estimated total value of this award is . The estimated award date is 07 Feb 17.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

B. Due to the circumstances described below in Sections V, IX and XI, there are no immediate or feasible actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year. If other qualified or approved sources become known during the life of this contract any remaining options will not be exercised.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2).

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE

AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

A. The B-2 automatic printer provides a hard copy of mission related fault and diagnostic information for the B-2, while maintaining the low observable characteristics of the air vehicle. Astro-Med, Incorporated (DBA: AstroNova) recently acquired the ruggedized printer division of Miltope Corporation which included all data, test equipment and technical information required to repair the B-2 automatic printer B. AstroNova is the only known source that has the technical data, parts, expertise, tooling, and test equipment necessary to repair the B-2 automatic printer sufficiently to meet the Government’s needs. The repair data, test equipment and acceptance test criteria needed to foster competition for the repair are not available to the Government and it is not possible for the Government to draft adequate specifications for the repair of the automatic printer without the technical data. Although the Government realizes that it has unlimited usage rights to form, fit, and function data, as well as data related to operation, maintenance, installation, and training, such rights are insufficient due the special capabilities that are required for repair purposes of meeting the Government’s needs. Additionally, the Government does not have qualification requirements as AstroNova approves additional sources.

C. Accordingly, AstroNova is the only firm capable of providing this service described in Section III above without the U.S. Air Force experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. Additional information can be found in Section IX.

D. 424 SCMS/GUMA recommends sole source contract to AstroNova be awarded. The Government does not possess the data to qualify additional sources. Possible additional sources could be accomplished by AstroNova. However qualification of a new source would drive additional aircraft testing and would result in procurement delays and additional costs. These delays could have the potential for disrupting availability of the B-2 Aircraft, leaving the Air Force unable to meet critical mission requirements. For these reasons, AstroNova is the only source capable of providing the supplies described above in Paragraph III, without the Government experiencing such delays.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposal posted in Federal Business Opportunities (FedBizOpps) website. The Government performed market research on 14 Oct 15 to locate additional sources. A sources sought notice was posted B-2 Automatic Printer under FA8119-16-R-0001 to FedBizOpps from 5 Oct 15 to 12 Nov 15, and no other qualified sources were identified.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. the Air Force Negotiating team will perform price and cost analysis and their finding will be made available in a Price Negotiation Memorandum.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS

NOT CONDUCTED

A. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition advising industry of the pending acquisition and soliciting inquiries from interested parties. Additionally, a multi-functional team consisting of the Engineer, Contracting Officer, and Production Management Specialist conducted further research by Parts Manufacturer Approvals, Haystack, and Internet search, completed on 14 Oct 15. This research revealed that there is not a commercial process available to meet this requirement. The applicable items in this system are used in military applications and no commercial or non-developmental substitutes are available. There are no applicable industry standards, regulations, trade journals, or process guides that apply to the repair of the B-2 automatic printer. The Government market research identified the same sole-source market condition that has existed since these parts originally were manufactured by the OEM in October 1991.

B. On 6 Nov 15, AstroNova declined via email to the Government’s request to purchase use rights to the printer data. Although the contractor has declined, the Government will continue to encourage the purchase of the data rights through the solicitation.

C. Other companies that perform similar efforts exist in the marketplace, but they do not possess the applicable technical data, tooling, and security classification that are required.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

A. The Government does not expect that another source could become qualified in time to avoid unacceptable delays in meeting the current mission requirement. The Air Force's highly specialized B-2 capability would be diminished.

B. Although it is remotely possible to recover the cost of reverse engineering over the life expectancy of the parts, the time it would take to await that course of action makes it unfeasible to meet the current need. The development of repair procedures without the requisite data, test equipment and/or technical manuals is impossible without extensive and costly reverse engineering. The Government does not have enough experience or historical data to estimate costs with any degree of specificity, and we anticipate that developing a repair capability for these parts without any releasable data would be a very high risk endeavor The B-2 weapon system was always intended to be contract repair due to the low number of aircraft . The requirements fluctuate and organic repair would likely never generate enough workload to recoup the cost for developing an organic repair shop. It is not possible to draft adequate repair procedures without the technical data required, which would drive unacceptable delays in fulfilling the Air Force’s requirements.

C. The Government does not have the capability to qualify a source for this repair due to the lack of source qualification data. To the Government's knowledge, AstroNova has not received any request to qualify additional repair sources for this item.

For example, reverse engineering the end state of an advanced coating does not necessarily reveal the means by which it was applied, and significant trial and error is likely to be encountered. Further, funding has not been approved, and the priority of these parts does not rise to the level at which funding likely would be approved or budgeted. The B-2 weapon system was always intended to be contract repair due to the low number of aircraft

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

A. The 424 SCMS will continue to monitor the marketplace for repair source development and will continue licensing discussions with the sole source vendor for additional sources.

The Government will continue to synopsize the requirement, rescreen the item, and attempt to acquire the user rights to data necessary to qualify additional sources.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the coordination and approval document is evidence the Contracting Officer has determined this document to be both accurate and complete to the best of the Contracting Officer’s knowledge and belief.
