I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm-fixed price, fixed-quantity contract. The contemplated contract will be with Northrop Grumman Systems Corporation, Commercial and Government Entity (CAGE) code 1W025, for the new manufacture of the electronic control panels to support the B-2 aircraft.
The estimated total value of this award is with an estimated award date of 12 May 17 and a required delivery date of 12 May 18.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET
THE AGENCY’S NEEDS
Under contemplated contract, Northrop Grumman Systems Corporation will provide the following services for manufacture of electronic control panels.

Item description and function: 5.750 in. long X 3.375 in. wide X 6.750 in. high, weighing 1.8 lbs., and composed of aluminum. The electronic control panel is used as a backup system to primary throttle control system.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND
OPEN COMPETITION
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. IAW with FAR 6.304(a)(1) the approval level for this J&A is the contracting officer.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES
THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF
AUTHORITY)
In accordance with the Contractor Integrated Technical Information System (CITIS), item part number DAA3233A017-017 contains many proprietary hardware drawings and specifications. The Government does not own the data or rights to the data to develop additional sources. Northrop Grumman Systems Corporation is the only known source for this item.
Accordingly, Northrop Grumman Systems Corporation is the only responsible source capable of providing the items described in section III of this document.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED
PRACTICABLE
In accordance with FAR 5.201, this requirement shall be synopsized and the Request for Proposal will be posted to the Federal Business Opportunities website.
The Government does not have qualification requirements, as only the original equipment manufacturer approves additional sources.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide certified cost or pricing data. A detailed cost analysis and price analysis may be accomplished. The Defense Contracting Management Agency may be contacted to assist with the analysis.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH
WAS NOT CONDUCTED
Market research, in accordance with FAR Part 10, was conducted on 28 Mar 16.
This research revealed that there is not a commercial item available to meet this requirement. The items described in section III are used in military applications and no commercial or non-developmental substitutes are available.
Based on the above, a high level of confidence exists that Northrop Grumman Systems Corporation is currently the only responsible source able to fulfill the requirement.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL
AND OPEN COMPETITION
Reverse engineering would entail profound duplication of design and testing effort, the cost of which could not reasonably be expected to be recovered over the life of the weapon system.

BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES
OR SERVICES REQUIRED
The 424 SCMS will continue to monitor the marketplace for source development, and will continue discussions with the Original Equipment Manufacturer (OEM) regarding additional approved sources. The Government will continue to synopsize the requirement, rescreen the item, and attempt to acquire the data necessary to qualify additional sources. A Sources Sought Synopsis was posted to the Federal Business Opportunities website under solicitation number: FD2030-16- 01746_NSN: 1680-01-390-4546 on 26 Apr 16, with a closing date of 4 May 16, in an effort to solicit interested sources. There were no responses to this effort.
XII. CONTRACTING OFFICER’S CERTIFICATION
By signing the coordination and approval document, the Contracting Officer determines this document to be accurate and complete to the best of the Contracting Officer’s knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the coordination and approval document, the technical or requirements personnel certify that any included, supporting data within their area of responsibility is both accurate and complete.
