IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND

OPEN COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2).

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES

THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

This acquisition will be a follow-on contract for the remanufacture of the specialized Direct Current Motor. Kearfott Corporation has provided this highly specialized remanufacture on sole source contract FA8118-11-D-0012. This motor is a 28 volt direct current reversible motor, equipped with a radio noise filter for electrical noise suppression, and is used to extend and retract the crew entry door and crew ladder for the B-1 aircraft. This motor is highly specialized because of the aforementioned characteristics and is solely applicable to the B-1 aircraft, a supersonic strategic bomber. Failure of this item could compromise personal safety and mission success. In order to maintain the quality of the remanufactured part, pre-contract source approval is required.

The Original Equipment Manufacturer (OEM), Kearfott Corporation, is currently the only known contractor that has the parts, expertise, tools, and test equipment necessary to remanufacture the B-1 Direct Current Motor sufficiently to meet the Government’s needs. Kearfott Corporation has previously remanufactured this motor on the sole-source contract identified above.

The Air Force exceeded the ordering requirement on the previous contract, and option year IV was subsequently not exercised. Presently, we are without contract coverage and do not have sufficient pipeline assets to cover the current demand.

Accordingly, Kearfott Corporation, is the only firm currently capable of providing the remanufacture described in Section III above without the Air Force experiencing unacceptable delays in fulfilling its mission requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

Pursuant to FAR 9.204, Qualification Requirements (QR) have been established and were synopsized on Federal Business Opportunities (FedBizOps) on 19 May 2014. The purpose of the QR synopsis was to seek additional sources to be approved for remanufacture of this item via the source approval process. No responses have been received in result of this synopsis.

In addition, in accordance with FAR 5.201, a sources sought synopsis (SSS), FD2030-14-01876, was posted on the FedBizOps website on 28 May 2014. Three companies responded to the SSS. Sources were Triumph Airborne Structures, Inc., ARMCOR (specializing in collections, funding, and contract administration services), and First Aviation Services, Inc. To date, no further action has been taken by any of these companies to become a qualified source. The submission of a Source Approval Request (SAR) package by the contractor is required for the source approval process. No SAR packages have been received to date.

In accordance with FAR 5.201, this requirement will be synopsized and the Request for Proposal will be posted to FedBizOps for 30 days.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide other than certified cost or pricing data. A detailed cost analysis and price analysis will be accomplished. The Defense Contracting Management Agency and/or Defense Contract Audit Agency may be contacted to assist with the analysis, and may assist with inputs throughout the life of the contract.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. Additionally, the engineer conducted a Google web search on 2 July 2014 and reviewed Thomas Register and HAYSTACK. Research revealed that there is not a commercial process available to meet this requirement. Furthermore, the requirement cannot be modified with a commercial item. This is a non-developmental item. The Direct Current Motor in this system is used in a military application, and no commercial or non-developmental substitutes are available. There are no applicable industry standards, regulations, trade journals, or process guides that apply to the remanufacture of these Direct Current Motors. Market research also allowed the Government team to identify the same sole-source market condition that has existed since these parts originally were manufactured by the OEM. Kearfott Corporation was found to be the only source currently approved to fulfill the requirement.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL

AND OPEN COMPETITION

The Government has qualification data and the ability to qualify additional sources through the SAR process. No additional sources have come forward or submitted a SAR package for source approval.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

Kearfott Corporation CAGE: 05088 2858 US Highway 70 West Black Mountain, NC 828-350-5330

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE

TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION

BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES

OR SERVICES REQUIRED

Due to the complexity and criticality of the item, only pre-approved sources meet USAF requirements. Qualification requirements are available and will be forwarded to any prospective vendors upon request. The qualification requirements will be periodically synopsized in the FedBizOps pursuant to FAR 9.204(a)(1). The contracting office, with engineering assistance, will determine whether the possibility exists to approve alternate sources. The Government will work with interested vendors to determine remanufacture capabilities for future requirements.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the coordination and approval document evidences the Contracting Officer has determined this document to be both accurate and complete to the best of the Contracting Officer’s knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the coordination and approval document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
