Due to the circumstances described below in Sections V, IX and XI, there are no immediate actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year’s requirement. If other qualified or approved sources become known during the life of this contract, full and open competition will be utilized to the maximum extent practicable.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii)(B)
V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE
USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF
AUTHORITY)
AstroNova, the Original Equipment Manufacturer (OEM), is the only known contractor that has the data, parts, expertise, tools and test equipment necessary to repair the items mentioned above in Section III. AstroNova, has provided this highly specialized service on the previous warranty contract, FA8730-06-D-0011. Although the government realizes that it has unlimited usage rights to form, fit and function data as well as data related to operation, maintenance, installation, and training, such rights are insufficient for purposes of meeting the government’s needs. The manufacturing and repair data and acceptance test criteria needed to foster competition for repair is not available to the government and it is not possible to draft adequate specifications for this repair task. These services are considered highly specialized due to the peculiarity to their respective weapon systems and require special tooling and expertise for the repair of these items. AstroNova possesses unique equipment and capabilities (such as test equipment, acceptance test software, theory of operation/architecture, assembly/disassembly procedures, material provisioning and selection criteria, fault diagnostics, shop practices, replacement parts, trained personnel, etc.) derived from knowledge and expertise gained during previous production of these items.
Requests for data/data rights was made on 4 Aug 16. Refusal from the OEM to answer this request for data and data rights release has been construed as a negative response to the government's request.
Complete or releaseable drawings are not available in the Joint Engineering Data Management Information and Control System or the Military Engineering Data Asset Locator System.
These items are critical application items. However, they are not critical safety items on the systems listed in Section III, but are considered highly specialized components. Development of additional sources to produce these parts is not feasible within allowable timeframes. Delays in repair have the potential of disrupting the availability of weapon systems, thereby leaving the Air Force unable to meet critical mission requirements and hampering the Air Force’s ability to execute its global mission. If another company were able to obtain the data/data rights for repair, it would take a minimum of three years for it to develop full repair capability.
The 422 Supply Chain Management Squadron (SCMS) believes that award to any other source would result in unacceptable delays in fulfilling the Air Force’s requirements.
Accordingly, AstroNova is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirement.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE
On 16 Aug 16, a Sources Sought Synopsis (SSS) was posted in Federal Business Opportunities (FedBizOpps) under the reference number FA8117-16-SS-0036 with a close date of 31 Aug 16. The SSS included the NSN, part number and quantity for this acquisition and requested information, pursuant to FAR 10, in support of market research to identify potential sources for the repair of the NSN listed. The Government received no response to the synopsis.
Government defined pre-award qualifications for new sources cannot be drafted due to the unavailability of the necessary technical data as described in Section V. The OEM is the only entity capable of approving additional sources at this time.
IAW the FAR 5.201, this requirement shall be synopsized and the Request for Proposal will be posted to the FedBizOpps website.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. IAW FAR 12, the contractor may be required to provide other than certified cost or pricing data and a detailed cost analysis and price analysis will be performed.
The Contracting Officer may request a technical evaluation from the Defense Contract Management Agency to aid in the evaluation of the contractor’s proposal. The Contracting Officer may seek audit assistance from the Defense Contract Audit Agency if necessary.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS
NOT CONDUCTED
Market research, IAW FAR 10, was conducted on 17 October 2016 by a multi-functional team consisting of the Item Manager, Equipment Specialist, Logistics Officer, and Engineer. This research included inquiries into internet sites including http://www.mymiltop.com/, http://www.rockwellcollins.com/, http://www.interfacedisplays.com/, www.abilityone.gov, Google, the Parts Manufacturer Approvals (PMA), Haystack. Other vendors manufacture similar items but none have been identified as a qualified source to meet the requirements described in Section III.
This research did not reveal any other qualified sources available to fulfill the commercial requirement.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
If repairs do not begin by 13 Jun 17, the Air Force’s capability would become inoperable and would be impacted immediately with Mission Incapable Awaiting Parts backorders materializing within weeks, thereby degrading the Air Force’s combat capability. Furthermore, reverse engineering the repair process is not feasible within allowable timeframes. Any effort to reverse engineer would take a minimum of 5 years from the initiation of the CSAG (Consolidated Sustainment Activity Group) Sustaining Engineering project. This timeframe includes the budget request period, purchase request processing, contract negotiations and award, period of performance, qualification testing and source qualification. A cost estimate to complete this has not been generated due to the unknown nature of some of the projects elements to include the scope of the qualification testing required to ensure OSS&E (Operational Safety, Suitability and Effectiveness).
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION
AstroNova, Inc 600 E Greenwich Ave West Warwick, RI
02893-7526
CAGE:54318
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES
REQUIRED
The 422 SCMS will continue to monitor the marketplace for potential source development and continue to synopsize requirements and rescreen the item in order to qualify additional sources.
XII. CERTIFICATION BY THE CONTRACTING OFFICER
The Contracting Officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.
XIII. CERTIFICATION BY THE TECHNICAL/REQUIREMENTS PERSONNEL
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein which is their responsibility are both accurate and complete.
