JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING/REQUIRING ACTIVITY
The 25th Air Force/Business Support Branch (25th AF/PK) located at 102 Hall Blvd, Suite 268, San Antonio, TX 78243-7034 is the contracting office for the requirements described herein.
The technical organization is 25th AF/National Intelligence Coordination Cell (NICC) Advanced Programs and Communications (XRC).
Purchase Request Number: F2MTA65002AC01 (Military Interdepartmental Purchase Request
(MIPR) F2BDED5012G001)
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
The purpose of this individual Justification and Approval (J&A) is to extend the period of performance (PoP) for one month in accordance with (IAW) Federal Acquisition Regulation (FAR) clause 52.217-8, Option to Extend Services of the basic contract. A contract modification will be executed for the extension of services to the Digital Integration for Combat Engagement (DICE) task order FA7037-12-D-0001-0007 entitled “AFISRA DICE” with Scientific Research Corporation (SRC), cage code 0D5A6, which was awarded on a competitive basis.
The extension of “AFISRA DICE” support services is to avoid any interruption which would impact 24/7 global situational awareness and other PWS requirements. The continued support services are required while the follow-on DICE Indefinite-Delivery-Indefinite-Quantity (IDIQ) Source Selection is being finalized. The Source Selection experienced approximately three weeks of unforeseen delays in resolving issues during the evaluation process. As a result of the change of command from Air Force Intelligence Surveillance and Reconnaissance Agency (AF ISR Agency) to 25th Air Force, the DICE Source Selection documents will require review by the Acquisition Management and Integration Center (AMIC) Contracting Office and Air Force Installation Contracting Agency (AFICA). The Contract Clearance Approval Authority is the AFICA/KC Director of Contracting (OL-ACC). As this is a new process and these offices are not co-located in San Antonio, the exact amount of time required to accomplish Contract Clearance is unknown. All offices are closely working together to ensure clearance is accomplished as quickly as possible and minimize the amount of time needed for the extension. At this time, the estimated award date of the follow-on DICE IDIQ and task order 0001 is on or about 9 Feb 2015.
The FAR clause 52.217-8 allows the Government to exercise the option more than once, but the total extension of performance shall not exceed six months. This extension of services will be for one month commencing 1 Feb 2015 through 28 Feb 2015 to ensure ample time for review, revisions and the potential resolution of a protest. Any additional extensions will be addressed in a new J&A.
The “AFISRA DICE” task order contains two firm fixed price (FFP) contract line item (CLIN) for DICE Labor (1001 and 1004), a cost reimbursable CLIN for Travel (1002) and a Not-Separately- Priced (NSP) CLIN for Data (1003). Only CLINs 1001, 1002 and 1003 will be extended, as the requirements for CLIN 1004 are no longer required.
The monthly estimated value of this continued support is $79,161.60 for Labor (CLIN 1001).
FY15 certified funds are available. The contract does not include a wage determination, and there will be no wage adjustment. The contract will utilize the previous established labor rates in the basic DICE IDIQ contract.
With this one month extension, the current total DICE IDIQ contract value will increase by $79,161.60, to $11,676,950.76, ensuring the contract maximum ceiling amount of $11,747,414 will not be exceeded. Since the dollar value of the IDIQ maximum ceiling amount does not change, this J&A only addresses the “AFISRA DICE” task order PoP extension.
The 25th AF/NICC-XRC Program Office and the 25th AF/PK Contracting Office believe that not exercising this option would adversely affect real-world operations.
The estimated award date for the contract modification is 30 Jan 2015.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S
NEEDS
The DICE mission provides the 25th AF Commander 24/7 global situational awareness. DICE is connected to every Combatant Command (COCOM) in the world and is capable of moving near real-time Intelligence, Surveillance and Reconnaissance (ISR) data directly to the Warfighter. It has changed the fight by adding ISR Link 16 day-to-day operations.
The scope of work requires the contractor to provide systems engineering, tasks and capabilities required to provide technical and analytical support to the 25th AF Operations Center, Department of Defense (DoD) and other Government agencies, such as the Joint Integrated Air & Missile Defense Organization (JIAMDO). DICE plans, manages, installs and trains ISR operators to move Top Secret/Sensitive Compartmented Information (TS/SCI) ISR data and deliver it to the military tactical data exchange networks used by the United States (U.S.), North Atlantic Treaty Organization (NATO) and nations allowed by the Multifunctional Information Distribution System (MIDS) International Program Office (IPO) Link 16, to the Warfighter.
The contractor shall perform analysis of architecture and operations to determine baseline capabilities; conduct gap analysis in regard to end-state vision provided by operational requirements and develop recommended solutions based on gap analysis for desired modernization and integration of ISR data link capabilities. Work shall be accomplished at
Nellis AFB, Nevada, and any other locations specified in the task order. The contractor shall recommend Tactics, Techniques and Procedures (TTPs), provide training, and perform installation preparation for the locations identified in the individual task order. The contractor shall perform systems engineering to include research and development (R&D) leading to the integration, test, installation, evaluation and training for sustainment and enhancement of existing data link technologies, including but not limited to Commercial-off-the-Shelf (COTS) and
Government-off-the-Shelf (GOTS), as well as Tasking, Collection, Processing, Exploitation, and
Dissemination (TCPED) capabilities for both materiel and non-materiel solutions including modernization leading to the integration, installation, evaluation and training for sustainment and enhancement of existing system infrastructures, architectures and technologies. The contractor shall provide on-site and virtual System Administration support to configure, update and manage all servers and systems with configuration control updates for all applications supported with Government authorization.
This requirement is of the same nature of support services that the contractor is currently performing on the “AFISRA DICE” task order FA7037-12-D-0001-0007.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
Title 10 U.S.C. 2304(c) as implemented by FAR 6.302-2, Unusual and Compelling Urgency need exists and circumstances justifying the extension. If the PoP is not extended, it would result in interrupted mission critical services. The Contracting Officer has determined the exercise of FAR clause 52.217-8, Option to Extend Services is of unusual and compelling urgency, as the current contract expires 31 Jan 2015.
IDIQ contract FA7037-12-D-0001 was awarded to SRC on 20 Sep 2012, on a competitive basis.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR
NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE
(APPLICABILITY OF AUTHORITY)
The nature of this acquisition requires the use of the Unusual and Compelling Urgency exception to the general requirement for full and open competition to prevent interruption of critical data link integration for the U-2, Global Hawk and Distributed Common Ground System (DCGS) Weapons Systems. This would result in mission-damaging work stoppage directly affecting data link operations around the entire ISR enterprise. It will have a ripple effect across the 25th AF DCGS and Air Force National Tactical Integration (AF-NTI) enterprise that would end in critical interruption and possible failure of the ISR data link operations. The extension of services will provide required support should delays arise in the award of the IDIQ contract. The AF does not have adequate military or civilian staffing to provide on-going DICE support for these missions which are tied to real world events.
The DICE team (25th AF/NICC-XRC) is the lead for data link integration, testing, certification and configuration management. This is a partnership between Secretary of the Air Force (Acquisition) (SAF/AQ), National Security Agency (NSA), Defense Information Systems Agency (DISA), Joint Interoperability Test Command (JITC) and other National Intelligence Community stakeholders.
The DICE IDIQ contract is the only contract vehicle that supports ISR Data Link operations at all phases of execution with uniquely qualified engineers. The engineers used under this contract are required to execute these evolving changes to data link requirements.
SRC’s knowledge and work in progress makes this contractor uniquely qualified to immediately perform the additional work. The on-going “AFISRA DICE” support services require continuity of services and awarding a contract to any other contractor would cause disruption in services, to include a duplication of effort, delays, and increased costs and would not meet the current mission schedule.
“AFISRA DICE” ensures uninterrupted mission coverage which enhances the reliability, integrity and confidentiality of data link operations to meet the needs of the ISR community. The ISR
TDLs are used to send vital information directly to the United States (U.S.) and coalition warfighters on the ground, to the cockpits or aircraft and to surface ships in the oceans of the world. Lengthening the kill chain, could expose U.S. and coalition forces to unnecessary risks.
It is imperative that “AFISRA DICE” prevent interruption of critical data link integration for 25th AF weapons systems.
All reasonably available acquisition resources are now being employed to ensure all documentation fully supports the final Source Selection decision. Allowing the existing contractor, SRC to remain in place ensures the Government’s critical needs for continuity of operations and avoids potential costs of disrupting operations.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
The proposed extension of services will not be synopsized IAW FAR 5.202(a)(11). The proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST
TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.
As stated in the FAR clause 52.217-8, the Contracting Officer will verify that the rates proposed are the same rates as those incorporated in the existing DICE IDIQ contract. Since the basic IDIQ contract was awarded on a competitive basis, the Contracting Officer has determined the anticipated costs of this extension of services will be considered fair and reasonable.
Pricing of the use of this clause was not evaluated in the original price negotiation memorandum. However, under the clause, the Government may require continued performance of any service within the limits and at the rates specified in the contract. The referenced contract does not include wage determination, and there will be no wage adjustment.
Contract will be extended within the limits and at the rates specified in the contract. The extension of services is within the scope of the contract.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A
STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED.
All reasonably available acquisition resources were employed in order to obtain a greater efficiency and productivity in spending and promoting competition for the DICE Source Selection.
The follow-on acquisition has been solicited under full and open competition procedures and is currently undergoing a competitive source selection. The Small Business Administration has concurred with these findings.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
Conducting a separate competition for a short bridge would significantly delay the support services provided by the “AFISRA DICE” task order. The technical, pricing, contracting, and past performance teams would have to divert focus from the on-going Source Selection to support a separate contract effort. It is impracticable and does not make good business sense to conduct a separate competition to address the requirements under the proposed modification as doing so would take a tremendous expenditure of additional resources.
X. LIST OF SOURCES, IF ANY THAT EXPRESSED INTEREST IN THE ACQUISITION.
See Section VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT
ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED.
In order to remove or overcome the barriers to competition, the Government has unlimited rights to all information. The on-going Source Selection for the follow-on acquisition was solicited under full and open competition procedures to foster competition.
XII. CONTRACTING OFFICER’S CERTIFICATION
The contracting officer’s signature on the Coordination and Approval document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein which is their responsibility are both accurate and complete.
