Justification and Approval (J&A) for Other Than Full and Open Competition
I. Contracting Activity.
The Air Force District of Washington Contracting Directorate (AFDW/PK) executes this Justification and Approval (J&A) for the acquisition of commercial items pursuant to Federal Acquisition Regulation (FAR) Subpart 13.5 - Simplified Procedures for Certain Commercial Items.
II. Nature and/or description of the action being processed.
AFDW/PK intends to award a sole-source Purchase Order (PO) to Leidos Innovations Corporation (DUNS: 080272604; CAGE:
7LQ18) ("Leidos") using other than full and open competition procedures. This will be awarded as a new contract action and the contract type anticipated is Firm-Fixed Price (FFP) for labor with a Cost-Reimbursable (CR) CLIN for travel.
AFDW/PK competed a follow-on effort on NETCENTS NetOps and Infrastructure Solutions however it is under protest with the GAO. GAO has until 22 February 2016 to issue its Opinion. The current contract expires 31 Dec 2016.
III. Description of supplies/services required to meet agency needs.
This requirement shall provide Information Technology (IT) support service to Air Force Personnel Operations Activity (AFPOA), supporting the human resource needs of Airmen and families throughout the Total Force.
This requirement is to bridge services provided to AFPOA until the protested award decision for NETCENTS-2 Solicitation F1AF1C5223A001 is resolved in order to avoid an unacceptable delay.
Under the PO, Leidos will provide approximately labor hours, or approximately Full-Time Equivalents (FTEs), over the 6-month performance of this PO from 1 January 2017 through 30 June 2017 and 3400 appropriations will fund this effort.
IV. Statutory authority permitting Other than Full and Open Competition.
41 U.S.C. 1901 Simplified Acquisition Procedures, as implemented by FAR Subpart 13.5 - Simplified Procedures for Certain Commercial Items, required by FAR 6.303-2(b)(4).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
An unacceptable delay in fulfilling AFPOA's requirement will result if Leidos is not awarded this contract. Under Task Order (TO) FA8734-08-D-0003-0029 ("TO 0029"), Leidos, formerly Lockheed Martin Services, Inc. ("LSMI"), has been satisfactorily providing AFPOA the highly specialized IT support service required since 29 February 2016. Note, on 16 August 2016, this subsidiary of Leidos Holdings, Inc. merged with the entirety of LSMI, resulting in Leidos (the "Transaction"). In connection with that Transaction, the entire former LSMI responsible for performing TO 0029, including all of its assests, key personnel, business processes, knowledge and experience, and past and present contracts, was transferred to and became part of Leidos. Accordingly, Leidos is the full successor-in-interest of TO 0029. TO 0029 expires 31 December 2016.
NETCENTS-2 NetOps and Infrastructure Solutions Small Business Companion's Solicitation F1AF1C5223A001 was anticipated to be the competitive follow-on effort to TO 0029 with a projected transition start date of 17 November 2016. Solicitation F1AF1C5223A001 was awarded on 6 November 2016 but the award decision was protested to the Government Accountability Office (GAO) on 14 November 2016. As such, the Air Force will not have contractor support following the expiration of TO 0029.
There is not enough time to process a competitive award for this contract as there will be an unacceptable delay of technical support service of the Air Force's human resource applications, functions, and its associated IT equipment such as Windows Operations, A1 Service Desk, Business Objects, and Enterprise Architecture. Competing similar requirements takes an acquisition lead time of approximately 12 months, not including at least 1 month of transition.
Justification and Approval (J&A) for Other Than Full and Open Competition
Leidos is the only contractor with the immediate resources, considering experience and skill level, to adequately perform IT service support required of this effort without causing an unacceptable delay or otherwise negatively impacting the mission.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Notice of Intent / Sources Sought was posted to FedBizOpps at www.fbo.gov on 13 December 2016 with only one response form .
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
In accordance with (IAW) FAR 13.106-3(a)(2)(vi) comparison to an independent Government estimate, the Contracting Officer (CO) determined the anticipated cost to the Government will be fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted and concluded that only one responsible source will satisfy Air Force requirements because award to any other source would result in unacceptable delays in fulfilling the Air Force's requirements.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
Other facts are not applicable.
X. List of sources, if any, that expressed interest in the acquisition.
expressed interest and is capable of providing IT support, enterprise architectures, data storage, and consulting services. However, with a need date of 1 Jan 2017 for (or any new contractor) the government would have to prepare and release an RFP. and others would require time to analyze the requirement and prepare a proposal.
Following proposal receipt, the government would have to evaluate proposals, make a selection and award the contract.
Full performance could not start until the successful offeror completed a 30-day transition period. During this month long process there would be no IT operations coverage for AFPOA. This would be unacceptable and constituent mission failure.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
It is not anticipated barriers to competition will be required after the expiration of this PO. Therefore, the Air Force will remove barriers to competition before making subsequent acquisitions for the services required.
