4. AUTHORITY:

Title 10 USC 2304(c)(1) or Title 41 USC 253(c)(1), as implemented by FAR 6.302-1(c), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. The brand name description is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. APPLICABILITY OF AUTHORITY:

An essential part of AFOSI’s mission is to identify, exploit, and neutralize criminal, terrorists, and intelligence threats to the U.S. Air Force, DoD, and U.S. Government. The (Spell out name) CI&O program is responsible for completing the mission through: (1) Resolving Air Force related cyber intrusions; (2) Proactive cyber operations; (3) Specialized investigative support; and (4) Digital media analysis. Only ProDiscover IR® enables AFOSI cyber crime investigators to meet this mission and has done so over the past several years by providing a platform to forensically collect and analyze digital evidence from multiple operating systems (Windows, Linux, AIX, OS X, and UNIX). ProDiscover IR® meets the Government’s requirement for remote acquisition of digital evidence.

6. EFFORTS TO OBTAIN COMPETITION:

AFOSI purchased ProDiscover IR® circa 2007 to fulfill an essential requirement to operate and investigate remotely. This application has been a mainstay in the CI&O program for the application to stay relevant to current threats and nuances involved in conducting digital evidence analysis and thus allows OSI to visualize network data in support of counterintelligence and criminal operations and investigations.

AFOSI purchased ProDiscover IR® to replace Guidance Software’s Field Intelligence Module (FIM) because circa 2005 changes to their end user license agreement (EULA) for the FIM prevented AFOSI from using to use the tool to fulfill the CI & O mission. Market research shows thatProDiscover IR® is owned and developed solely by Technology Pathways, LLC.

If Air Force OSI used the more expensive Guidance Software product, in lieu of the current ProDiscover IR®, there would be additional expense over and above AFOSI’s investment to date through duplication of procurement and training costs to develop expertise in a different system.

This brand name requirement will be posted to FedBizOpps in the event there are any authorized distributors.

7. ANTICIPATED COST IS FAIR AND REASONABLE:

Cost will be evaluated and determined fair and reasonable.

8. MARKET RESEARCH:

Research was conducted, both through the Internet as well as interview with the Defense Computer Forensics Laboratory, to identify additional companies that may distribute software updates to ProDiscover IR®. Our searches disclosed Technology Pathways, LLC, as the sole proprietor of ProDiscover IR®. Written confirmation of this has been received. If any valid quotes are received from other than the proprietor, they will be considered.
