52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (APR 2009) (DEVIATION)

(a) Comptroller General Examination of Record. The Contractor agrees to comply with the provisions of this paragraph (a) if the contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to the right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times, the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(b)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(i) 52.203-13, Contractor Code of Business Ethics and Conduct (DEC 2008) (Pub. L. 110-252, Title VI, Chapter 1 (41 U.S.C. 251 note).

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 Days.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 Days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 Months.

5352.201-9101 OMBUDSMAN (AUG 2005)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMBC A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Mrs. Diane Dade, 1535 Command Drive, Suite 202, Andrews AFB, Camp Spring MD, 20762 Phone # 301-981-7342. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067.

(d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.

5352.242-9000 CONTRACTOR ACCESS TO AIR FORCE INSTALLATIONS (AUGUST 2007)

(a) The contractor shall obtain base identification and vehicle passes for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.

(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or security police for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver's license, current vehicle registration, and valid vehicle insurance certificate to obtain a vehicle pass.

(c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.

(d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with AFI 31-101, Volume 1, The Air Force Installation Security Program, and AFI 31-501, Personnel Security Program Management, as applicable.

(e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.

(f) Failure to comply with these requirements may result in withholding of final payment.

STATEMENT OF WORK

FOR

USAF HONOR GUARD BARBER SERVICES

1.0. Description of Services.

1.1. SCOPE OF WORK. The contractor shall provide all supervision, personnel, transportation, and other services necessary to provide barber services to the United States Air Force Honor Guard (USAF HG) located at BLDG 47, 50 Ducan Avenue, Bolling AFB, DC 20032.

1.2 HONOR GUARD HAIR STYLES. The contractor shall perform barber ing services in accordance with Air Force Instruction (AFI) 36-2903/USAF HG SUP 1. Male Sideburns and “square back” trims are prohibited. The length of hair is precribed as follows: The hair will be neatly trimmed and cut close (skin) around the back and sides of the head at all times; graduating to 1/2 –inch where the hair lays under the hatband. Hair above the hatband will not exceed 3-inches in length or 1-inch in bulk. Female hairstyle (bulk of hair) must not exceed three inches or prevent wearing of the ceremonial hat. Hair length will comply with AFI 36-2903 except as noted in this instruction. “Bangs” will not touch the brows.

1.3 BARBER. The contractor shall perform two styles of USAF Honor Guard haircuts “High and Tight” and “Clean Shave”. Straight razor shall be used with warm lather for male Clean Shave cut. At the end of each hair cut an alcohol base shall be applied where hair was shaved. Scissors shall used when cutting females. The contractor shall clean down their workstation after each patron. Handlebar mustaches, goatees, and beards are not authorized.

1.4 hAIR CUT STANDARDS. The hair on top of the head must be neatly groomed. The length and bulk of the hair may not be excessive or present a ragged, unkempt, or extreme appearance. The hair must present a tapered appearance. Hair must not interfere with the normal wear of headgear or protective masks or equipment.

1.5. CONTRACTOR QUALIFICATIONS. The contractor shall meet the minimum qualifications as identified below.

1.5.1 Contractor shall provide two professional barbers with a certified barber license and shall have at the minimum 2 years of consistent hair cutting experience.

1.5.2 Contractor shall be familiar with AFI 36-2903/USAF HG SUPPLEMENT 1 paragraph 7.3 and 7.31 DRESS AND PERSONAL APPEARANCE OF USAF HONOR GUARD PERSONNEL. The contractor shall perform in accordance with AFI 48-117 PUBLIC FACILITY SANITATION, paragraph 7, Barber and Beauty Shop Requirements; paragraph 8, Health and Personal Hygiene of Barber and Beauty Shop Hairdressers; paragraph 9, Taking Care of and Disinfecting Instruments and paragraph 13, Medical Evaluation of Public Facilities. See Appendix A.

1.6 General Information.

1.6.1 QUALITY CONTROL. The contractor shall develop and maintain a Quality Control Plan (QCP) to ensure barbering services are performed in accordance with AFI 36-2903 and other applicable standards and codes. The contractor shall develop and implement procedures to identify and prevent defective services from recurring. As a minimum, the contractor shall develop quality control procedures that address the areas identified in paragraph 2, Service Summary. The government personmel must have a specific quality control inspector to notify in case of customer complaints. A copy of the QCP shall be submitted to the contracting officer for approval within 30 calendar days after contract award.

1.6.2 QUALITY ASSURANCE. The government will periodically evaluate the contractor’s performance in accordance with the Performance Plan. The government will evaluate the contractor’s performance through intermittent on-site inspections of the contractor’s quality control program and receipt of complaints from base personnel. The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or repeated customers complaints. Likewise, the government may decrease the number of quality control inspections if performance dictates. The government will also receive and investigate complaints from various customers located on the installation. The contractor shall initially validate customer complaints. However, the government representative shall make final determination of the validity of customer’s complaints in cases of disagreement with customer(s).

1.6.3 PERFORMANCE EVALUATION MEETING. The contractor may be required to meet at least monthly with the QAP and Contracting Officer (CO) during the basic year of the contract. Meetings will be as often as necessary thereafter a determined by the QAP. However, if the contractor requests, a meeting will be held. The written minutes of all performance evaluation meetings shall be signed by the contract representative, CO, and QAP. Should the contractor not concur with the minutes, the contractor shall so state any areas of nonconcurrence in writing to the CO within ten calendar days of receipt of the signed minutes.

1.6.4 Compliance with Laws and Regulations. The service provider shall be knowledgeable of and shall comply with all applicable federal, state, and local laws, permits, Department of Defense (DoD), AF, and base requirements and instructions required for the performance of the duties in this SOW. The service provider shall ensure policies and procedures are established that protect the safety and welfare of customers, employees, and the community to minimize or eliminate safety or environmental pollution risks.

1.6.5 Indemnification. The contractor agrees to indemnify and hold the Government and the Department of the Air Force harmless, whether in tort or in contract, for any and all loss or liability for injury to or death of service provider personnel in transit to, from or during the period of attendance at any of the required locations in support of this production.

1.6.6 BASE ACCESS. The contractor shall ensure compliance with all federal, DoD, AF, and Bolling AFB vehicle identification policies for contractor-owned vehicles. The contractor shall complete AF Form 75, Request for Visitor/Vehicle Pass and DD Form 1172, Application for Uniformed Services Identification Card and submit them to Security Forces, Pass and registration. Vehicle registration, proof of insurance and a valid driver’s license shall be presented for all vehicles to be registered. The contractor shall submit a complete list of all employees performing on this contract through the Contracting Officer to the Security Forces. Lost vehicle and entry passes shall be reported immediately to the Security Police and Quality Assurance Personnel.

1.6.7 HOURS OF OPERATION. The contractor(s) shall be available on site 0800-1700 Sundays, and 0600-1500 Monday-Thursdays. For emergency barber service (due to State Funerals, Joint Service Arrivals, Out of Town Funerals, or any other major ceremony), the contractor(s) shall be able to respond to emergency calls from USAF HG leadership within 1 hour any day of the week. Once the contractor responds within 1 hour they shall report on site within 1 hour.

1.6.8 federal holidays. The contractor shall not be required on site for the listed Federal Holidays observed by this installation: Columbus Day, Veterans Day, Thanksgiving Day, Christmas and Inauguration Day but for any emergency barber service (due to State Funerals, Joint Service Arrivals, Out of Town Funerals, or any other major ceremony) contractor(s) shall be able to respond to recalls from USAF HG leadership within 1 hour. Once the contractor responds within 1 hour they shall report on site within 1 hour.

1.6.9 PEFORMANCE OF SERVICES DURING CRISIS DECLARED BY THE NATIONAL COMMAND AUTHORITY OR OVERSEAS COMBATANT COMMANDER. The contractor shall perform all services under this contract during a national emergency or crisis according to the Department of Defense Instruction (DODI) 3020.37. The contractor is expected to perform emergency or special event services as indicated in paragraphs aforementioned, unless otherwise advised by an authorized government representative.

1.6.10 WARRANTIES. The contractor warrants that work performed under this contract shall conform to the contract requirements and shall be free of any defects. The contractor shall remedy at the contractor’s expense any defects noted by the Contracting Officer. The contractor shall provide a written warranty agreeing to repair or replace items that fail in workmanship under this contract. Materials provided by the contractor shall be manufacturer’s standard warranty.

1.6.11 GOVERNMENT REMEDIES. The contracting officer shall follow FAR 52.212.4, Contract Terms and Conditions-Commercial Items for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.6.12 CONTRACTOR FURNISHED ITEMS AND SERVICES. Except for those items or services specifically stated as Government Furnished Property/Services or government reimbursed, Appendix 4a, 4b, and 4c, the contractor shall furnish everything required to perform this contract.

1.6.13 CONTRACTOR PERSONNEL.

1.6.13.1 The contractor shall provide a senior barber who shall be responsible for the performance of work on site. The senior barber shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The senior barber shall be available at all times to meet at Bolling AFB with government personnel to discuss problem areas. The senior barber shall have a minimum of 5 years full barbering service management experience. The contactor shall provide resumes substantiating the qualifications of the senior barber of this position, in performing on this contract, along with the proposal. The positions shall at no time be vacant.

1.6.13.2 CONTRACTOR EMPLOYEES. The contractor shall ensure that all employees have current and valid certificates before starting work. The contractor shall maintain copies of the barbering certificates at the duty location. The contractor shall provide qualified and trained employees for all equipment used in this contract. Additionally, the contractor shall ensure employee familiarization with OSHA and Air Force Safety Standards. Employees with expired certificates shall not be scheduled for work. The contractor shall keep a current list of names of personnel employed on this contract reflecting the expiration date of certificates.

1.6.13.2.1 The contractor shall not employ persons for work on this installation if such employee is identified to the contractor by the contracting officer as a potential threat to the health, safety, security, general well being, or operational mission of the installation and its population.

1.6.13.2.2 Listing of Employees. The contractor shall maintain a current listing of employees. The list shall include employee’s name, social security number. The list shall be validated and signed by an authorized personnel from the company and provide a copy to the contracting officer prior to the contract start date. Updating listings shall be provided when an employee’s status or information changes.

1.6.13.2.3 The management and control of contractor employees in the performance of this contract shall be the responsibility of the contractor; however, the contractor shall comply with the contract requirements and Bolling Air Force regulations concerning conduct of employees.

3.0 Government Furnished Property and Services

3.1. Government-Furnished Utilities. The government will furnish utilities for the operation of the facilities provide. These utilities include heating, fuels, gas, electricity, water, sewer, postal distribution, refuse collection, fire and police protection and sever emergency medical.

3.2. Conservation of Utilities. The contractor shall ensure employees practice utilities conservation. The contractor shall operate under conditions that prevent the waste of utilities to include; turning off lights and water faucets w hen not in use.

3.3. Government Owned. The contractor shall be responsible for operating the government owned equipment. Should any item require repair or replacement due to negligence, the contractor shall be responsible for all such repairs or replacement at no cost to the government. The Government shall be responsible for replenishing all equipment and materials used only during the performance of this contract. Before any modification to the equipment is performed, the contractor shall provide to the NCOIC of Supply all documentation detailing the modification requested. All modifications shall be at the contractor’s expense. The contracting officer shall make no modification to any equipment without written approval.

3.4. Equipment Inventory. An inventory of government furnished equipment must be done not later than 2 calendar days before the start of the contract period. The contractor and a government representative (identified by the contracting officer) shall conduct a joint inventory of all Government-furnished equipment and materials. The contractor shall sign a receipt for all equipment and materials provided by the government. Items of equipment missing or not in working order shall be recorded and the contracting officer notified in writing. The contractor and the government representative shall jointly determine the working order and condition of all equipment and document their findings on the inventory.

3.5. Loss or Damage.

3.5.1 The contractor shall submit requests for replacement of government-furnished equipment to the NCOIC of Supplies for processing. Such requests shall specify the reason for equipment replacement.

3.5.2 The government shall replace materials that are lost due to wear and tear. The Government owned tools, parts, equipment and materials provided to the contractor(s) for barber services, shall remain in the USAF HG barber shop at all times unless given permission by USAF HG leadership. See Appendix B.

Add paragraph (m), Preparation of Proposal.

1. This section specifies the format that offerors shall use in this Request for Proposal (RFP). The intent is not to restrict the offerors in the manner in which they will perform their work, but rather to ensure a certain degree of uniformity in the format of the response for evaluation purposes.

2. The offerors’s proposal, as a minimum, shall consist of past performance information, price proposal, and a signed SF 1449. The offeror shall acknowledge all amendments and complete the necessary fill-ins and certifications in provisions 52.212-3 and return in their entirety with proposals. The Government contemplates incorporating the price proposal into any resulting contract. The Government, at its discretion, may incorporate all or portions of an offeror’s proposal at contract award.

3. The offeror’s proposal shall provide convincing rationale to address how the offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the offeror’s proposal. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

4. The proposal must include all data and information requested by the Instructions To Offerors (ITO) and must be submitted in accordance with these instructions. The offer shall be compliant with the requirements as stated in Statement of Work (SOW). Non-conformance with the instructions provided in this section may result in offeror’s proposal being determined unacceptable.

5. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the offeror intends to meet these requirements.

6. Proposal Format and Content.

i. Paper, Page Size, and Format. Page size shall be 8.5 x 11 inches. Pages shall be single-spaced. Use at least 1-inch margins on the top, bottom, and side margins.

ii. Text Spacing and Type. Except for the reproduced sections of the solicitation document, the text size shall be no less than 10 point. Pages shall be numbered sequentially by section.

7. Distribution. Proposal shall be hand-delivered or mailed, and proposals must be received by 4:00 p.m. Eastern Standard Time (EST) on 12 August 2009 to the following address:

8. Special Instrustions.

To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. The proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation. The responses shall consist of two (2) separate parts; Part I- Past Performance Information, Part II-Technical Proposal, and Part III – Price Proposal

A. PART I – PAST PERFORMANCE INFORMATION SECTION – Only references for same or similar type contract desired. Submit original and one (1) copy.

(1) Quality and Satisfaction Rating for Contracts Completed in the Past five (5) years from the closing date of this solicitation. Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.), which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract in the past five years. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.

(2) Offeror shall provide the past performance survey at attachment 2 to their references for them to complete and mail or fax directly to the contracting office, attention Anthony Vaughn. The mailing address is listed in paragraph 7 above and the fax number is 202-767-7887. The Government will evaluate the quality and extent of offeror’s experience deemed relevant to the requirements of this RFP. The Government will use information submitted by the offeror and other sources such as the Federal Government offices and commercial sources, to assess experience. Provide a list of no more than five (5) of the most relevant contracts performed for Federal & Local agencies and commercial customers within the last 5 years that demonstrate your ability to perform the proposed effort. Relevant contracts include providing full barbering services and maintaining the barber shop and upkeep of equipment. Past performance regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement will be given a rating. Offerors with no relevant past or present performance history shall receive the rating “neutral”, meaning the offeror is rated neither favorable nor unfavorably.

(3) If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past/present performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of past and present relevant contracts.

(4) Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor. Provide a brief description of any pending disputes or claims. Be specific in identifying a problem and describing its resolution. This information is required as the government may award without discussions.

(6) The Government will evaluate each offeror on its performance under existing and prior contracts for similar services. The Government will use performance information for both responsibility determinations and as an evaluation factor in determining the acceptability of an offeror. The Government may contact references, other than those identified by the offeror, and use the information received to evaluate the offeror’s past performance.

B. PART II – TECHNICAL PROPOSAL SECTION – Submit an original and one (1) copy.

Technical Capability: Subfactors: Senior Barber and Quality Control

Subfactor 1 – Senior Barber: The offeror shall outline functional relationships and lines of authority and responsibility. The offeror shall describe how he/she will develop an effective approach to quickly provide qualified personnel to perform the required services. The offeror shall describe in detail a sound plan for sustaining trained and qualified personnel. The offeror shall submit adequate resumes for key personnel. The offeror shall provide sufficient information within the resumes to detail the personnel education, experience, licenses as well as any other information relative to performance of this contract. Failure to submit resumes on key personnel may result in the offeror’s proposal being eliminated from further consideration for award for failure to submit an acceptable proposal.

Subfactor 2 - Quality Control Plan: The contractor shall submitt a detailed plan addressing all of the requirements of the SOW; addressing all aspects of quality control to implement procedures to identify and prevent defective services from recurring; acceptance, rejection, documentation, and resolution of deficiencies and corrective action; interface with government inspectors; and describing the records; and comply with all requirements of the SOW. The proposal shall contain a brief description to be used to identify unfavorable trends and problem areas.

C. PART III – COST/PRICE SECTION – Submit an original and one (1) copy.

(1) Complete blocks 12, 17a, 17b, 30a, 30b and 30c of the Standard Form 1449. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP. This RFP constitutes the model contract.

(2) Insert proposed unit and extended prices for each Contract Line Item, including all option periods, on pages 3 through 7. The offeror shall include a fully completed price schedule of the solicitation in this section of their proposal. Any offeror, which fails to cite a price for each item, or fails to make an entry, indicates that work will be provided at no charge.

(3) Note that unrealistically low or high proposed costs or prices may be grounds for eliminating a proposal either on the basis that the offeror does not understand the requirement or has made an unrealistic proposal. Offer should be sufficiently detailed to demonstrate their reasonableness. The burden of proof for credibility of proposed costs/prices rest with the offeror.

(4) Offeror shall submit as minimum, the following financial information: (1) the name of their current financial institution, (2) the name and phone number of their bank representative, and (3) the type of services their financial institution provides their business.

(5) If additional information is required to support price reasonableness, each offeror may be requested to provided a hard copy of the the following information listed below from the prime offeror and any subcontractors.

(i) Direct Labor- List the straight time and overtime productive labor hours, whether compensated or uncompensated, and the average hourly rates and cost for each individual job classification. Provide supporting rationale and methodology used for labor rate development of each classification.
