APPROVED:

STEPHANIE E. LATHAM

380 ECONS, Contracting Officer

JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

Contracting Activity: 380th Expeditionary Contracting Squadron Al Dhafra AB, UAE

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

The 380th Expeditionary Contracting Squadron proposes to procure by means of other than full and open competition under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2)(iii)(B), Only One Responsible Source, a sole-source Firm Fixed Price bridge contract to continue the service of Heating Ventilation and Air Conditioning (HVAC) Support at Al Dhafra Air Base (ADAB).

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The Contractor shall provide services to include all cooling equipment but not limited to, flex ducting, generator, power panels, commissioning engineers, transportation, crane support equipment, and all other equipment necessary to provide proper cooling in support of two (2) hangars, maintaining the existing 244 tons of cooling on site for each hangar.

The period of performance for the existing contract, FA5706-13-C-0010, ends 24 May 2014. The estimated period of performance for the bridge contract will be 25 May 2014 thru 24 Aug 2014 for a total of up to three months. The bridge contract will be a firm-fixed price contract with an anticipated value of $35,553.81 per month for a TOTAL of $106,661.43.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii)(B) – Only One Responsible Source

V. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

Aggreko is the incumbent contractor for this requirement. A solicitation was posted on 29 April 2014 to acquire continued support after expiration of the current contract. Requirements changes made after solicitation was posted interrupted the acquisition process. The requirement is now under review. This service is still required and the incumbent contractor is the only source able to obtain base access and provide uninterrupted services until another contract is awarded for continued service. A break in service would result in mission degradation/stoppage within the facility. This facility houses operations which are critical to execution of the Air Tasking Order; any degradation/lapse in service could interrupt combat operations.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

A new acquisition was being competed using full and open competition through RFQ FA5706-14-R-0003 on FBO.gov, but was cancelled in order to re-evaluate requirements and provide time for a site visit to better enhance competition. Additional time is required to award the follow-on contract given the current circumstances and, potentially, transition to a new contractor

Market research indicated the future acquisition of this service will be for a 2.5 year period of performance. The next acquisition of this service will be competitively procured using full and open competition.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer has determined the anticipated price to the Government will be fair and reasonable based on the current rates in the contract and recent market research conducted during the follow-on solicitation period.

VIII. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

N/A

VIII. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

N/A

IX. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Justification Review Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)).

X. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Justification Review Document, the technical and/or requirements personnel have certified that any supporting data contained herein which is their responsibility is both accurate and complete (FAR 6.303-2(b)).
