F-3 NORMAL WORK HOURS
Normal work hours at Al Dhafra Air Base are from 6:00 am to 6:00 pm, Saturday through Thursday, excluding holidays. Access to work sites may be restricted to these hours and days. Work that requires inspection during accomplishment or that prevents inspection of previous work after accomplishment normally will not be allowed during other than normal work hours specified above. The Contracting Officer must approve work during other than normal hours. Request must be submitted in writing, 24 hours in advance and shall include proposed work hours and outline specific work to be performed.
F-4 U.A.E. MID-DAY SUMMER LABOR LAW
The contractor shall follow all local labor laws, including any labor restrictions placed upon work hours during the summer months. It is imperative that the contractor familiarize itself with all laws and restrictions and ensure their work plan takes into account the effect of any law on the overall performance of the contract.

Consideration for late performance shall be negotiated on a case-by-case basis. Otherwise the clauses in this agreement apply.

The Contractor shall be required to:
(a) commence work under this contract within 10 Calendar Days after the date the Contractor receives the Notice to
Proceed
(b) prosecute the work diligently, and
(c) complete the entire work ready for use not later than 120 calendar days after the issuance of the Notice to
Proceed. The time stated for completion shall include final cleanup of the premises. (End of Clause)

G-1 INVOICING PROCEDURES
The contractor shall provide a proper invoice. A proper invoice shall include the following information:
Name, address of the business concern, invoice number, and the invoice date
Contract number or other authorization for delivery of property and/or services (including order number and contract line item number)
Description, price, and quantity of property or services actually delivered or rendered
Shipping and payment terms
Other substantiating documentation or information as required by the contract
Name (where applicable) title, telephone number, and complete mailing address of the responsible official to whom payment is to be sent
It is important that the invoice match the schedule of supplies and service of the contract to avoid delays in processing invoices submitted
Submit invoices to the contracting office via e-mail shown in the invoicing paragraphs in this order.

SECTION H - SPECIAL CONTRACT REQUIREMENTS

SPECIAL CONTRACT REQUIREMENTS
H-1 GOVERNING LAW
This contract shall be construed and interpreted in accordance with the substantive laws of the United States of
America. By the execution of this contract, the Contractor expressly agrees to waive any rights to invoke the jurisdiction of local national courts where this contract is performed and agrees to accept the exclusive jurisdiction of the U.S. Armed Services Board of Contract Appeals and the U.S. Court of Federal Claims for the hearing and determination of any and all disputes that may arise under the Disputes clause of this contract.
H-2 SECURITY / PASS REQUIREMENTS (July 2004)
a. The contractor shall follow existing security procedures and instructions applicable to Al Dhafra AB, UAE (see Section J, Host Nation Gate Entry Procedures for more detail). The U.S. shall not be liable for delays caused by inaccessibility through the Emirati Gate. The Host Nation base will not grant access for individuals of the following nationalities: IRAN, IRAQ, CUBA, CHINA, LIBYA, TURKEY, AFGHANISTAN, SYRIA, PALESTINE, SUDAN, YEMEN, JORDAN, AND NORTH KOREA.
b. The contractor shall submit pass request applications to the Contracting Officer (CO) within 72 hours after receipt of “Notice of Contract Award”. The pass request applications require coordination with the Host Nation
Liaison. The U.S. Air Force shall not be liable for delays resulting from Emirati pass coordination/approval.
Contractor shall be required to submit completed DBIDS application along with completed application for Emirate pass. DBIDS pass requirements are in addition to Emirate entry requirements and require an additional 5 days processing time once Emirate pass is completed. Upon notification, contractor will have 72 hours to bring all personnel working on the contract to complete biometrics and demographics processing. Contractor shall be liable for completing all requirements within the specified time frames. No extensions on work will be granted due to delays from Emirati pass coordination/approval. Failure to complete and submit required entry pass documentation will result in contractors being refused entry onto base.
c. The work site is located in a restricted or controlled area. The contractor may therefore experience delays due to compliance with entrance/exit requirements of restricted/controlled areas. The maximum amount of delay should not exceed four (4) hours per occurrence.
H-3 ESCORTS
Contractors are responsible for providing all transportation to and from the worksite, to include transportation between the host nation gate and the Vehicle Search Area. Upon entry through the US Air Force
Al Dhafra Gate, contractor personnel are required to be in the presence of a military escort at all times. The U.S. Air
Force shall provide escorts. The contractor shall comply with escort directions. Initial contractor personnel/escort requirements shall be discussed at the Pre-construction Conference. The contractor shall notify the designated
Project Inspector 48 hours in advance of any revised personnel/escort requirements. The contractor shall notify the designated Project Inspector 24 hours in advance of any change in time that the escorts shall meet the contractor and/or when the number of contract workers increases or decreases. The contractor will not be able to start work until escort arrangements are made. The U.S. Air Force shall not be liable for delays caused by the contractors’ failure to follow the above notification requirements.
H-4 SECURITY / SEARCH
a. Upon entry through the Al Dhafra AB Gate, contractor personnel and vehicles shall process through the search area.
b. Materials including but not limited to concrete, asphalt, asphalt emulsions, and water require search and surveillance by U.S. Air Force personnel from the point of origin to the search area inside the Al Dhafra Gate. The contractor shall notify the designated Project Inspector five (5) days in advance of the scheduled delivery.
The contractor shall immediately notify the Project Inspector of changes. Changes shall require an additional five (5) days for Government personnel coordination. The U.S. Air Force shall not be liable for delays resulting from the contractor’s failure to follow the above notification requirements or supplier/contractor delivery changes.
c. Tanker truck/trailer cargo compartments shall allow for a complete visual inspection. All tanks and all baffled sections shall have a minimum 3 ft / .91meter diameter visual inspection port. Equipment not meeting the above specifications shall not be allowed entry onto Al Dhafra AB. The U.S. Air Force shall not be liable for delays caused by equipment not meeting the above requirements.
d. CAMERA AND TELEPHONE USE PROHIBITION: Contractor personnel working on Al Dhafra Air
Base are prohibited from using or bringing onto base any telephone instruments, (to include but not limited to, cell, mobile, land line and satellite phones, fax machines, and pagers) without expressed pre-approval of responsible security personnel. Sim cards, HD cards, computers, or any other computer-type paraphernalia is prohibited from being brought onto base unless pre-approved of responsible security personnel has been obtained. For permission to use telephones on base consult the Contracting Officer (CO) in advance. At no time are cameras or cell phones with cameras allowed on Al Dhafra Air Base.
H-5 UTILITIES
(a) For the purpose of this contract, where available, utilities, construction water, electricity, etc., will be furnished at no cost to the Contractor. The Contractor will be required to participate in all energy conservation programs. All temporary connections, outlets and distribution lines, as may be required, shall be installed by the Contractor at his own expense.
(b) The contractor will be required to provide an appropriate number of restroom facilities at the worksite for employees.
(c) Water for most construction activities in Al Dhafra is very limited and under most circumstances will not be provided by the U.S. Government. The contractor shall notify the designated Project Inspector within 24 hours in advance of construction water requirements. The contractor shall furnish all equipment, material, and labor necessary to obtain and deliver water to the work site(s). The U.S Air Force shall not be liable for delays caused by the contractor’s failure to follow the above notification requirements.
(d) The contractor shall be responsible for providing ample drinking water for their personnel, subcontractors, and any other non U.S. Government personnel linked to the project in any way.
(e) Contractor shall notify the Contracting Officer in writing two weeks prior to any utility outage anticipated during the performance of this contract.
H-6 ENGLISH SPEAKING REPRESENTATIVE
At all times when any performance of the work at any site is being conducted by any employee of the Contractor or its subcontractors, the Contractor shall have a representative present at each site who has the capability of reading, writing, speaking, and receiving instructions in the English language and can explain the work operations to persons performing the work in the language that those performing the work are capable of understanding. The Contracting
Officer shall have the right to determine whether the proposed representative has sufficient technical and lingual capabilities.
H-7 ENVIRONMENTAL IMPACT/COMPLIANCE WITH APPLICABLE FEDERAL, STATE AND
LOCAL REQUIRMENTS
All waste materials generated by work under a contract performed on a U.S. Government installation shall be handled, transported, stored, disposed of, and treated by the contractor and any subcontractor in accordance with all applicable federal, state, and local laws, ordinances, regulations, executive orders, agency rules or order, court orders, or any other types of rules or ruling having the effect of the law. In performing or under this contract, the contractor shall comply with all other relevant federal, state and local statutes, ordinances, regulations, executive orders, agency rules or orders, court orders or any rules ruling having the effect of law. Contractor shall be;
contacted; and federal, state, and local environmental compliance regulations or any other types of rules or rulings having the effect of law.
H-8 MATERIAL & EQUIPMENT EXIT PERMIT
Prior to removing material and/or equipment from Al Dhafra, the contractor shall notify the designated Project
Inspector 48 hours in advance of any requirement to remove material and/or equipment from Al Dhafra. The U.S.
Air Force shall not be liable for delays resulting from the contractor’s failure to follow the above notification requirements. The U.S. Air Force shall not be liable for delays resulting from permit coordination/approval.
H-9 INSPECTION AND SURVEILLANCE
The Project Manager and Construction Manager from Civil Engineering are designated as the representatives of the
Contracting Officer for the purpose of surveillance and inspection of performance of work under this contract. This designation does not include authority to direct or authorize the Contractor to make changes in the scope or terms of the contract without the written authority of the Contracting Officer. Contractor shall notify the Contracting Officer at least 24 hours in advance, date work will commence under this contract; contractor shall also notify that office at earliest possible time of anticipated absence(s) from the job site.
H-10 SALVAGE MATERIALS
(a) All items of U.S. Government property indicated on the drawings or in the specifications to be removed and disposed of by the contractor shall become the property of the contractor and shall be removed promptly from the installation and legally disposed of.
(b) Contractor is encouraged to recycle salvage materials when possible.
H-11 HAZARDOUS WASTE REMOVAL
The Contractor shall dispose of all hazardous waste in accordance with all applicable laws and regulation. The
Contractor shall assume the responsibility of determining what constitutes “hazardous waste” and complying with all environmental laws and regulations governing its removal.
H-12 MUSLIM HOLIDAYS
The U.S. Government acknowledges the following holidays: Ramadan, Eid Al Fitr, Eid Al Adha, and accepts that the contractor may decide not to work on these days, or to work reduced hours on these days. However, the contractor understands, and agrees, that the performance period for this contract includes any and all non-productive time attributable to the contractor’s observance of these holidays. The contractor shall notify the Contracting
Officer of the holidays it intends to observe; and whether it intends to work reduced hours or not at all.
H- 13 380 AEWI 31-102 TCN/CONTRACTOR RULES JUN 2005
The force protection escort will be the contractor’s escort official. FP escorts are responsible for contractors’ safe and secure conduct until they leave the area. While on the worksite, contract employees must be under escort at all times. If for any reason a contract employee is separated from their escort, they must contact the first American military member they see and be escorted to the main entry control point of the American compound.
EXCEPTION: If workers are in a designated work area, they must remain in that area and attempt to contact any
American military member and have them contact Security Forces.
Contract employees will not be allowed into any area unescorted, especially living quarters. Visitors are not allowed to bring any hand-carried items (with the exception of personal items and tools) into the area without written permission.
The following are prohibited items: wear of any type of US military uniform, cellular telephones, mobile radios, beepers, pagers, or any other type of communication device, still cameras or video recording devices, and contraband (weapons, drugs, etc.). EXCEPTION: TCNs or contractors may carry a cellular telephone if they possess a signed letter of authorization from 380 AEW/FP. This letter must contain the name of the authorized individual; the name of the company represented, and has an expiration date not to exceed six months. This letter is required to be carried at all times when in possession of a cellular telephone.
Contract workers are not allowed to bring vehicles into the area unless the vehicle is mission essential and has passed through the Security Forces search pit. If in a convoy, they must follow their escort, and ensure they do not leave the convoy. Escorted workers must drive with their flashers on at all times while on the installation. If for any reason their escort stops, they must also stop. If separated from the convoy, they must stop and wait to be contacted and not proceed ahead.
Escorted workers must not leave their job site without an escort and must remain in their escort’s line of sight and within 45m (150 ft) at all times.
Contractor employees must not record any information; any information written or recorded will be confiscated.
They may not ask or request official or personal information from any US personnel. They must not go through any papers or trash. All issued badges must be displayed on the upper torso after an escort verifies that it is not expired and the individual is the owner of the badge. This badge must be displayed at all times while on the installation. If safety reasons require removal of a badge, the escort must be asked permission.
Removal of anything off the installation that was not brought on is prohibited.
H-14 DELIVERABLES
The Contractor shall maintain one set of drawings at the work site and record all changes and hidden or subsurface data discovered during construction. All changes that transpired during the contract shall be included on this copy in ink, and shall be neat, legible, reproducible, and consistent with the drawings’ drafting standards. The As Built
Drawings will be given to the Contracting Officer prior to the final inspection
All drawings will be in the following format:
Drawing Format: Drawings shall be completed on AutoCAD latest Release and follow the ERDC/ITL TR-01-6
“A/E/C CADD Standard”, latest release which includes specific organizational criteria for layers, linetypes, symbols, etc. The minimum drawing letter size shall be 3/32 inches in height. X-referenced files can be used to assist in creating drawings; however, at the final submission EA drawing/file shall stand on its own merit without X-referenced files. All conversions from Intergraph/Micro station shall be complete such that all information and details are fully readable and accessible to AutoCAD. If Intergraph/Micro station is utilized, then converted to
AutoCAD, final payment will not be authorized until all files have been opened and are found to be fully converted.
The design-build contractor shall also provide all miscellaneous files produced under AutoCAD to control line weights. If problems arise, it is the contractor’s responsibility to correct the conversion of the files. Standard sheet size shall be Engineering ANSI Size A3. Title block for use on the drawings will be provided by the U.S.
Government. All Final Submittal drawings shall have the contractor registered stamp; title and signature next to the title block. EA design submittal shall include one set of drawings on A3 (11” x 17”) sized paper. In the case of conflicts between the CADD standard referenced in this SOW and the standard referenced in the CDRL, the A/E/C
Standard shall be used.
Content: The drawings shall show general layout and construction details necessary for a clear and concise presentation of the work to be accomplished. A cover sheet and site plan sheet (for EA discipline) with identified utilities are required for all projects. Sheet numbering shall provide both generic sheet number (i.e. Sheet # of ##) and discipline sheet numbers (i.e. G-#, C-#, A-#, S-#, M-#, E-#) in which both shall be provided in an index on the cover sheet.
The final drawings utilized for construction shall be sealed by the registered professional architect or engineer responsible for the design. EA sheet of the final drawings set shall bear the professionals stamp and signature.
Electronic Submission/Interim Submission (CD-ROM): All items indicated for submission shall be written to a recordable CD and write protected. CDRW are unacceptable. The CD shall have folders labeled: Drawings, Individual Specification files in MICROSOFT WORD as well as Adobe Portable Document Format (PDF), Project
Timeline, Comment Responses, etc., with the appropriate uncompressed files saved to the corresponding folder. A
Table of Contents of the CD shall be created in MICROSOFT WORD format listing in a table with the path of all files and descriptions. The Table of Contents shall then be saved in the route folder of the CD. Upon completion of the recording, “End of Section” shall be specified on the CDR.
Final Submission: The contractor shall provide two sets of electronic file copies of the Final plans and specifications on CD-ROM. A generic ASCII index file (space delimited) with a consecutively ordered electronic filename, plate number, sheet number, and drawing title; one set of final specifications (single file) in Microsoft Word; one set of final specifications in Adobe Portable Document Format (PDF); one copy of the final AF Form 66 in Microsoft
Excel format, and all AutoCAD drawings as described in paragraph Drawing Format. The contractor shall insert blank pages in the electronic specification files as necessary to insure an even number of pages. EA specification section page shall contain the project number in the lower left corner, and the specification section and page number, separated by a dash, on the bottom center. In addition, the contractor shall furnish one hard-copy set of corrected final design drawings (As-builts), the redlined As-built set, one copy of the specifications and annotated submittal register printed from PDF files, completed AF Form 1354, and one copy of the design authentication sheet for certifying that the As-built drawings represent as-installed conditions.

(a) “Hazardous material,” as used in this clause, is defined in the Hazardous Material Identification and Material Safety Data clause of this contract.
(b) The Contractor shall label the item package (unit container) of any hazardous material to be delivered under this contract in accordance with the Hazard Communication Standard (29 CFR 1910.1200 et seq). The Standard requires that the hazard warning label conform to the requirements of the standard unless the material is otherwise subject to the labeling requirements of one of the following statutes:
(1) Federal Insecticide, Fungicide and Rodenticide Act;
(2) Federal Food, Drug and Cosmetics Act;
(3) Consumer Product Safety Act;

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.
(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or security police for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver’s license, current vehicle registration, valid vehicle insurance certificate, and SEE SECTION ATTACHMENTS FOR ENTRY INSTRUCTIONS

(c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.
