2 DEFINITIONS

2.1 Contracting Officer (CO) - The United States Government Contracting Officer: The only person authorized to make changes to this contract for the United Sates Government or the USAF. This authority is sometimes referred to as the Contracting Office. The terms should be considered the same.

2.2 Contracting Officer’s Technical Representative (COTR): A person authorized by the CO to represent the CO for limited specific functions. Primarily to provide technical interpretations of the contract documents. The COTR does not have the authority to change the contract. This person may also be referred to as a CO’s Representative (COR), Quality Assurance Representative (QAR), or Quality Assurance Evaluator (QAE).

3 GENERAL REQUIREMENTS

3.1 SCOPE OF WORK

3.1.1 Provide design, material, means and labor in their entirety as required to construct one laundry building, approximately 290 square-meters (3120 square-feet) in area including but not limited to;

Construction fencing and site barricades.

Site fill and earth improvement.

Building construction and utility appurtenance.

Exterior sidewalk and curbing.

Building interior fit-out and finishing.

Building service connections.

Site cleanup and waste removal.

All as illustrated and described by the project documentation, and in accordance with this Scope of Work and the procedures of the United States Government Contracting Officer.

3.1.2 Notice To Proceed (NTP) with material submittals (AF66) will not be issued until the pre-construction meeting has been completed. The NTP will be issued in writing by the Contracting Officer (CO) and establishes the first day of the Period of Performance (PoP).

3.1.3 The Period of Performance under this contract shall be One Hundred Twenty (120) calendar days.

3.1.4 A detailed work schedule, identified on the Schedule of Material Submittals (AF66), shall be submitted by the Contractor no more than ten (10) days after NTP. Approval of this schedule by the United States Government (USG) may take three to six (3 - 6) days. This schedule must be approved before on-site construction work may begin. Contractor mobilization shall be indicated on the submitted work schedule and shall count against the PoP.

3.2 CHANGES OR SUBSTITUTIONS TO THIS SCOPE OF WORK: Shall be made at the direction of the Contracting Officer only. The USG will not incur any financial liability for any work that is performed without prior authorization of the CO.

3.3 UNIFIED FACILITIES CRITERIA COMPLIANCE: All design, material, means and methods shall be in accordance with the National Institute of Building Services, Whole Building Design Guidance (WBDG), Unified Facilities Criteria (UFC) 1-200-01 latest edition. Note that this specification subordinates the entirety of UFC, as well as ASCE seismic design code, International Building Code (IBC), International Fire, Plumbing and Fuel Codes, National Fire Protection Association (NFPA) code, National Electrical Code (NFPA 70), as well as others. Where conflict exists between UFC 1- 200-01 and other project specification, the more conservative criteria shall govern.

3.4 DESIGN-BUILD RESPONSIBILITY: The Contractor shall hold Design-Build Responsibility for all aspects of this project. Provision of design to the Contractor by the USG does not relieve the Contractor from Design-Build Responsibility. This responsibility includes, but is not limited to, due diligence vetting of all USG provided representations of existing conditions, material list(s) and quantities, and compliance of USG provided design and construction with relevant specification and standard.

3.5 INSPECTIONS AND CONSTRUCTION HOLDPOINTS: The Al Dhafra Air Base (ADAB) General Specification, latest date, as amended for this project obligates the contractor under general requirements, to provide notification to the USG and hold construction in regards to the special observation and acceptance of certain minimum elements.

3.6 SUBMITTALS: USAF Form 66 ‘Schedule of Material Submittals’ is attached herewith and made a part of Contractor’s obligation. All submittals must be accompanied by a properly completed USAF Form

3000, or may be subjected to rejection and/or disapproval. No element or material is to be be construed by the Contractor as approved by the USG for ordering, stocking, construction or installation prior to submission by the Contractor and approval by the USG of a corresponding material submittal. The Schedule of Material Submittals attached is not exhaustive, the Contractor may append to or subdivide the entries of this schedule to better identify unique circumstances.

3.7 CONTRACT PERSONNEL: The Contractor shall specify in writing the name and contact information for the following mandatory personnel;

3.7.1 Project Manager (PM): The Contractor shall provide a PM who shall be responsible for the performance of all work. The PM shall have full authority to act for the Contractor on all contract matters. The PM shall be able to read, write, speak, and understand English. The PM shall be available within one hour during onsite activity to meet on the installation with government personnel. The project manager shall have a minimum of 5 years of experience in Program Management and an Architectural or Engineering Bachelor’s Degree or 7 years of continuous construction experience.

3.7.2 Quality Control Manager (QCM): The Contractor shall provide a QCM who shall be responsible for the quality of all work on a day-to-day basis. This person must have a minimum of five years experience in a supervisory or managerial capacity in the type(s) of construction included within this project. The QCM shall be able to read, write, speak, and understand English. The QCM will approve all Contractor submittals prior to their being submitted to the CO for acceptance. The QCM shall be available within one hour during onsite activity to meet on the installation with government personnel.

3.7.3 Construction Superintendent (CS): The Contractor shall provide a qualified CS to be on-site during the performance of all work. The CS shall be able to read, write, speak and understand English. The CS shall have a minimum of 7 years of experience managing construction duties of similar requirements and a minimum of 3 years of experience managing construction projects in the U.A.E.

3.7.4 Contractor Employees: The United States Government reserves the right to reject any contractor personnel deemed to be a potential threat or hazard to the health, safety, or security of the installation’s operation and/or population. The names of the contractor employees do not need to be submitted as part of the proposal. However, the names and personal information will be required to be provided once the contract has been awarded.

3.7.5 Certified Electrician: The contractor shall provide a certified electrician that has a minimum of 6 years of experience performing construction duties of similar requirements outlined in the SOW and 3 years of experience managing construction projects in the U.A.E.

3.7.6 Certified Plumber: The contractor shall provide a certified plumber that has a minimum of 6 years of experience performing construction duties of similar requirements outlined in the SOW and 3 years of experience managing construction projects in the U.A.E.

3.8 SECURITY RESPONSIBILITIES: The Contractor is responsible for ensuring proper documentation is provided in a timely manner for personnel and vehicle passes, through both the HN and USAF visitor control points to avoid any delays in starting and completing the project. No contractor personnel will be permitted access without prior approval by the CO, USAF Security Forces and HN Security Forces.

3.8.1 The contractor shall educate him/herself on and abide all HN security procedures. In order to gain access to ADAB through the HN Security, the Contractor must provide legible color copies of all employees’ passports, residency cards, and drivers licenses (when applicable) along with the Entry Authorization Application letter, format provided by the CO. These will be given by the USAF to the HN security. Employees will be investigated by the HN security service. Each sub-contractor must submit their employees indicating that the employee works for that subcontractor. The HN security process takes a minimum of three working days to provide temporary clearance. The request should indicate the first day of requested authorization as the calendar day on which clearance is expected – not the day of submission.

The Contractor must resubmit the entry authorization requests with all supporting documentation a minimum of four working days (temporary) or 30 calendar days (permanent) prior to the expiration date of the current authorization period.

3.8.2 The Contractor is responsible for providing the CO with a list of company personnel that will be used to execute the contract. The list must contain the name, nationality, and duration of time the individual is expected to require a pass. Additionally, the Contractor is responsible for providing the CO with a list of vehicles that require access to the USAF compounds. This list must contain the Make, Model, Year, Color, and License Plate Number of each vehicle, as well as all pertinent owner/operator information such as the owner and operator’s name, driver license number, and vehicle registration information. These items will be used to expedite the entry process. All forms will be provided by the CO prior to notice to proceed.

3.8.3 The Contractor's employees must be escorted by USAF personnel at all times while on ADAB.

If work is to be accomplished in geographically separated areas, each party must have its own escort to accompany them to said areas.

3.8.4 The Contractor shall be solely responsible for the physical security of all project materials, supplies, and equipment.

3.9 UTILITIES: No provision of construction site utilities is included with this contract. Request by the contractor for such will be honored at the CO’s discretion.

3.10 SAFETY: The Contractor shall be solely responsible for construction site safety and compliance with the mandatory safety plan. The USG and its representatives (CO, Fire Chief, Security Forces, and Construction Inspectors) reserve the right to stop work due to unsafe conditions without recompense to the Contractor. Once stopped, work may only resume upon the authority of the CO.

3.11 FIRE PROTECTION: The Contractor shall comply with the provisions of the Base Fire Protection Program, as well as, any specific instruction by the Base Fire Chief. The Contractor shall coordinate controls, staff instruction, and response material with the Base Fire Chief prior to delivery of any project site combustible materials.

3.12 HAZARDOUS SPILL RESPONSE: The Contractor shall provide project site hazardous spill response and clean up, at his expense, in accordance with Base Environmental instruction. The Contractor shall coordinate controls, staff instruction, and response material with Base Environmental prior to delivery of any project site hazardous materials.

3.13 SITE CLEAN UP: The Contractor shall remove all waste materials from the project site to a USG and HN sanctioned off-base disposal facility on a daily basis, in accordance with all local environmental standards and jurisdiction. The Contractor shall contract, at his expense, trash and construction site dumpsters including daily service, in accordance with the instructions of the CO.

3.14 AS-BUILT DRAWINGS: As-built drawings shall be maintained on site by the Contractor and made available for the CO’s inspection and approval upon completion.

4 PRODUCTS AND MATERIALS

4.1 All materials for this contract shall be new. Used materials are not authorized in the execution of this project.

4.2 All assemblies and products shall be UL and/or CE certified, and carry the corresponding certification marking.

4.3 GOVERNMENT FURNISHED EQUIPMENT (GFE): No provision by the USG of project equipment or materials is included with this contract. Request by the contractor for such will be honored at the CO’s discretion.

5 EXECUTION

5.1 Construction of this Project shall not interfere with day to day operations of nearby facilities. Unless specified by the CO, all other base operational activities supersede construction activities should scheduling conflicts arise.

5.2 The limits of work shall be as indicated on the contract drawings. The Contractor shall not excavate, fill, grade, or otherwise alter any area, which is beyond the limits of work. The CO and or designated “Representative” shall approve haul routes.

5.3 The Contractor is responsible for validating the construction documents. The Contractor will review all project documentation and advise the CO of any discrepancy, inconsistency, or ambiguity prior to proceeding with the work. The Contractor will field verify all measurements and advise the CO of any discrepancies prior to proceeding with the work. The CO must approve any deviations or changes, in advance.

5.4 All work shall comply with the specifications and drawings provided. All work shall be performed by craftsmen skilled in the applicable trade and shall be supervised by a qualified CS with experience in the related construction trades. The CS is required to be on-site during the performance of all work to ensure that a quality product is provided. The CS shall have a complete current set of the contract documents and approved submittals on the job site at all times.

5.5 While the CO or COTR may indicate any problems in the workmanship in any phase of the project that they find to the Contractor, Quality Control is the Contractor’s responsibility. Inspection or non-inspection by USAF representatives of the work does not relieve the Contractor from ensuring the work complies with the contract documents. It is the responsibility of the Contractor to identify and correct all workmanship problems. Any workmanship problems identified are to be corrected in a timely manner, to the satisfaction of the CO, at no additional cost to the USG.

5.6 Prior to performing any excavation or demolition work, the Contractor shall obtain USAF Form 103, Base Civil Engineering Work Clearance Request, from the CO for the purpose of obtaining location of existing utility lines through the Work Clearance Request process. The Contractor shall request referenced locations and permit at least five days prior to scheduled beginning of work. The Contractor shall exercise due care and take reasonable steps to avoid damage or to otherwise interfere with lines where positions have been provided. If sufficient information is not available, the Contractor shall explore prudent techniques, such as hand-dug test holes, to ascertain the precise location of such facilities.

5.7 Prior to performing any welding work, the Contractor shall obtain USAF Form 103, Base Civil Engineering Work Clearance Request, from the CO. The Contractor shall request referenced locations and permit at least five days prior to scheduled beginning of work.

5.8 In the event utility outages are required, they shall be coordinated with the COTR a minimum of ten

(10) calendar days prior to the proposed outage. Outages will be scheduled in all cases at the convenience of the USG and work performance may be required during periods of time other than normal duty working hours.

5.9 It is the responsibility of the Contractor to coordinate with the CO or the CO’s authorized representatives to preclude damage to any existing utilities. Any damage to utilities caused by the Contractor will be repaired by the Contractor at no additional expense of the USG or to the HN.

5.10 The Contractor is required to maintain a clean work site and will remove any construction debris and waste materials on a daily basis. Any and all materials that are to be removed and/or demolished per the contract are to be disposed of at an approved disposal location in accordance with HN laws and regulations.

5.11 The Contractor shall provide barriers as required and/or directed by the CO to prevent public entry to construction areas and to protect existing facilities and adjacent properties from damage by construction operations.

5.12 MAINTENANCE OF TRAFFIC

5.12.1 Traffic flow shall be maintained at all times, except when altered by an approved detour. All traffic detours shall be requested through the COTR a minimum of one week in advance of implementation.

5.12.2 Temporary signs showing areas of construction, detour routes and temporary parking areas shall be constructed and approved before construction within that area begins.

5.12.3 Lighted barricades shall be used to separate the public from the construction. Lights shall be operational at all dark hours to ensure a safe operation.

5.12.4 Excavated or other materials temporarily stored on a roadway shall be adequately marked for traffic and pedestrian safety at all times. Access to all buildings within the area of construction shall be made available throughout construction.

5.12.5 Where traffic must be maintained across excavations, the Contractor shall provide steel plate bridging to allow vehicle passage.

5.12.6 The Contractor shall be solely responsible for furnishing, erecting, maintaining, and removing all protective barriers, signs, temporary lighting, etc., required for protection of persons and property. No open flame devices of any type shall be permitted.

5.13 ON-SITE STORAGE OF CONTRACTOR MATERIALS

5.28.1 The Contractor is responsible for the receipt, unloading, security and handling of all equipment and materials required for the completion of this work. The Contractor shall identify storage area requirements and coordinate said location with the CO.

5.28.2 The Contractor shall protect all stored material from weather and negligence. If for any reason materials are damaged the Contractor shall replace the materials prior to use at the Contractor’s expense.

5.28.3 The Contractor is responsible for providing security fencing around any stored material. All materials stored on site will be kept clean, off the ground and protected from adverse weather, at all times.

5.28.4 Materials deemed unfit for use by the CO for reasons of contamination, rusting, sun damage, water damage, wind damage, general poor condition or quality or abuse will be replaced as directed by the CO and at the Contractor’s expense for all work, cost and material required to make the correction.

5.28.5 The Contractor’s need for lay-down area shall be identified during the pre-construction site meeting.

5.29 PROGRESS REPORTS: Progress reports shall contain Project number, start date or anticipated start date, completed date or anticipated completed date, progress status, problems or concerns, and any issues. Receipt of these reports may be a condition of payment or partial payment of contract funds to the Contractor.

5.30 PRE-CONSTRUCTION (PRE-CON) MEETING: Attendance is required by the Contractor to begin work;

Pre-Con members include Contracting and Civil Engineering and may also include Security Forces, Force Protection, User and Wing Safety. Possible topics to be covered are:

Force Protection Escorts.

Approved Haul Routes.

Approved Contractor Lay down Areas (as applicable).

Period of Performance.

Contractor questions.

6 MILITARY INSTALLATION REQUIREMENTS

6.1 TOXIC SUBSTANCES: The Contractor shall certify that products do not contain mercury, lead, hexavalent chromium, toluene, chlorinated solvents, hydrolysable chlorine derivatives, ethylene based glycol ethers and their acetates, nor any carcinogen. When tested, the lead content shall not exceed 0.06% by weight of the dry film and the test for chromium content shall be negative.

6.2 ESCORTS: On-site, the Contractor shall comply with base security requirements. Since the site will be in controlled areas, USG will provide escorts for all Contractor employees working on site. Contractor will assure supervisor of employees is present at all times.

6.3 MATERIAL DELIVERIES: The Contractor must provide 4 days notice prior to bringing any material deliveries on base. The Contractor may be required to offload materials at a site approved by the USG for search purposes. Once the material has been cleared, the Contractor shall reload the material and proceed to the job site. Stockpiling of material will be allowed at a USG approved site.

The USG reserves the right to refuse access of vehicles not having prior coordination.

6.4 SECURITY REQUIREMENTS: Contractor employees will be issued the proper access badges by the installation security forces. These items will be issued and controlled by the USG. The PM is responsible for managing, securing, and returning to USG all passes issued to his/her employees.

6.5 HOURS OF OPERATION: Contractor shall obtain approval for his desired work schedule from the CO prior to start of work, any changes must be approved prior to implementing any deviation from the approved work schedule. In the event the Installation Commander directs a temporary shutdown of the jobsite, the Contractor shall immediately remove all employees until directed to return. Any USG imposed delays as a result of a temporary shutdown that may require an adjustment to the contract PoP and will be coordinated through the CO. Alternative work schedule requests shall be submitted to the CO, in writing, for approval no later than Seven (7) Calendar days prior to alternative schedule start.

6.6 SAFETY DURING ALARM CONDITIONS: In the event the ADAB Installation Commander directs the installation to assume Alarm conditions, the Contractor shall comply with all instructions of USG Security Forces to protect the health and safety of employees/residents and minimize or eliminate potential damage and/or injuries.

7 PROJECT ACCEPTANCE

7.1 SITE CLEAN-UP: The Contractor shall remove all waste materials from the project site to a USG and HN sanctioned off-base disposal facility, in accordance with all local environmental standards and jurisdiction. The Contractor shall remove and/or stockpile excess project material in accordance with CO instructions. The Contractor shall deliver all structures in a clean and ready condition in accordance with CO instructions.

7.2 HAZARDOUS MATERIALS: The Contractor is responsible for removal of all project site hazardous materials to a USG and HN sanctioned off-base disposal facility.

7.3 BENEFICIAL OCCUPANCY: A portion of the project may be accepted by the CO on behalf of the USG. At this point this portion is considered completed and accepted under terms of contract.

7.4 PRE-FINAL INSPECTION: Contractor shall request from the CO a Pre-final inspection for the Project.

This typically takes place seven to ten (7-10 each) calendar days prior to project completion or end of PoP. The inspection allows an opportunity for the Contractor to correct small discrepancies. A pre-final may be considered a final inspection if the USG accepts the work without exception. Attendance at the pre-final Inspection is mandatory of the Contractor. The Contractor’s representative must be able to speak on behalf of the company and be able to obligate the company. The pre-final inspection will be attended by the CO, Project Engineer, Construction Inspector, and Contractor. At this time a comparison of the Statement of Work (SOW) to completed project state will take place.

7.5 FINAL INSPECTION AND ACCEPTANCE: Contractor shall request from the CO a final inspection for the Project. This typically takes place at project completion or end of PoP. Attendance at the final inspection is mandatory for the Contractor. The Contractor’s representative must be able to speak on behalf of the company and able to obligate the Contractor. The final inspection will be attended by the CO, Project Engineer, Construction Inspector and Contractor. At this time a comparison of the Statement of Work (SOW) to completed Project will take place. Any discrepancies will be added to a punch list for the Contractor to complete. Upon final acceptance, by written notice, the USG will take over ownership of the Project.

7.6 PUNCH LIST: The Contractor has ten (10) calendar days to complete items on the punch list.

7.7 WARRANTY: Contractor shall provide all manufacturer/s warranty documents required and a one (1) year warranty on all materials, work and labor. Contractor shall apply all materials in accordance with manufacturer’s recommendations in order to maintain the manufacturer’s warranty. Contractor shall submit manufacturer’s warranty information to CO within five (5) days of final acceptance of each project.
