QUESTION AND ANSWER DATED 18 MAR 2010
QUESTION NO 1:
“It is specified that "All firms shall provide a Bank Letter of Assurance with their proposal submittal" in the solicitation document of "Roads & Grounds IDIQ (FA5685-10-R-0002)". But there is not a Sample Letter for "Letter of Assurance" in the documents. Please clarify the details of the "Bank Letter of Assurance" that we will provide with our proposal. And issue the sample letter for Letter of Assurance.”
ANSWER TO QUESTION NO 1:
A “Sample” Bank Letter of Assurance was intentionally not provided as a Section J attachment to subject RFP, nor will a “Sample” Bank Letter of Assurance be issued. Reasong being, Bank Letters of Assurance interested offerors obtain will vary from bank to bank. All interested offerors should understand the Bank Letter of Assurance Letters they submit along with their proposal should contain language from the bank which clearly states if the interested offeror were to receive the resulting contract award the bank will provide the interested offerors firm with a Bank Letter of Guarantee as required by the below paragraph which appears on page 45-46 of 53 of the solicitation. (NOTE – See * below for an example of the type of language which should appear in the Bank Letter of Assurance interested offers are required to provide with proposal submittal):
(6) Bond Requirements. All firms shall provide a Bank Letter of Assurance with proposal submittal. A Bank Letter of Guarantee (see Sample Letter – Section J, Attachment 6) in the amount of 10% of the total amount of the contract award and shall be submitted within 10 calendar days upon award of the contract. Alternatively, firms may submit a bid bond and Performance Bond in accordance with FAR 52.228-1 Bid Guarantee and FAR 52.228-15 Performance and Payment Bonds-Construction. In addition to their Bank Letter of Assurance or Bank Letter of Guarantee as described in Sections L and J, offerors may be required to provide additional information at a later date if needed to verify financial responsibility to perform the contract.
* For example:
“I/We, the undersigned acting as the duly authorized representatives’ ___________________________ (Bank Name), assure that we will issue a Bank Letter of Guarantee for account of ___________________ (Firm Name), should the contract pursued under subject solicitation be awarded to them.
The Bank Letter of Guarantee will be issued for the amount of 10% of the total amount of the bid as presented by this firm, ________________ or 10% of the total amount of contract award. The Bank Letter of Guarantee will be provided to you within 10 days after contract award and will contain all conditions listed in the sample provided by this solicitation.”

QUESTION NO 2:
“We are instructed to submit a Bank Letter of Assurance according to following Section of the said RFP:
K. Additional Information To Be Provided in Volume 1:
(6) Bond Requirements. All firms shall provide a Bank Letter of Assurance with proposal submittal.
Kindly provide us a blank form/specimen of the Bank Letter of Assurance acceptable to your office, and instruction to properly fill it in.”
