52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. IMPORTANT INFORMATION CONCERNING ELIGIBILITY FOR AWARD OF THIS SOLICITATION: DUE TO ESTABLISHED ECONOMIC AGREEMENTS BETWEEN THE UNITED STATES GOVERNMENT AND THE GOVERNMENT OF TURKEY, THE AIR FORCE INTENDS TO AWARD THIS SOLICITATION TO A BUSINESS CONCERN WITHIN THE COUNTRY OF TURKEY. THEREFORE, PROPOSALS FROM BUSINESS CONCERNS OUTSIDE OF TURKEY WILL NOT BE CONSIDERED.

2. This solicıtation can be electronically accessed. It is highly encouraged that you download the solicitation due to hard copy being unavailable.

3. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The offer shall consist of three (3) separate parts: Part I - Technical Proposal, Part II – Price Proposal, and Part III – Past Performance Information. An offer acceptance period of 120 calendar days is desired.

4. Evaluation factors and standards: Each proposal will first be evaluated for technical and price acceptability. Past Performance and Technical shall be of equal importance. Past performance is significantly more important than price. Past performance will be evaluated by the contracting officer for offerors who have been rated acceptable for both technical and price in order of price, beginning with the lowest priced offeror, until a past performance rating of High Confidence is determined or until all offerors’ past performance has been evaluated. The government contemplates award without discussions.

5. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

PART I – TECHNICAL PROPOSAL - Limited to no more than 50 pages.

(a) Subfactor 1 – Concept of Operations. Offerors are required to submit a concept of operations plan addressing as a minimum:

(i) How the offeror intends to perform aircraft traffic services, aircraft ramp services, and cargo and mail handling services required by PWS paragraphs 1.1, 1.2, and 1.4.

(ii) As a part of the Concept of Operations, a draft Quality Control Plan, IAW PWS para 4.1, must be submitted addressing the following for operations at all work sites:

(1) Quality control

(2) Handling of deficiencies

(3) Frequency of inspections

(b) Subfactor 2 – Minimum Past Experience/Legal Requirements. Offerors are required to provide certification that the following past experience requirements have been met:

(i) Performed aircraft grounds handling and cargo processing services for at least 3 of the last 5 years.

(ii) Tax Payers License With No Outstanding Tax Payment Proof/Document

(i) Trade Chamber Registration

(ii) Signature Circular

(iii) Company Registration If Applicable

(iv) Company Authorization Licenses/Certificates Must Be Provided With Solicitation Package

THE ABOVE DOCUMENTATION MUST BE TRANSLATED AND CERTIFIED IN ENGLISH AND WILL BE KEPT AS AN ATTACHMENT IN THE FOLDER. THESE DOCUMENTS WILL NOT BE RETURNED BACK TO THE ORIGINATORS.

PART II – PRICE PROPOSAL -

(a) Complete blocks 12, 17, 23, 24 and 30 of the RFP, SF 1449. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP. These sections constitute the model contract.

(b) Insert proposed unit prices in Section B for Firm Fixed Price CLINs 0001, 0002, 0003, 004, 0005, and associated option periods .

(c) Insert proposed unit prices in Section B for Cost Reimbursable CLIN 0006 and associated option periods.

(d) Complete the Price Schedule, using the template at Exhibit A, Estimated Quantities & Price Schedule for the basic and all option periods. The Price Schedule contains estimated quantities and will be used by the government for price evaluation.

(e) All proposed prices shall be submitted in US Dollars. Offers not submitted in the US Dollars will not be considered for award.

(f) Complete the necessary fill-ins and certifications in the RFP. FAR Clause 52.212-3 Offerors Representations and Certifications shall be returned in its entirety.

(g) Failure to provide the required documents and the solicitation properly filled, signed, and stamped may cause your offers to be considered, and determined non responsive.

PART III – PAST PERFORMANCE INFORMATION - Limited to no more than 3 pages per contract listed. Only references relevant to this solicitation are desired.

(a) Past Performance Information: The Government will evaluate each proposal based on recency, relevancy and quality of the offerors’ demonstrated present and past performance. The contractor shall provide Past Performance information on no more than five (5) of the most relevant contracts performed for federal agencies and commercial customers within the last three (3) years. Offerors shall provide information for each current or previously performed contract which details at a minimum the following items:

(i) Company/Division name

(ii) Product/Service

(iii) Contracting Agency/Customer

(iv) Contract Number

(v) Contract Dollar Value

(vi) Period of Performance

(vii) Verified, up-to-date name, address, FAX , email & telephone number of the contracting officer

(viii) Narrative addressing why performance of the subject contract is relevant to the requirements defined in this solicitation.

(ix) Narrative addressing compliance with contract terms and conditions

(x) Narrative addressing customer satisfaction in terms of quality

(xi) Narrative addressing any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions and any corrective actions taken.

(b) Past Performance Information submittal: It is the Government’s desire to begin the collection of Past Performance information early. Therefore, each offeror is requested to submit the Past Performance information by 25 Feb 08, 1630 hrs Central European Time (CET). The Past Performance information shall be submitted no later than the RFP closing date.

(c) Past Performance Questionnaires: The Government will utilize Past Performance questionnaires in addition to the above contractor provided narratives to evaluate the quality and extent of offerors’ past performance. Each offeror is requested to complete only Section I of each questionnaire, Attachment 3 Past Performance Questionnaire and email or hand carry it to the Contracting Officer (CO) by 25 Feb 08, 1630 hrs CET. The Past Performance information shall be submitted no later than the RFP closing date. The Government will send Past Performance questionnaires to the sources identified by the offeror and compile the responses thereto for the evaluation of performance confidence. The respondent shall e-mail or fax the completed questionnaire to fred.moore@incirlik.af.mil or joe.reich@incirlik.af.mil . Offerors shall not follow-up with respondents to ensure they have completed the questionnaires. The CO will conduct such follow-up with any POC as necessary. The filled in Past Performance Questionnaire will not be counted against the Part III-Past Performance information page limitation.

(d) Subcontractor(s) and Key Personnel: The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, and/or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition.

(e) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Proposals shall include letters from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor. If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past performance information on previous teaming arrangements with same partner. If this is a first time joint effort, past performance information shall be provided for each party to the arrangement.

(f) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(g) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Government will use the following degrees of relevancy when assessing past performance:

(c) Performance Quality Assessment. The Government will consider the quality of performance of those contracts submitted by each offeror, giving greater consideration to those that are deemed recent and relevant. The quality assessment consists of an in-depth evaluation of the past performance questionnaire responses and any information obtained from other sources.

The following quality assessment levels will be used:

Assigning Ratings. The Government will determine and assign a performance confidence rating IAW chart below based on the recency, relevancy and quality of the offeror’s demonstrated present and past performance. The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this RFP, based on the offeror’s demonstrated present and past performance. The assessment process will result in an overall performance confidence assessment of High Confidence, Significant Confidence, Satisfactory Confidence, Unknown Confidence, Little Confidence, or No Confidence, as defined in AFFARS MP5315.3, Table 3, and as shown in the below chart. Past performance regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement will be rated as highly as past performance information for the principal offeror. Offerors with no relevant past or present performance history shall receive the rating "Unknown Confidence," meaning the rating is treated neither favorably nor unfavorably.

Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort.
NO CONFIDENCE
Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.

If the lowest priced evaluated technically acceptable offer is judged to have a High Confidence performance confidence assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

If the lowest priced offeror is not judged to have a High Confidence performance confidence assessment, the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have a High Confidence performance assessment or until all offerors are evaluated. The Source Selection Authority shall then make an integrated assessment best value award decision.

Offerors are cautioned to submit sufficient information and in the format specified in the RFP. Offeror’s may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without discussions.

The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (SEP 2007) ALTERNATE I (APR 2002)

An offeror shall complete only paragraph (k) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (i) of this provision.

(a) Definitions. As used in this provision:

"Emerging small business" means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Veteran-owned small business concern means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned small business concern" means a small business concern--

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or

(2) Whose management and daily business operations are controlled by one or more women.

(b) Taxpayer Identification Number (TIN) (26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to a central contractor registration database to be eligible for award.)

(1) All offerors must submit the information required in paragraphs (b)(3) through (b)(5) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the Internal Revenue Service (IRS).

(2) The TIN may be used by the Government to collect and report on any delinquent amounts arising out of the offeror's relationship with the Government (31 U.S.C. 7701(c)(3)). If the resulting contract is subject to the payment reporting requirements described in FAR 4.904, the TIN provided hereunder may be matched with IRS records to verify the accuracy of the offeror's TIN.
