SUMMARY OF CHANGES
The Purpose of This Amendment Is: The purpose of this amendment is to make the fallowing changes and clarifications:
1. remove the certificate of classification requirement E 3 2
2. For clarification purposes: The fence (SOW Sec 2.5) will require three (3) cables at 1 inch diameter each.
3. Sections L and M, PART II - Technical Proposal, subfactor 1 - Past Experience, change sections A1, A2 and A3 from 3 to 5 examples to 1 or 2 examples. As a minimum one (1) example of each must be provided and as a maximum two (2) examples of each.
Section K - Representations, Certification, & Other Statements
Miscellaneous text in this section has been modified to:

Section L - Instructions, Conditions, & Notices to Offerors or Quoters
Miscellaneous text in this section has been modified to:
A. General Instructions: This section provides general guidance for preparing proposals, as well as specific instructions on the format and content of the proposal. Throughout this section, the term "offeror" means the prime contractor submitting the proposal. The offeror's proposal shall include all data and information requested and shall be submitted in accordance with these instructions.
Any offeror who submits an incomplete package may be considered unacceptable. The offer shall be compliant with the requirements as stated in the Request for Proposal (RFP). A proposal that is sufficiently documented to support cost/price and technical requirements in a complete, orderly, and specific detailed manner will enable the Government to perform a thorough and fair evaluation. Non-compliance with the instructions of this RFP may result in an unacceptable proposal evaluation and the proposal may be eliminated from consideration for contract award.
B. Type of Acquisition: For this acquisition, the selection will be made using Lowest Priced Technically Acceptable (LPTA) procedures with the technical factor and subfactors evaluated on an acceptable/unacceptable basis.

C. Discrepancies and Ambiguities: If an offeror believes the requirements in these instructions contain an error, omission, ambiguities, or are otherwise unsound, the offeror shall immediately notify the CO in writing with supporting rationale no later than 10 calendar days after the RFP release.
D. Mistakes: Mistakes in offeror's proposal shall be handled in accordance with FAR 14.407-4 as referenced in FAR 15.508.
E. Postponement of Proposal Closing Date: If a determination is made to postpone a proposal closing date, an announcement of the determination shall be posted to FBO and, if practicable, before issuance of a formal RFP amendment otherwise communicated to prospective offerors.
F. Post-Award/Pre-Performance Conference: A post-award/pre-performance conference will be scheduled by the Contracting Officer (CO) and held prior to the commencement of any work under the awarded contract. The offeror or their duly authorized representative is required to attend the post- award/pre-performance conference.
G. Contract Document: Sections K, L and M apply to the solicitation phase only; therefore, they will not be a physical part of the resulting contract.
NOTE: All questions and answers will be posted on FBO.
NOTE: Not attending the site visit will not result in an extension of the solicitation closing date and time.
Proposal Format and Submission Instructions
A. The proposal package must be completed and sent to the following e-mail addresses:

In addition, it may also be hand delivered in CD form with .pdf format files (to include all parts) to the address in Block 7 of the SF 1442.
Only electronic copies of the proposal will be accepted.
It is the offerors responsibility to ensure that the proposal reaches the office designated for receipt of proposals within the time established in the solicitation.
B. HAND-CARRIED PROPOSALS NOTICE: Offerors are cautioned that Moron Air Base has stringent visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass and be cleared by the Government point of contact prior to entrance. Please contact the POC's listed at least 5 labor days prior to the Solicitation closing date to coordinate delivery of hand carried proposals. All Third Country Nationals must notify the POC's at least 10 labor days prior to the solicitation closing date, as they must be approved through ODC Madrid prior to requesting base access.
PART I - CONTRACT DOCUMENTATION AND PRICE PROPOSAL
SF 1442: Complete applicable blanks. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through J. Acknowledge all amendments issued to the solicitation (see Block 19 of the SF 1442)
A. Section B: Insert the proposed price for ALL CLINS and the TOTAL AMOUNT to provide a complete and usable end product in accordance with the terms and conditions stated in this solicitation. Offerors' proposals not conforming to this RFP may be considered ineligible for award.
The prices shall be valid through the proposal acceptance period (SF 1442 Block 13 D).
B. Section C through J: Complete applicable blanks, the offeror shall submit only those pages that require a fill-in.
C. Section K: Complete the representations, certifications, and acknowledgments. Section K shall be returned in its entirety. Submit all the required certificates.
D. Letters of Agreement: The offeror shall provide Letter of Agreement (LOA) for all teaming partnerships, joint ventures, A/E Firm partnerships or significant subcontractors that will be performing as part of this contract. Changes will not be permitted after contract award without a valid justification and approval from the Contracting Officer
PART II -TECHNICAL PROPOSAL
Offerors shall meet the minimum standards of each Technical Factor and subfactor in order for their technical proposal to be determined "technically acceptable." The standards are defined in Section M of the RFP.
Note: Offerors are responsible for ensuring their proposal meets the minimum requirements of the Statement of Work. See Section M - Other - Conformance to Specification Requirements.
A. Subfactor 1 - Past Experience:
The offeror shall include with the proposal the following documents:
A.1. 1 or 2 example projects demonstrating the design-build project management experience of the Offeror and/or Key subcontractor, if any, and his (their) capability on a construction project of similar type and scope.
A.2. 1 or 2 example projects demonstrating the experience and capability of the Architect-Engineer Design Firm on a design of similar type and scope.
A.3. 1 or 2 example projects demonstrating the experience and capability of the Construction Firm on a construction of similar type and scope.
B. Subfactor 2 - Technical and Management Approach and Capabilities:
B.1. A-E Design Capabilities: The Offeror shall include in the proposal the proposed A-E design firm and the capabilities of the A-E design firm, demonstrating their experience performing design-build construction projects, as well as design of projects of similar type/scope, physical size, and dollar value. Provided experience information must be detailed sufficiently to allow the Government to ascertain the Offeror's capability to perform works similar to this effort.
B.2. Management and Technical Approach: The Offeror shall include in his proposal the description of the Offeror's management and technical approach of all involved parties (Prime Contractor, Architect- Engineer Design Firm, and key subcontractors, if any). Key elements include, but are not limited to:
a. Describe the proposed management structure of the team, describing how the design and construction process will be managed and the authorities and/or the delegations of authority within the team.
b. Available headquarter management resources assigned to the project.
c. Construction team involvement during the design phase.
d. Design team involvement during the construction phase.
e. Identify potential technical problems for the project and mitigation techniques/strategy.
f. Construction Safety.
g. Design and construction quality control processes.
h. Integrating Sustainability into design and construction practices. Utilizing a design philosophy that seeks to maximize the quality of the built environment, while minimizing or eliminating negative impacts to the natural environment. Providing sustainable construction through educing resource consumption, reusing resources, using recyclable resources, protecting nature, eliminating toxics, applying life-cycle costing, and focusing on quality.
B.3. Schedule Plan: The Offeror shall include in his proposal the description of his ability to execute the design and construction, minimizing the impact on operations. The plan will include a preliminary summary schedule for the design and construction, including all events associated with the work.
The preliminary summary for the design shall include events associated with site visits, site surveys, design review meetings and design submittals. This plan shall be in the form of a bar chart schedule (Gantt chart), showing relationship between activities, the critical path and floats.
C. Subfactor 3 - Key Staff and Organizational Chart:
C.1. Key Staff: The Offeror shall include in the proposal the proposed key staff (Project Manager, Designer of Record (DOR), Superintendent, Surveyor, and Safety Officer). The Offeror shall identify Teaming Partners/ Key Subcontractors and describe the extent of their involvement in the project and applicable qualifications, certifications, and specialized experience.
C.2. Organizational Chart: The Offeror must include in the proposal the organizational chart identifying roles and responsibilities of the key personnel, teaming partners and key subcontractors, if any.
D. Subfactor 4 - Agreements with Subcontractors:
D.1. Memorandum of Agreement between the Offeror and each Key Subcontractor, if any: Offeror must include in his proposal a memorandum of agreement between the Offeror and each key subcontractor, if any, establishing that the key subcontractor will perform the corresponding work activity if the contract is awarded to the Offeror. The memorandum of agreement has to be signed by the Offeror and the key subcontractor and shall be original or a notarized copy. Key Subcontractors are defined as any sub-contracted work that perform 30% or more of project scope.
Section M - Evaluation Factors for Award
Miscellaneous text in this section has been modified to:
A. Basis for Contract Award: This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) part 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures, Appendix A, and Air Force Mandatory Procedures 5315.3. These regulations are available electronically at the Air Force (AF) FAR Site, http://farsite.hill.af.mil
B. Number of Contracts to be Awarded: The Government intends to award one (1) Firm Fixed Priced (FFP) contract in response to this solicitation to the offeror who is deemed responsible in accordance with the FAR Subpart 9.1, as supplemented, whose proposal conforms to the olicitation's requirements (to include all stated terms, conditions, representations, certifications, and all information required by Section L and M of this solicitation) and is judged, based on the evaluation factors to represent the lowest price technically acceptable proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
C. Rejection of Unrealistic Offers: The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, contract terms and conditions, or unrealistically high or low in price when compared to Government estimates, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the contract.
D. Discussions: The Government intends to award without discussions; therefore, offerors should submit proposals that represent their best efforts. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. In the event discussions are to be conducted, a competitive range will be established IAW FAR 15.306(c)(2). The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit effective competition. (10 U.S.C. 2305(b)(4) and 41 U.S.C.
3703).
E. Solicitation Requirements, Terms and Conditions: Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors and subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award.
Offerors shall clearly identify any exception to the solicitation terms and conditions and shall provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
EVALUATION PROCESS
Step 1: Review proposals and rank them by total price from lowest to highest.
Step 2: Conduct technical evaluations beginning with the lowest priced proposal. If the lowest priced proposal is determined to be technically unacceptable, then the next lowest priced proposal will be evaluated. Technical evaluations will continue until the lowest priced technically acceptable proposal is identified. The Government, at its discretion, may continue technical evaluations until the Contracting Officer determines that a sufficient number of technically acceptable proposals have been identified to permit determination of price fair and reasonable. The Government reserves the right to award without discussions. Only those offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.
EVALUATION FACTORS -
The following evaluation factors and sub-factors will be used to evaluate each proposal. The Government will evaluate proposals for acceptability, but will not rank the proposals by the non-price factors.
Factor 1: Price
Factor 2: Technical
Subfactor 1: Past Experience
Subfactor 2: Management and Technical Approach
Subfactor 3: Key Staff and Organizational Staff
Subfactor 4: Agreement with subcontractor
Factor 1 - Price: The evaluated price shall be the total price proposed by the offeror in Section B.
The offeror's total price proposal will be evaluated, using one or more of the techniques defined in FAR 15.404, in order to determine if it is fair and reasonable. Normally, adequate price competition establishes a fair and reasonable price (FAR 15.403-1(c)(1)(i)).
Factor 2 - Technical: For the purposes of technical evaluation, the term "offeror" will include any proposed teaming arrangements. The Government's technical evaluation team shall evaluate the technical proposals on an acceptable or unacceptable basis, assigning one of the ratings described below for each factor. Any factor evaluated as "Unacceptable" will render the entire proposal unacceptable and, therefore, will not be eligible for award. Only those proposals determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.
However, the offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
TECHNICAL ACCEPTABLE/UNACCEPTABLE RATING METHOD:
Acceptable: Proposal meets the requirement of the solicitation
Unacceptable: Proposal does not meet the requirements of the solicitation.
The proposals shall be evaluated against the following Technical Subfactors:
A. Subfactor 1 - Past Experience:
The offeror shall include with the proposal the following documents:
A.1. 1 or 2 example projects demonstrating the design-build project management experience of the Offeror and/or Key subcontractor, if any, and his (their) capability on a construction project of similar type and scope.
A.2. 1 or 2 example projects demonstrating the experience and capability of the Architect-Engineer Design Firm on a design of similar type and scope.
A.3. 1 or 2 example projects demonstrating the experience and capability of the Construction Firm on a construction of similar type and scope.
This requirement is met when the offeror demonstrates with examples that the Offeror, design firm and construction contractor have past experience with work of similar type work and scope.
B. Subfactor 2 - Technical and Management Approach and Capabilities:
B.1. A-E Design Capabilities: The Offeror shall include in the proposal the proposed A-E design firm and the capabilities of the A-E design firm, demonstrating their experience performing design-build construction projects, as well as design of projects of similar type/scope and magnitude. Provided experience information must be detailed sufficiently to allow the Government to ascertain the Offeror's capability to perform works similar to this effort.
This requirement is met when the offeror demonstrates that the A-E firm has experience performing design-build construction projects and/or design of projects of similar type/scope and magnitude.
B.2. Management and Technical Approach: The Offeror shall include in his proposal the description of the Offeror's management and technical approach of all involved parties (Prime Contractor, Architect- Engineer Design Firm, and key subcontractors, if any). Key elements includes, but are not limited to:
a. Describe the proposed management structure of the team, describing how the design and construction process will be managed and the authorities and/or the delegations of authority within the team.
b. Available corporate headquarters resources assigned to the project.

This requirement is met when the offeror submits all information required to demonstrates a clear concise Management and Technical Approach that will allow the accomplishment of this design-build construction project and is in compliance with all requirements specified in the General Conditions of the Statement of Work.
B.3. Schedule Plan: The Offeror shall include in his proposal the description of his ability to execute the design and construction, minimizing the impact on operations. The plan will include a preliminary summary schedule for the design and construction, including all events associated with the work.
The preliminary summary for the design shall include events associated with site visits, site surveys, design review meetings and design submittals. This plan shall be in the form of a bar chart schedule (Gantt chart), showing relationship between activities, the critical path and floats.
The requirement for a schedule plan is met when the offeror submits a complete, realistic, and well sequenced schedule plan that captures all Statement of Work requirements and conforms to the period of performance stated in the Section F of this RFP. The offeror shall demonstrate project completion showing all major elements of work to include percentage of each work element in accordance with the Statement of Work.
C. Subfactor 3 - Key Staff and Organizational Chart:
C.1. Key Staff: The Offeror shall include in the proposal the proposed key staff (Project Manager, Designer of Record (DOR), Superintendent, Surveyor, and Safety Officer). The Offeror shall identify Teaming Partners/Key Subcontractors and describe the extent of their involvement in the project and applicable qualifications, certifications, and specialized experience.
C.2. Organizational Chart: The Offeror must include in the proposal the organizational chart identifying roles and responsibilities of the key personnel, teaming partners and key subcontractors, if any.
This requirement is met when the offeror demonstrates a clear concise Staffing Plan that shows that the offeror's team can accomplish with sufficient experience and knowledge the design-build construction project in accordance with the technical specifications.
D. Subfactor 4 - Agreements with Subcontractors:
D.1. Memorandum of Agreement between the Offeror and each Key Subcontractor, if any: Offeror must include in his proposal a memorandum of agreement between the Offeror and each key subcontractor, if any, establishing that the key subcontractor will perform the corresponding work activity if the contract is awarded to the Offeror. The memorandum of agreement has to be signed by the Offeror and the key subcontractor and shall be original or a notarized copy. Key Subcontractors are defined as any sub-contracted work that performs 30% or more of project scope.
This requirement is met when the offeror submits agreements for all key subcontractors that will be involved in the completion of this project.
