PERFORMANCE WORK STATEMENT

1. DESCRIPTION OF SERVICES. SPMAGTF-CR-AF 17.1 will require rental vehicles at Moron Air Base, Moron, Spain. The requirement is for minivans, full size vans, Sedans, a cargo van, and a 4X4 SUV from 01

May 2017 through 30 August 2017 with potential option periods in accordance with the Performance Work

Statement. Vehicles will be delivered within the timeframe identified within the SF1449 and must meet the minimum acceptance criteria provided herein.

2. SERVICE DELIVERY SUMMARY.

2.1. The contractor shall provide all equipment, vehicles, personnel, and labor required to perform the following tasks.

2.1.1. Task: Provide twenty-eight (28) Minivans, seventeen (17) Sedans, two (2) Full Size Vans, one (1)

Cargo Van, and (1) 4x4 SUV

2.1.1.1. Number of passengers: Six (6) passengers or more for Minivans, four (4) passengers or more for Sedans, Nine (9) passengers or more for full size vans two (2) passengers for Cargo Van and seven (7) passengers or more for 4X4 SUV.

2.1.1.2. Location: Delivered to Moron Air Base, Moron.

2.1.1.3. Performance Period: see 2.

2.1.1.4. Time: Base Period: 01 May 2017- 30 August 2017

Option 1: 01 September 2017- 31 December 2017

Option 2: 01 January 2018- 1 May 2018

2.1.1.5. Additional Requirements: Vehicles will be provided with all preventive maintenance complete.

Any repairs will be the responsibility of the contractor. All vehicles will be fully insured by the vendor. The insurance terms and conditions shall be provided with the quote.

2.1.1.6. Fuel: Diesel and Gas are acceptable.

3. GENERAL INFORMATION.

3.1. Definitions

3.1.1. Acceptance inspection - an inspection shall be performed on all vehicles and equipment before placing them in service. This inspection shows the overall condition of the vehicle. Discrepancies must be fixed before putting the vehicle in service, if use of the vehicle would aggravate the problem or if the discrepancy creates a safety hazard.

3.1.2. Accident repairs - Repairs required as a result of collision; regardless of whether the object collided with a vehicle, or whether the vehicle requiring repairs was the moving unit.

3.1.3. Criminal act - A violation of a civil law.

3.1.4. Disabled vehicle - A damaged, worn out, or malfunctioning vehicle.

3.1.5. Fair wear and tear - The deterioration of items attributed to normal usage.

3.1.6. Hostile act - An act of war.

3.1.7. Scheduled maintenance - Periodic prescribed inspections or servicing of equipment, accomplished on a calendar, mileage, or hours-of-operation basis.

3.1.8. Unscheduled maintenance - Maintenance that is not scheduled but is required to correct deficiencies and to restore the vehicle or equipment to a serviceable condition.

3.2. VEHICLES. The following minimum criteria shall be met at the time of the acceptance inspection:

3.2.1. Year. Shall be 2006 model year or newer. Offered vehicles must have fully functioning brakes and full fluids (gasoline/diesel, brake fluid, power steering, etc.) at the time of acceptance. All vehicles will be in compliance with local and national laws and regulations.

3.2.2. Condition. Both the exterior and the interior of the vehicles must be free of excessive soil, rust, and damage.

3.2.3. Safety Items. Each vehicle must meet all host nation safety requirements and have, as a minimum, the following safety features: seatbelts, rear view mirrors, windshield wipers, parking brake, and horn.

3.2.4. Heating and Air-Conditioning. Heating and air-conditioning will be functional and available for use. If the heating or air conditioning system in a vehicle fails during the period of performance, the contractor shall repair it or replace the vehicle at the contractor’s option, within 8 hours.

3.2.5. Cleaning. Vehicles provided will be clean and free of all trash and debris throughout the entire performance period.

3.2.6. Records. The contractor should maintain records of transactions with the US Government and, upon request, make such records available to properly designated contract representatives within a reasonable period of time.

3.2.7. Services. The following services shall be provided by the contractor:

3.2.7.1. Maintenance. The contractor shall ensure both scheduled and unscheduled maintenance are conducted on the vehicles provided without an interruption to performance. Vehicles disabled for scheduled and un-scheduled maintenance will have a comparable replacement within (1) hour of being removed from performance. The contractor is responsible for ensuring all parts, labor, and expertise necessary to complete required maintenance tasks. Parts include those items that must be replaced due to fair wear and tear such as windshield wipers, tires, headlamps, filters, fluids, and lubricants.

3.2.7.2. Recovery. Upon proper notification from the COR, the contractor will recover disabled vehicles. This service will be available 24 hours a day and all disabled vehicles must be recovered within 24 hours of notification from the COR. The contractor will ensure a comparable replacement vehicle with driver is provided within (3) hours of a disabled vehicle notification.

3.2.8. Operator Care. The contracted operator will be responsible for operator care (e.g., checking and replenishing fluids, tire pressure, lights, etc.).

3.2.9. Government Remedies. The contracting officer shall follow the requirements of FAR 52.212-4, Contract Terms and Conditions for Commercial Items (Feb 2002), for contractor’s failure to correct nonconforming services. Failure to pass the acceptance inspection in the timeframe specified may result in a monetary penalty.

4. PERIOD OF PERFORMANCE. See delivery schedule.

5. INVOICES. Invoices shall only be paid for actual services rendered. Invoice must be submitted when all tasks have been completed and will be certified by the COR before a payment voucher will be processed. Invoice must meet all requirements of the invoice clause to be processed for payment.

6. POINTS OF CONTACT.

6.1. Contractor points of contact - The contractor will provide points of contact within his company to interface with the contract representative on issues concerning rental vehicles. Names, business address, phone numbers, and hours of operation are the minimum information requirements. Arrangements for contacting the contractor's points of contact after normal business hours should also be made.

7. PERFORMANCE REQUIREMENTS SUMMARY (PRS)

7.1. Overview. This PRS summary identifies critical success factors for the contract. It identifies both the performance objectives for those factors and the performance threshold required for each performance objective. The Government reserves the right to survey all services called for in the contract to determine whether or not the performance objectives and goals were met. This PRS;

7.1.1. Lists the performance objectives for the required service that the Government will survey.

7.1.2. The absence of any contract requirement from the PRS shall not detract from its enforceability nor limit the rights or remedies of the Government under any other provision of the contract including identified in the FAR clause 52.212-4, Contract Terms and Conditions, Commercial Items.

7.1.3. Will be used as the baseline to identify the surveillance methods the Government will use to evaluate the contractor’s performance.

7.2. Surveillance. A variety of surveillance methods will be used to evaluate the contractor’s performance.

Some Performance Objectives (POs) may be inspected by more than one surveillance method. Deviations from a single performance objective detected by more than one surveillance method will be added together to determine the total number of deviations from the PO.

7.2.1. Surveillance methods will include:

8. Periodic inspections: Pre and post inspections of the vehicles will be performed by the COR.

9. Customer complaints: Complaints will be reviewed by the COR and, if found to be valid, will be addressed with the contractor as a discrepancy for corrective action.

10. 100% Inspection: These performance objectives will be inspected by the COR each time they are performed. If a deficiency is found, the COR will annotate the deficiency and address it with the contractor for corrective action. The COR will notify the Contracting Officer of any significant performance deficiencies.

10.1. Performance Evaluation. Performance of a service will be evaluated to determine whether or not it meets the performance threshold. At the end of each month, all validated complaints that were corrected and any significant deficiencies will be counted to determine if performance is exceptional, very good, satisfactory, marginal, or unsatisfactory. Performance will be determined by the sum of all valid customer complaints or deficiencies not found by the COR to be significant and significant deficiencies identified and will measured based on the following criteria;

Exceptional: Not more than (1) significant deficiency or (4) customer complaints or deficiencies not found to be significant.

Very Good: Not more than (2) significant deficiency or (8) customer complaints or deficiencies not found to be

Satisfactory: Not more than (3) significant deficiency or (12) customer complaints or deficiencies not found to be

Marginal: Not more than (4) significant deficiency or (16) customer complaints or deficiencies not found to be

Unsatisfactory: (5) or more significant deficiency or (16) or more customer complaints or deficiencies not found to be significant.

Performance Incentive. If the contractor is found to have (2) or more COR reports with Marginal performance or

(1) or more COR reports with unsatisfactory performance, they will be evaluated by the Contracting Officer for a determination of responsibility.
