52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
1.0 Basis for Contract Award
This is a Lowest Price Techincally Acceptable (LPTA) source selection conducted in accordance with Federal
Acquisition Regulation (FAR) Part 12, Commercial Items and FAR Part 13, Simplified Acquisition Procedures as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Air Force Federal
Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures. These regulations are available electronically at the Air Force (AF) FARSite, http://farsite.hill.af.mil. The Government will select the Quote(s) that represents the best overall value to the Government. Contract(s) may be awarded to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose Quote conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable.
Award will be made based on the lowest overall price offered that meets the technical requirement of the scope of work, delivery schedule, and a demonstrated record of successful past performance.
An overall non-price factors rating must be at least "ACCEPTABLE" in order to be eligible for award. An
"UNACCEPTABLE" rating in any factor results in the overall non-price factors proposal being rated
"UNACCEPTABLE" unless corrected through discussions. An overall non-price factors rating of
"UNACCEPTABLE" makes a proposal ineligible for award.
While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective;
and therefore, professional judgment is implicit throughout the entire process.
1.1 Number of Contracts to be Awarded
The Government contemplates awarding one (1), but may award up to two (2), three (3) year IDIQ contract(s). The guaranteed minimum order to each awardee shall be a total of $3,500.00. Offerors are reminded that the
Government is not obligated to order additional quantities beyond the guaranteed minimum.
1.2 Discussions
If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Quote Revision will be considered in making the source selection decision. If the offeror’s Quote has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Quote Revision are subject to evaluation and may introduce risk that the offeror’s
Quote be determined unacceptable and ineligible for award.
1.3 Solicitation Requirements, Terms and Conditions
Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to deny such requests.
1.4 Completeness
The Government will review the pricing submissions for completeness and compliance with instruction in this
Request for Quote (RFQ). Incomplete price submissions may not be evaluated and the Quote may be eliminated from the competition.
Offerors shall provide unit prices for each ELIN in Exhibits A thru C. Unit prices shall be multiplied by the estimated annual order quantity indicated on the ELIN to indicate the extended price. Extended prices for each
Exhibit shall be totalled and indicated in the exhibit and on the Basic Year, Option Year 1 and Option Year 2 contract line items of this document.
1.5 Contract Documents
The offeror’s Quote shall include a signed copy of the solicitation and all amendments. Offeror signature on the document indicates that all portions have been reviewed and agreed to with any exceptions clearly indicated with the quote. Additional terms and conditions submitted in separate documents will not be included in any awarded contract. Incomplete contract documentation may cause the offeror to be considered unresponsive.
This includes:
1.5.1 Solicitation/Contract Form
Completion of blocks 12, 17a., and signature and date for block 27 of the Standard Form (SF) 1449.
Complete total estimated price for Basic Year IDIQ CLIN 0001, Option Year 1 IDIQ CLIN 1001 and Option Year
IDIQ CLIN 2001.
Complete offeror reps and certs in FAR 52.212-3 (Only paragraph b if annual reps and certs are on file at SAM.gov)
1.5.2 EXHIBIT A, B, C – ELINS
Using the excel document provided with the solicitation, fill in all pricing without material change to the ELIN structure. Desired changes to the ELIN structure shall be requested by submitting a separate document with offeror’s quote indicating the desired ELIN structure with explanation.
2.0 EVALUATION FACTORS
2.1 Evaluation Factors and Subfactors
The following evaluation factors and subfactors will be used to evaluate each Quote. The Government will evaluate
Quotes for acceptability, but will not rank the Quotes by the non-price factors or subfactors.
Factor 1: Technical
Availability of all ELIN items
Factor 2: Past Performance
Recent and relevant past performance
Factor 3: Price
2.1.1 Factor 1: Technical
The Government’s technical evaluation team shall evaluate the technical Quotes on an acceptable or unacceptable basis, assigning one of the ratings described below for each subfactor. Any subfactor evaluated as “Unacceptable” will render the entire Quote unacceptable. Only those Quotes determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial Quote, as received, without discussion.
The Quotes shall be evaluated against the following technical subfactors:

2.1.1.1 Subfactor 1: Availability of all ELIN items
All ELIN items in Exhibit A thru C must be available for delivery at any time during contract Period of Performance in accordance with any limitations specified in the contract and ELIN descriptions. Any requested change to the
ELIN structure must not limit the availability of any ELIN items and shall only facilitate and demonstrate more advantageous ordering procedures.
2.1.2 Factor 2: Past Performance
The Past Performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. Offerors must receive a past performance rating of “Acceptable” to be eligible for award.
2.1.2.1 Ratings
Offeror’s shall be assigned a past performance rating pursuant to Table 2 below.
2.1.2.2 Evaluation Process
The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the solicitation requirements. In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance
Quote volume and information obtained from other sources available to the Government, to include, but not limited to: the Past Performance Information Retrieval System (PPIRS); Federal Awardee Performance and Integrity
Information System (FAPIIS); Contractor Performance Assessment Reporting System (CPARS); Electronic
Subcontract Reporting System (eSRS); or other databases; and interviews/questionnaires with Program Managers, Contracting Officers and Fee Determining Officials, the Defense Contract Management Agency (DCMA), and commercial sources.
2.1.2.2.1 Recency Assessment
An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3 years from the date of issuance of this solicitation.
Past performance information that does not meet the recency threshold established here may not be considered.
2.1.2.2.2 Relevancy Assessment

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
An assessment of the past performance information will be made to determine if it is relevant. To be considered relevant, the effort presented must have involved similar scope, magnitude of effort, and complexity as this solicitation requires. The Government will use the following relevancy definitions when assessing recent, relevant contracts:

2.1.2.2.3 Performance Quality Assessment
The Government will consider the performance quality of recent, relevant efforts (how well the contractor performed on the contracts). The quality assessment may result in positive or adverse findings. Adverse is defined as past performance information that supports an unsatisfactory rating on any evaluation element or any unfavorable comment received from sources without a formal rating system. For adverse information identified, the evaluation will consider the number and severity of the problem(s), mitigating circumstances, and the effectiveness of corrective actions taken. Process changes will only be considered when objectively measurable improvements in performance have been demonstrated. The Government will use the following quality levels when assessing recent, relevant efforts:

ACCEPTABLE During the contract period, contractor performance is substantially meeting (or substantially met) contract requirements. For any problems encountered, contractor took effective corrective action.
UNACCEPTABLE During the contract period, contractor performance is not meeting (or did not meet) some contract requirements. For problems encountered, corrective action appeared only marginally effective, not effective, or not fully implemented. Customer involvement was required.
NOT AVAILABLE Quality and/or performance information is not available.
2.1.2.3 Assigning Ratings
As a result of the relevancy and performance quality assessments of the recent contracts evaluated, offerors will receive an integrated past performance rating at the factor level (see Table 2).
2.1.3 Factor 3: Price
2.1.3.1 Total Evaluated Price (TEP)
The TEP includes the pricing proposed in Exhibit A thru C for the total estimated quantities indicated therein, as also indicated on all contract CLINS and ELINS.
2.1.3.2 Option(s)
The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
3.0 Contract Award
A written notice of award or contract document furnished to the successful offeror signed by the contractor and returned to the government, shall result in a binding contract without further action by either party.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the
Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

252.216-7006 ORDERING (MAY 2011)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the contract schedule. Such orders may be issued from 1
March 2016 through the term of the contract.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c)(1) If issued electronically, the order is considered “issued” when a copy has been posted to the Electronic
Document Access system, and notice has been sent to the Contractor.
(2) If mailed or transmitted by facsimile, a delivery order or task order is considered “issued” when the Government deposits the order in the mail or transmits by facsimile. Mailing includes transmittal by U.S. mail or private delivery services.
(3) Orders may be issued orally only if authorized in the schedule.
