NOTES:

1. The contractor, upon release, shall provide to the Government the Pulsar Cost Estimating Software (PCES) software upgrades. Annual updates of the RS Means computerized data shall be provided by the contractor and incorporated for use as the “current database” upon issuance by RS Means.

1. All contract line items are subject to the Guam Gross Receipts Tax (GRT) and that pricing must include all applicable GRT. Contact the Guam Department of Revenue and Taxation for applicable current information at (671) 475-1815.

1. The Statutory Cost limitations for all minor construction is $750,000.00

CLAUSES AND PROVISIONS

1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were in full text.

1. Clauses and provisions in this document will be numbered in sequence, but not necessarily appear in consecutive order.

1. Sections K, L, and M will be physically removed from any resultant award, but will be deemed to be incorporated, by reference, in that award.

GENERAL NOTES

NOTES:

1. This is a Fixed Price Indefinite Delivery Indefinite Quantity type contract. The above coefficient/ pricing schedule represents the Government’s maximum estimate of the quantities to be ordered during the contract period.

1. A letter of intent to supply performance and payment bonds from a bonding company shall be submitted with original proposal.

GENERAL NOTES

1. In order to be considered for award, each Offeror must identify their coefficient attributed to each ordering period for Task Order Coefficients (CLIN 0001AA, AB), (CLIN 1001AA, AB), (CLIN 2001AA, AB), (CLIN 3001AA, AB), (CLIN 4001AA, AB) and the Design/Cost Estimating Fee Coeffient (CLIN 0001AC, 1001AC, 2001AC, 3001AC, and 4001AC). Coefficients are the price multipliers that the Contractor offers and will be converted from a percentage factor to decimal format. The Government will use these multipliers to determine the price of work for each task on individual Task Orders. The Unit Bare Cost price established in the Pulsar Cost Estimating Software (PCES) database provided by the RS MEANS Company (which means no cost markup for the overhead and profit column, to include subcontractor cost markup), will be multiplied by the local City Cost Index (CCI), identified by RS MEANS at 1.071 (Weighted Average Total for Guam), and the Offeror’s coefficients for either standard or non-standard work hours to arrive at the actual price for a unit of work. (The term “non-standard work hour” is not to be interpreted as “overtime”). The coefficients shall be represented as “net”, a “decrease from” or an “increase to”, the prices listed in the Pulsar Cost Estimating Software (PCES). An offer of “net” would be represented as “1.0”. An example of a decrease from prices in the PCES would be “0.98”. An example of an increase above the prices in the PCES would be “1.10”. The figures entered for CLINs 0001AC, 1001AC, 2001AC, 3001AC, and 4001AC Design/Cost Estimating Fee will be represented in dollar ($) amounts.

1. Coefficients are defined as numerical factors that compensate the contractor for any and all costs (generally indirect costs) not included in the Unit Price Book (PCES). Coefficients must contain all allowable contract costs including contingencies and profit. It covers cost elements such as overhead, profit, project estimating/design services, G&A expenses, bond premiums, and gross receipt taxes. Examples of such costs but not limited to are: superintendent’s salaries, builders’ risk insurance, bond premiums, mobilization/demobilization, pick up and delivery of Government furnished property and/or material, site office overhead, site office building, furniture, equipment, site office staff salaries, vehicle and construction equipment maintenance, office administration expenses, consultant fees. Coefficients should also include all types of insurance, special clothing/ equipment for workers, flag persons, traffic barricades, airfield free zone barricades, construction area enclosures, personnel airfield driving licenses, additional supervision, essential and incidental tools, equipment and protective clothing/equipment gear normally used by tradesmen, asbestos and lead based paint removal plan preparations, base pass requirements, utility/water outages, digging permits and project final cleaning.

1. Changes to the offered coefficients and prices, CLINs 0001AA through 4001AC will NOT be permitted for the Basic Ordering Period or any Option Year (if exercised) after the contract is awarded. The Pulsar Cost Estimating Software (PCES), RS Means Cost Data Guides (MCDG) and City Cost Index (CCI) for Guam will be updated yearly or as required. These updates shall provide the only economic price adjustments permitted for this contract.

1. The terms and conditions of the contract, including but not limited to coefficients and prices included in the Pulsar Cost Estimating Software (PCES) database are applicable to all Task Order modifications.

1. The following Division Number/Title/Major Classifications, from Pulsar Cost Estimating Software (PCES), RS Means Cost Estimating Guides (MCEG), will not be used as line item pricing on Task Orders/Modifications issued under this contract. These costs will be included in the submitted coefficients.

Section C - Descriptions and Specifications

CONTRACT DESCRIPTION

This Simplified Acquisition of Base Engineer Requirements (SABER) contract is a fixed-price indefinite- delivery, indefinite quantity contract for construction efforts at Andersen AFB and its associated sites in Guam. Each construction project will be awarded by individual task orders (TO’s) issued against the basic contract and specifying work in support of real property maintenance, repair, alteration, and minor/new construction. The work is required in support of 36 Base Civil Engineer (BCE) activities headquartered at Andersen AFB, Guam.

The contract will list a wide variety of individual construction tasks required to complete each specific job and the Base Contracting Office will issue individual TO’s to the Contractor to complete those jobs. Individual jobs will vary in size, with the majority expected to be of a small to medium size. The jobs will include but are not limited to such trades as, carpentry, road repair, roofing, excavation, electrical, plumbing, sheet metal, painting, demolition, concrete masonry, and welding.

The Contracting Officer (CO) will issue a request for proposal (RFP) describing basic requirements for each individual TO. Following review of the Contractor’s TO proposal, the CO will negotiate with the Contractor, and award an individual TO. The Contractor shall furnish all materials, equipment and personnel necessary to manage and accomplish the work. The Contractor will be required to maintain management offices on Andersen AFB, Guam in order to receive work requests and provide other management services related to accomplishing individual jobs.

Services such as carpet installation, landscaping, asbestos removal and building demolition may be performed as construction when the work is incidental to a larger construction project. If the preponderance of the work involves the services cited, although there may be some incidental related construction work, the project falls under the Services Contract Act and cannot be performed by SABER.

Duration of the contract will be the basic period with four (4) one-year Option Periods to be executed at Government option. The minimum amount for the entire life of the entire contract period is $10,000; the maximum estimated amount is $30,000,000.00.

SPECIFICATIONS AND DRAWINGS

SABER TECHNICAL SPECIFICATIONS/CONSTRUCTION CODES

Reference Section J (List of Documents, Exhibits, and Other Attachments) Attachment Number 1, Entitled “Technical Specifications”

1. The Technical Specifications, Volume I, are numbered and organized by the 1994 edition of the Construction Specification Institute’s (CSI) Master Format. Division 1 covers base policy. All specifications are filed in Division 2 through 16 as per CSI guidelines. SABER CARPET/TILE and 36 Communication Squadron Specifications are also included in the Technical Specifications.

1. The intent of these specifications is to furnish concise industrial and/or commercial standards for maintenance, repair, and construction of government facilities. These specifications will be used in all SABER projects.

1. Contractor is responsible to ensure each project meets SABER Technical Specifications, Industry Standards, appropriate codes (Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, National Fire Code, National Fire Protection Association, Uniform Federal Accessibility Standards, ASTM Standards in Building Codes, etc.) as well as adequate design for systems/construction to ensure that it functions according to industry standards and contract specifications. All design NOTE: Any work performed not meeting this criterion will be corrected solely at the Contractor’s expense. Approval by the CO shall not relieve the Contractor from responsibility for any errors or omissions, nor from the responsibility for complying with the requirements of this contract. If there is a conflict between the above mentioned building codes, the most stringent requirements shall apply unless specifically requested in writing by the Government.

ABBREVIATIONS

A list of abbreviations to be used is contained in the SABER Specifications.

SAMPLE CALCULATIONS

MEANS COST ESTIMATING SYSTEM (MCES)

1. The MEANS Cost Estimating System (MCES) is available in electronic format (PULSAR Software Program) through Estimating Systems, Inc., P.O. Box 1301 Forestdale, MA, POC: Allan Cleveland, (800) 967-8572, or in hard copy published by R.S. Means Company, Inc., 100 Construction Plaza, P.O. Box 800, Kingston, MA 02364-0800, (800) 448-8182, Ext. 888. The publication may be purchased at standard federal government/SABER discount thru R.S. Means Co., Inc.

1. The MCES will contain pricing information for the description of work to be accomplished in the unit of measure specified. The unit prices from the MEANS Cost Estimating System is referred to as the BARE COST TOTAL and is a national average cost per unit or line item. Quantities are assigned and multiplied by the CITY COST INDEX WEIGHTED AVERAGE (States and Possessions, Guam) and is considered to the localized cost. This total figure is then multiplied by the coefficient, resulting in the delivery order cost.

1. The PULSAR Software/MEANS Cost Estimating System will be updated annually on 1 January by Estimating Systems/R.S. Means Co.

SPECIAL CONTRACT REQUIREMENTS

WORK HOURS

For the purpose of establishing and defining a normal work schedule for this contract, the term “Standard Hours” means the hours of 0700 through 1630 excluding Saturdays, Sundays and Federal holidays (Refer to Paragraph 1 of Section 01000 of the SABER Technical Specifications). Task Orders priced using Standard Hour coefficients are intended to be performed during standard hours. At the Contractor’s discretion, permission to work outside standard hours may be requested under paragraph (b) below. However, no price adjustment will be made for any such work performed outside standard hours.

If the contractor desires to work during periods other than above, additional government inspection forces may be required. The contractor must advise the CO in writing Three (3) business days prior to his desired work period. The CO may authorize the contractor to work outside the standard duty hours/days. However, if approval is granted to permit the Contractor to work other than the hours specified herein, any work of a nature requiring the area to be covered, concealed, buried, etc., will not be planned or performed during this period. All work done during non-duty hours will be readily visible and available for inspection the following day.

WORK CLEARANCE REQUEST

Work Clearance Request will be submitted for all Task Orders Fourteen (14) days prior to the intended start date (Air Force Form (AF 103) will be used to process Digging Permit and Utility Outages)

The BCE work clearance request is used for any work (contract or in-house) that may disrupt aircraft or vehicular traffic flow, base utility services, protection provided by fire and intrusion alarm system, or routing activities of the installation. The form is used to coordinate the required work with key base activities and keep customer inconvenience to a minimum. It is also used to identify potentially hazardous work conditions in an attempt to prevent accidents. The work clearance request is processed just prior to the start of work. If delays are encountered and the conditions at the job site change (or may have changed) this work clearance request must be reprocessed.

The contractor will ensure the AF Form 103 is filled out accurately. She/he will provide support documentation (sketches or drawings with accurate dimensions) to clearly indicate the area affected.

PERFORMANCE AND PAYMENT BONDS (FAR 28.102-2)

As specified below, within Twenty-One (21) calendar days from the date of contract award, the Contractor shall submit performance and payment bonds (SF 25 and 25A) to the Contracting Officer. Each bond will have good and sufficient surety or sureties acceptable to the Government.

Performance and Payment Bonds: The penal amount of performance and payment bonds must equal One Hundred (100%) percent of the Task Order contract amount in excess of $100,000.00 and if the Task Order increases in price, the additional amount must equal to One Hundred (100%) percent of the increase.

NOTE: Additional bonds shall be provided PRIOR to performance of any Task Order, which causes the increased coverage requirement.

SEPARATE REQUIREMENT FOR PROJECT DESIGN/COST ESTIMATING

The Government shall request the Contractor to prepare a Technical and Cost Proposal and participate in negotiations for a specific project prior to the Government’s receipt of full project funding. Once designed and negotiated, the project may be placed on-hold awaiting construction funds.

This effort will be referred to as Project Design/Cost Estimating. Compensation for Project Design/Cost Estimating will be determined by the figure entered on the Price/Coefficient Schedule (SECTION B) for Project Design/Cost Estimating. It is paramount that the figures entered on the Schedule for Project Design/Cost Estimating represents only that portion of CLINs 0001AA through 4001AC attributed to Project Design/Cost Estimating. This CLIN shall not be construed as an additional cost under the contract. Only CLIN 0001AC, 1001AC, 2001AC, 3001AC, 4001AC for Project Design/Cost Estimating shall be used on Task Orders issued for Project Design/Cost Estimating.

Once funds become available for the actual construction of a project previously negotiated under Project Design/Cost Estimating, the total negotiated construction amount shall be adjusted (decreased) by the amount previously paid as compensation for Project Design/Cost Estimating. If the design is less than One (1) year old, the original negotiated amount will be used. Designs older than One (1) year will be updated to the current Pulsar Cost Estimating Software (PCES). A separate Task Order shall be issued to construct the work described in the Statement of Work.

While it is not the Government’s intent to have the Contractor provide a Project Design/Cost Estimating service for projects with no serious SABER construction coordination, the Government is not obligated to issue a Task Order for the construction work described in the Task Order issued for Project Design/Cost Estimating.

If the Government and the Contractor cannot come to an agreement on a particular project to be priced under the Project Design/Cost Estimating process, negotiations shall either be terminated without cost to the Government or the Contracting Officer shall unilaterally direct the tasks with compensation to the Contractor for efforts attributed to their Project Design/Cost Estimating process.

ORDERING PROCEDURES

All Task Orders issued against this contract will be issued by the contracting office noted on SF Form 1442, block #7. Task Orders will be issued on the Department of Defense form, DD Form 1155.

A 35% design/statement of work, which includes a brief description of the specified, work intended and data items required, including site location, any Government Furnished Materials or Property, base support, required submittals and any other pertinent information will be issued to the Contractor as a Request for Proposal. A Pre-Proposal Site Visit meeting with the Contracting Officer, SABER Office, Facility User and Contractor shall take place to clarify the scope of the work requirements and verify existing conditions. The Contractor will provide to the Contracting Officer detailed minutes of the pre-proposal site visit within Three (3) calendar days after completion of the site visit. The SABER Office will conduct a scope review of the detailed Site Visit minutes within Three (3) calendar days and return the Contractor’s submitted Site Visit minutes to the Contracting Officer for final approval. The approved Site Visit minutes will become the basis for the Technical and Cost Proposal for each submitted Task Order.

Upon scope establishment of the individual Task Order requirement, the Contractor shall prepare their Technical and Cost Proposal for accomplishment of the task. All Pulsar Cost Estimating Software (PCES) proposal estimates will follow the guidelines and requirements set forth in Section B and Section C with the Guam cost index applied. The Pulsar Cost Estimating Software will not be manually adjusted or manipulated to change bare cost data to reflect local conditions and/or material and labor costs. Additionally, no changes to the selection drop down (sub) tab that selects subcontractor costs to each line item selected will likewise be permitted.

A comprehensive Technical and Cost Proposal for requested work shall be submitted to the Contracting Officer within Twenty-one (21) calendar days from the date of the pre-proposal Site Visit. Requests for additional proposal preparation time will be handled on a case-by-case basis. Generally, additional proposal preparation time for complex electrical, mechanical, architectural, structural, fire sprinkler and/or alarm system projects may be requested, but will not exceed Five (5) calendar days as approved by the Contracting Officer.

The Contractor’s comprehensive Technical and Cost Proposal shall include but not limited to: a detailed (Contractor developed) Statement of Work that must be supported by all necessary documentation to indicate that adequate engineering design and planning to accomplish the required work have been performed. The following are examples of documentation which will be included (as the Contracting Officer determines appropriate) with all proposals: Pulsar Cost Estimate, any Non-Priced Item Cost work-ups, AF Form 66 (Schedule of Material Submittals), Asbestos and/or Lead Base Paint test results, proposed project utility outages, drawings (AutoCAD DWG Drawing Files), work flow chart (similar to pert diagram), calculations, catalog cuts, specs, architectural renderings, etc. Project drawings shall be drawn to scale and dimensioned. Costs for such documentation shall be included in the Contractor’s coefficient and will not be paid by the Government. Adequate design must be certified by the SABER Contractor on each proposal to include noting any deficiencies that must be corrected to satisfy the design. This shall include single line drawings with necessary details and calculations.
