MEMORANDUM FOR PROSPECTIVE PROPOSER 入札事業者各位

SUBJECT: Policies and Procedures for Doing Business with the U.S. Government

米国政府の商取引に関する方針及び手続について

1. This is to acquaint your firm with certain policies and procedure in doing business with the United States Government.

米国政府の商取引に関する方針及び手続に関しては、次のことについてあらかじめご承知ください。

2. Purchases are normally made by soliciting quotations from all qualified sources deemed necessary to assure full and free competition. Collusion between vendors that restricts competition or restrains free trade is in direct violation of U.S. government purchasing policies.

契約は、完全で自由な競争を保証することができる事業者からの入札に基づいて締結されます。事業者間における

談合などの不公正な取引行為は、米国政府の調達方針に対する明白な違反行為とみなされます。

3. If evidence indicates that a firm acts in any way that restrict full and free competition, this office will reject their proposal and remove their firm from our list of qualified sources.

事業者において、完全で自由な競争入札を阻害する行為が明らかになった場合には、当契約中隊は、当該事業者

からの入札を拒絶するとともに、当契約中隊の入札事業者リストから当該事業者を抹消します。

4. All U.S. government personnel engaged in purchasing and related activities must conduct business dealings with industry in a manner that is above reproach in every respect. All contracts contain the “gratuities” clause. This covers measures to be taken in the event gratuities (in the form of entertainment, gifts or otherwise) are offered or given by the contractor. This clause covers any agent or representative of the contractor. Gratuities offered to any officer or employee of the U.S. government with a goal of securing a contract or securing favorable treatment with respect to the awarding/amending, or the making of any determinations with respect to the performance of such contract is illegal. I urge you to advise me of any irregularities you encounter while conducting business with the U. S. government employees.

すべての調達業務とその関連業務に携わる米国政府職員は、事業者とのあらゆる折衝に当たって、いかなる不正を

も疑われないように職務を遂行することが義務付けられています。すべての契約には、賄賂に関する条項が含まれま

す。この条項には、接待や金品等の贈賄行為に対する処分について定義しています。この条項は、事業者の代行業

者及び事業者の代理人に対しても同様に適用されます。契約受注の確約、事業者選定や入札内容についての有利

な変更、あるいは契約締結後の有利な取扱を目的とした米国政府職員への物品や役務の提供は、違法行為とみな

されます。入札など商取引を行うに当たって何らかの不正行為を発見された場合には、当契約中隊司令官までご通

報下さるようお願いいたします。
