D-B SCOPE OF WORK

1. GENERAL

1.1. Intent is to construct roof canopies over the two emergency stairwells on bldg. 9443, and refinish existing stairwells. This is a design-build contract; the drawings provided are conceptual in nature and serve to assist in the bidding process. They do not restrict the design of the canopies to what is shown. The specifications provided throughout are to provide design guidance and must be followed; any deviations from them must be approved by the Government. Structures must be designed and constructed using economical and code compliant methods and materials.

1.2. Facility will remain in use throughout the construction, so contractor must protect occupants from safety hazards and set up safety signage/barriers throughout, see attached specification section 09910 for containment requirements during painting operations.

1.3. Power Outages: Although unlikely, any power outage notifications must be sent to government a minimum of 2 weeks prior with a 24 hour confirmation notification prior to outage.

1.4. Site Storage: On site storage outside of the project areas is limited. The contractor shall minimize storage of materials and equipment on site.

1.5. DAMAGE TO EXISTING SITE CONDITIONS: The contractor shall be responsible to repair any and all damage incurred to existing Real Property/Grounds at no cost to the government. Contractor shall not park or drive on, sidewalk or grassy/snowy areas.

Damage incurred shall be repaired at no cost to the government.

1.5.1. This includes any disturbances to the grass in the surrounding areas.

1.5.2. All excavated soil that is not used as backfill around the concrete footings must be removed from the site, and the grass returned to its original condition.

1.6. MACC Contractors are strongly encouraged to visit the site and get familiar with all the work related to the project prior to submitting a bid, to verify existing site condition and other information as noted in the scope of work and drawings, as well as to become familiar with the scope of work. Failure to visit the site does not relieve the

Contractor from the responsibility of performing all work required to provide a complete and useable product in accordance with the Contract documents.

1.7. Use of existing building and utilities: The Contractor will not be permitted to use any facilities inside the existing building with the exception of electrical power, if there are available outlets on the exterior of the facility. The Contractor shall exercise strict conservation practices in the use of the existing facility utilities. Should the Contractor be found to be not using utility conservation practices, the cost of this utility use will be passed along to the Contractor for the remaining performance period of the contract.

If exterior outlets are not available, contractor must provide their own power as needed.

1.8. All material/surface preparations, installation procedures, product compatibility, safety/handling procedures, and material assemblies must be approved by each individual product manufacturer and done so in accordance with each manufacture’s installation & handling instructions.

2. STAIRWELL REHAB

The paint on both stairwells is badly deteriorated and corroded due to excessive exposure to chemical ice melt. The following tasks will need to be done in accordance with the attached specifications section 09910 Field Painting Structural Steel:

2.1. Remove and dispose of all existing diamond patterned steel plates that are installed over the stair treads. Plates are currently attached by spot welds as well as bolts.

Intent is to expose the steel grating below the plates, which will serve as the new tread surface.

2.2. Strip all existing finishes from the stairwells to SSPC-SP10 Near-White Blast Cleaning standard. If coating manufacturer allows a lower SP rating, then their recommended rating shall be sufficient.

2.3. Following blast cleaning of the stairwells, contractor must visually inspect all members and welds for defects. If any components appear to be damaged or inoperable the contractor must immediately notify the Government.

2.4. Apply a new three-coat system to both stairwells. This includes all stair treads/risers, stringers, supporting structural members, hand/guardrails, and all other steel

01020-3 components of the stairwells. No steel shall be exposed anywhere on them without receiving the new system.

2.5. Pressure wash and completely clean all concrete landings. Apply two coats of a matte finish chemical resistant concrete sealer to the landings. Surface prep and application must be done in accordance with the manufacturer’s instructions. Finished surface shall not be slick. An example of an acceptable sealer is CoverTec CoverShield U100 or approved equal.

3. NEW CANOPIES:

Contractor is to design and construct new canopies over both existing stairwells. Design process shall be done in accordance with specification section 01021 Design After Award.

Conceptual/preliminary design drawings are provided and shall serve as a starting point for contractor’s design, but are not restrictive in nature. See specification section 08900 Structural Design for additional detailed design guidance.

3.1. Canopies shall be designed to protect against snow accumulation on the stairwells with all canopy dimensions being sufficient to provide complete coverage.

3.2. Materials and methods chosen by the contractor must be economical yet compliant with all cited codes, regulations, and specifications.

3.3. If steel components are shop primed or prepared; ensure all coatings and surface prep meet the same specifications as those outlined in section 09910 Field Painting Structural Steel, which are the same standards as the stairwells themselves.

3.4. Canopy support foundations shall be engineered as part of the design-build effort.

Concrete mix design, size, and reinforcement shall be designed by a licensed Structural Engineer and done in accordance with the specification section 03300 Cast-In-Place Concrete. Deviation from those specifications can be requested in writing and is subject to Government approval.

3.5. Due to the close proximity of the existing stairwells and the facility, it appears the best method for supporting one side of the canopy is to secure directly to the facility’s exterior wall. If this method is chosen by the Contractor/Designer of Record, then all methods/materials of securing to the facility must be approved by the Structural Engineer of Record and detailed on the design drawings. All penetrations into the wall

01020-4 must be completely sealed with permanent waterproof silicone caulking, or a material chosen by the Designer of Record and approved by the Government. Attached exhibit drawings show wall construction details for the Designer/Engineer’s reference.

3.6. Canopy roof surface shall be galvanized metal decking, minimum 18 ga. or as approved by the Structural Engineer of Record and Government. Snow shall not shed onto the existing sidewalks or stair landings.

DESIGN AFTER AWARD

SECTION 01021

PART 1 GENERAL

1.1. SUMMARY

1.1.1. This section lists items that must be submitted for review at various times during the preparation of the construction plans and specifications. A meeting with the Government shall be required following contract award, referred to as the Proposal Documents Review Meeting. An over the shoulder meeting shall be required while design is in progress. The Contractor shall provide documents as required to allow Government comment and input. The requirements of the after award meeting, over the shoulder review meeting, and draft final design stage meeting are listed in this section.

1.1.2. Design submittals must comply with all requirements stated in this RFP, including amendments. In the event of any conflict between the RFP criteria and the Contractor’s submittals, the RFP criteria will govern unless there is a written and signed agreement between the Contractor and the Contracting Officer waiving a specific requirement. Notice to Proceed based on the Contractor’s proposal does not waive a specific requirement in the RFP.

1.1.3. The Contractor shall provide design submittals for review by the Government according to the project Schedule. Quantities of submittal requirements are summarized in paragraph 1.6.

1.1.4. Meeting Records: The Contractor shall, within ten (10) working days after meetings prepare a written record of the meeting and furnish to the Project Manager. The written report shall include the project name, contract number, subject, names of the participants, outline of discussions, recommendations, and conclusions. All meetings, site visits, review conferences, and require written records. Written records may be provided in .pdf format via electronic delivery.

1.2. AFTER AWARD, FOPR DOCUMENTS REVIEW MEETING

1.2.1. After contract award, the D-B Contractor and leaders from each design discipline shall meet with project stakeholders from the Government. At this meeting stakeholders and D-B Contractor shall review the scope of work and the D-B Contractor’s schedule. Comments and discussions at meeting may cover a wide variety of issues.

1.2.2. The D-B Contractor shall provide a draft project schedule at this meeting for review and discussion.

1.3. INTERIM DESIGN REVIEW & MEETINGS

1.3.1. Interim Design submittal and review meetings shall follow the schedule of the D-B Contractor’s initial proposal and shall incorporate a 14-day review period for Government review and comment, D-B Contractor response to Government comments, ending with a design review meeting. Changes to that schedule must be requested in writing and approved by the Government.

1.3.2. After receipt of the interim design review submittal package, the Government shall have 14 calendar days for review and comment. D-B Contractor response to review comments shall follow, with a design review meeting held at JBER approximately one week following the end of the review period. The review will be to ensure conformance with the requirements of the solicitation and the D-B Contractor’s Proposal.

1.3.3. Interim Review Meeting: The Government will furnish the D-B Contractor comments from the various design sections and from various stakeholders involved in the review process. The D-B Contractor shall bring key design personnel from each discipline to all review meetings. During the meetings, the D-B Contractor will have the opportunity to either accept the comments, with or without provisions, or have comments withdrawn if generally agreed upon.

1.3.4. Review comments provided to the D-B Contractor will not necessarily show coordination requirements with other parts of the submittal. The D-B Contractor shall incorporate and coordinate the review comments into each part of the next submittal.

1.4. ANNOTATING REVIEW COMMENTS

1.4.1. The D-B Contractor shall document all comments and responses on the workday before the review meeting. The D-B Contractor shall make copies for distribution at the review meeting. The D-B Contractor shall post the disposition of each comment at the review meeting.

1.4.2. The D-B Contractor shall ensure all designer responses have been addressed. The D-B Contractor shall furnish a hardcopy of the disposition of all comments within seven days. The disposition will clearly indicate the specific actions taken in response to each comment. Merely stating “concur” or “will comply” is not considered an adequate indication of actions taken.

1.4.3. The D-B Contractor is cautioned that if they believe the action required by any comment exceeds the requirements of the FOPR, they shall take no action and immediately notify the Contracting Officer in writing. No work or services shall be performed for which an additional cost will be charged without prior written authorization of the Contracting Officer.

1.5. FINAL DESIGN BACKCHECK REVIEW

1.5.1. Final Design submittal and backcheck review shall follow the schedule of the D-B Contractor’s interim design review and shall incorporate a 14-day Government

During this backcheck review the Government and D-B Team will verify the comments from the interim review have been satisfactorily addressed and incorporated in the final design. Following the backcheck review, the Government will notify the D-B Contractor the final design is approved for construction.

1.5.2. Final Backcheck Review Meeting: A final backcheck review meeting may be required if there are open or unresolved only be convened if necessary, if for example significant comments from the interim review have not been dispositioned satisfactorily or if the final design contains critical deficiencies. If needed the final design shall be corrected and resubmitted for another backcheck review.

1.6. DESIGNER OF RECORD

1.6.1. The D-B Contractor shall identify, for approval, the Designer of Record (DOR) that will be responsible for each area of design. The DOR shall exercise a standard of care for all design professional services commensurate with the care and skill ordinarily used by members of the design profession practicing under similar conditions at the same time and locality of the project. The DOR must be licensed and/or registered as a professional in the discipline for which services are provided. One DOR may be responsible for more than one discipline. All design disciplines shall be professionally registered in the State of Alaska, or have five years of northern climate design experience. If the deliverables are not ready for release for construction, they should be identified as "preliminary" or "not for release for construction" or by using some other appropriate designation. The DOR shall also be responsible for maintaining the integrity of the design; for compliance with the contract requirements through construction; documentation of the as-built condition; coordination, review and approval of extensions of design, material, equipment and other construction submittals; review, coordinate and seek resolution for Government approval or disapproval of requested deviations to the accepted design or to the contract; coordination with the Government of the above activities; and by performing other typical professional designer responsibilities.

1.6.2. The Designers of Record or designated representative shall review and approve all construction shop drawings and submittals.

1.6.3. Where construction and testing standards and criteria are contained within the specifications, the Designer of Record shall place them in the construction documents and require them of the D-B Contractor during construction.

1.7. DESIGN DELIVERABLES

1.7.1. D-B Contractor shall submit hard and electronic copy sets of documents for each phase as required.

1.7.2. All electronic files shall be submitted on CD-ROM.

1.7.3. Design Deliverable Package(s)

1.8. INTERIM DESIGN SUBMITTAL REQUIREMENTS

1.8.1. GENERAL REQUIREMENTS

1.8.1.1. The intent of the interim design is to provide the Government and the various stakeholders sufficient detail to understand the various systems and materials being incorporated into the project. It is the Government’s desire to avoid having important or critical design details introduced in the final design submittal, which may not be acceptable and cause design rework.

1.8.1.2. The D-B Contractor, DOR(s) and Government shall discuss and jointly determine what is expected to be included in the interim design submittal package at the kick-off meeting.

1.8.1.3. All architectural materials finish and color selections as required in 2.3 Architectural Design and Construction Criteria shall be presented to the Government for review at the interim design submittal stage, with final decisions included in the final design.

1.8.1.4. A substantial number of comments generated by the Government or comments indicating that constructability and/or compliance with the FOPR is not apparent at any of the defined submittals shall constitute grounds for the requirement of another, more complete, design submittal. The Government shall determine during the defined review period and prior to the review conference date if another submittal will be required.

1.8.2. DRAWINGS

1.8.2.1. Drawings must conform to parent MACC specifications for drawing format.

1.8.3. PRODUCT/MATERIAL INFORMATION

1.8.3.1. D-B Contractor shall be required to submit product or material information as required for design submittals. Refer to the attached draft AF Form 66.

1.8.3.2. The project requirements provided in this FOPR indicate minimum requirements that shall be used by the D-B Contractor’s Designers of Record to develop the corresponding product information and or material specifications.

1.8.3.3. A draft AF Form 66 shall be submitted for review with the interim design submittal and/or prior to any material processing. In additional to specification submittal requirements, catalog cut sheets to be provided with interim design submittal shall be listed on the AF Form 66. The Government will review the draft AF Form 66 and indicate the types of submittals to be provided for the various items listed. The AF Form 66 shall be coordinated with the project schedule. The intent is to ensure submittals are reviewed and approved (if required) prior to procurement, and lead times are coordinated with construction schedule activities.

1.8.3.4. All product or material information submittals whether for Government approval or For Information Only (FIO) shall be reviewed by the Designer of Record prior to submittal to the Contracting Officer.

1.8.4. DD FORM 1354 – TRANSFER AND ACCEPTANCE OF DOD REAL PROPERTY

1.8.4.1. The D-B Contractor shall provide a completed DD Form 1354, Transfer and Acceptance of DoD Real Property, (reference DD Form 1354 in Appendix). The DD Form 1354 itemizes component costs for the construction of this project, and is used by 673CES Real Property to update JBER assets inventory. The DD Form 1354 shall be in accordance with latest version of UFC 1-300-08. Three types of 1354’s shall be required:

1. Draft 1354: Due at interim design.

2. Interim 1354: Due at or before time of beneficial occupancy and/or project acceptance.

3. Final 1354: Due at or prior to final invoicing.

1.9. FINAL DESIGN SUBMITTAL REQUIREMENTS

1.9.1. GENERAL REQUIREMENTS

1.9.1.1. The final design documents shall be complete with sufficient details to construct the facility at this submittal. All major systems are to be coordinated for construction purposes.

1.9.1.2. Design Analysis, calculations, and catalog cuts of major and significant components and systems shall be complete as required. Drawings shall depict level of overall completion with major and significant systems equipment and schedules taking precedence.

1.9.1.3. The contents shall reflect clearly the requirements listed in this FOPR and the D-B Contractor's proposal along with any subsequent items negotiated since

1.9.1.4. New design details or elements introduced in the final design shall be subject to Government review, comment and approval.

1.9.2. REVIEW COMMENTS

1.9.2.1. Incorporate all Government review comments from the interim and informal design review meetings into the final drawings and specifications.

1.9.3. DRAWINGS

1.9.3.1. Drawings must conform to parent MACC specifications for drawing format.

1.9.4. CALCULATIONS AND PRODUCT/MATERIAL INFORMATION

1.9.4.1. Calculations and product / material information shall be complete at this submittal.

1.9.5. REQUIREMENTS BY DISCIPLINE

1.9.5.1. STRUCTURAL

1.9.5.1.1. Design Analysis – list and include discussion of the following:

• Technical references (codes, manuals, directives).

• Design criteria (dead and live, gravity and lateral loads).

• Foundation design considering gravity and lateral loads.

• Gravity and lateral framing system (primary and secondary members), and their connections.

• Structural Calculations

1.9.5.1.2. Drawings –As a minimum include the following items:

• General notes, code analysis, soils data, design live loads and material specifics.

• Foundation Plan and schedule(s).

• Roof Framing Plan.

• Sections and details of footings and member sizes.

• Sections and details of connections, bracing, diaphragm, etc.

• Column connection details.

• Framing member, column, beam and truss schedules as applicable.

• Braced and/or moment frame elevations.

1.9.6. DESIGN APPROVAL

1.9.6.1. The D-B Contractor shall obtain written approval of all aspects of the design from the Contracting Officer prior to beginning any field or construction work. The D-B Contractor should anticipate a final Design Submittal review

Construct Enclosed Exit Stairwells Bldg 9443 period of fourteen (14) days before the Government issues approval for construction to proceed.

1.9.7. REVISIONS TO THE APPROVED DESIGN

1.9.7.1. Once the final design submittal(s) has been accepted by the Government and released for construction, the D-B Contractor may not revise the design or delete any item from the project shown on the accepted and released Documents without prior Government approval. The D-B Contractor shall provide all items shown on the Documents, as accepted and released for construction. Contracting Officer (CO) review or acceptance of design submittal packages including the Construction Documents shall not be construed as a waiver from requirements where those requirements may have been erroneously expressed or omitted from the D-B Contractor prepared design documents, unless the D-B Contractor has specifically noted such variations and the Contracting Officer has accepted them in writing. These documents shall define the construction for this project.

1.9.7.2. The D-B Contractor must obtain both the approval of the Designer of Record and the Government’s concurrence for any D-B Contractor proposed revision to the Government reviewed and approved Construction Documents.

1.9.7.3. Unless the Government initiates a change to the contract requirements, or the Government determines that the Government furnished design criteria are incorrect and must be revised, any D-B Contractor initiated proposed change to the contract requirements, which results in additional cost, shall strictly be at the D-B Contractor’s expense.

1.9.7.4. The D-B Contractor shall track all approved revisions to the reviewed and accepted design and shall incorporate them into the as-built design documents.

1.10. CONSTRUCTION PHASE SUBMITTAL REQUIREMENTS

1.10.1. GENERAL REQUIREMENTS

1.10.1.1. Submittals shall be prepared by suppliers and submitted to the D-B Contractor and Designer/Engineer(s) of Record for review and approval.

Provide copies of final approved submittals bearing the D-B Contractor’s and Designer/Engineer(s) of Record’s review stamps to the Contracting Officer.

Submittal procedures shall be in accordance with MACC Contract Section 01000 paragraph 7 - Material Submittals. All submittals shall be submitted electronically, along with hard copy.

1.10.2. SUBMITTAL REGISTER

1.10.2.1. The D-B Contractor shall develop and submit a master list of all submittal items for review by the Government, organized by design discipline. The AF Form 66, Schedule of Material Submittals (Submittal Register) shall include

Construct Enclosed Exit Stairwells Bldg 9443 but not be limited to individual discipline requirements included in this section, and shall be in accordance with MACC Contract Section 01000 paragraph 7 – Material Submittals. A draft AF 66 has been included with other FOPR documents, however Contractor must submit a final draft.

1.10.3. HAZARDOUS MATERIAL SUBMITTALS

1.10.3.1. See specifications sections 01120 and 01121 for guidance relating to hazardous material submittals and procedures.

1.10.4. PROJECT CLOSEOUT SUBMITTALS

1.10.4.1. Record Drawings: provide record “as-built” drawings updated from the final design for all field changes, as indicated in the maintained construction “red-lines”, and actual installed conditions. All record drawings shall be transmitted electronically and hard copy in accordance with SOW.

ENVIROMENTAL PROTECTION / HAZARDOUS MATERIALS ON JBER

SECTION 01120

1. APPLICABLE LAWS AND DIRECTIVES

The Contractor and all subcontractors, in performance of this contract, shall comply with all Federal, State and local laws, regulations, orders and ordinances concerning environmental quality and environmental pollution abatement and control. The contractor is responsible for any fine, penalty assessments and/or natural resources damage claims that are brought against JBER for those incidents determined by the Contracting Officer which are due to Contractor’s performance or failure to perform during the execution and performance of this contract.

1.1 TECHNICAL ASSISTANCE

Technical assistance for complex environmental problems will be coordinated with:

a. The Base Environmental Coordinator, 673 CES/CEIEC 552-2445.

b. Bioenvironmental Engineering, 673 AMDS/SGPB, 384-3985.

1.2 Work shall be accomplished within the guidance and limitations established by the following, based on the most current changes and amendments thereto:

1.2.1 Title 40, Code of Federal Regulations.

1.2.2 673 ABW Instructions.

2. PROTECTION OF LAND RESOURCES

2.1 GENERAL

The Contractor shall furnish all labor, materials and equipment required to protect environmental quality and prevent environmental pollution as a result of work performed in accordance and/or in violation of the Technical Provisions of these specifications.

Environmental pollution is defined as any activities, actions or consequences of Contractor activity that produce an undesirable effect on the human environment, including environmental resources such as land, water,air or sound. Land and water resources within the project boundaries and any other location visited by the Contractor shall be preserved or referred to conditions existing prior to this contract. The Contractor shall confine construction activities to areas allowed by the plans and specifications.

2.2 EXISTING STRUCTURES AND UTILITIES

No excavation shall be performed until site utilities have been field located and 673 ABW Form 3, BCE Work Clearance Permit is processed by the contractor and approved as necessary. The Contractor shall take the necessary precautions to ensure no damage occurs to existing structures and utilities. Damage to existing structures and utilities, including monitoring wells and remediation systems, resulting from the Contractor’s operations shall be repaired at no additional cost to the Government. Utilities encountered that were not previously shown or otherwise located shall not be disturbed without written approval from the Contracting Officer.

2.3 LANDSCAPE PRESERVATION

The Contractor shall not remove, disturb, injure or destroy trees, shrubs or any other surface vegetation without written authority from the Contracting Officer.

2.2.1 The Contractor shall protect all trees adjacent to or within the contract work area which are not specifically designated for removal on the contract drawings.

Protection shall include erection of sturdy barriers installed at a minimum distance of 10’ from each tree. Barriers shall be maintained intact until all grading, construction and landscaping work are completed, with exception of such contouring as is required after removal of the barriers. All slopes shall be contoured by hand digging and hand raking to blend the protected areas into the final grade, after barrier removal.

2.3 Location of Temporary Field Offices and/or Storage Facilities: The Contractor shall obtain written permission from the Contracting Officer for locating any temporary office, storage or other buildings on Air Force controlled property. The Contractor shall request location of said facilities by submitting a letter and location drawing to the Contracting Officer. Any ground surface change or defacement caused by the location of said buildings shall be restored to the condition that existed before the contract by the Contractor, at no expense to the Government.

2.4 LANDFILL DISPOSAL

All non-regulated waste including asbestos materials shall be disposed in an off-base state approved site.

3. PROTECTION OF AIR QUALITY

3.1 EMMISIONS

Identify air pollution generating equipment or processes that may require federal, Alaska, or local permits under the Clean Air Act. Determine requirements based on any current installation permits and the impacts of the project. Provide a list of all fixed or mobile equipment, machinery or operations that could generate air emissions during the project to the

Installation Environmental Office (Air Program Manager).

3.2 DUST

As required by 18 AAC 50.045(d), control fugitive dust emissions. Fugitive dust emissions (airborne dust generated by vehicles operating on unpaved surfaces, transfer or transport of dust producing materials, etc.) shall be controlled at the construction site, along haul routes and at staging areas. The Contractor shall be required to maintain all excavations and excavation activities, embankments, stockpiles, hauling activities and all other work areas free from airborne dust. Dust control shall be practiced as required for the term of the contract.

The cost of any required dust control will be borne in full by the Contractor.

3.3 OPEN BURNING

The Contractor shall not engage in any burning activities on Air Force controlled properties.

4. PROTECTION OF WATER QUALITY

4.1 SURFACE AND GROUND WATER

4.1.1 The Contractor shall not operate equipment or machinery in any stream or lake without written permission from the Contracting Officer.

4.1.2 The Contractor shall prevent the deposit of any materials (including earth fill, vegetative waste, oils and grease) into any stream or lake. Any such accidental deposit will be immediately reported to the Contracting Officer.

4.1.3 The Contractor shall not directly discharge effluent from any process, including water-washing processes, into the sanitary sewer or storm drain system. Effluent and residues shall first be collected, sampled and tested for compliance with ADEC’s Alaska Pollutant Discharge Elimination System (APDES) regulations for discharge.

Disposal shall be made in accordance with APDES requirements based on the test results. Sampling, testing and disposal costs shall be borne in full by the contractor.

4.1.4 Any project which disturbs one acre or more is subject to regulations for storm water discharges. The contract will be responsible for submission of State of Alaska Department of Environmental Conservation (ADEC) (Notice of Intent (NOI) for Storm Water Discharges Associated with Industrial Activity under a APDES General Construction Permit. The contract will also be responsible for submission of stormwater pollution prevention plans (SWPPP) to ADEC or the Municipality of Anchorage, as applicable.

4.1.5 The contractor shall not install, alter, or modify any underground injection control class V unless other options have been determined to be either technically cost prohibitive of would adversely impact mission requirements. Documentation of exceptions needs to be provided to the Environmental Quality Branch Chief before any installation, alterations, of modification may proceed in an effort to comply with the Safe Drinking Water Act, 40 CFR Part 144.

4.2 WASTEWATER

4.2.1 Chapter 26.50 of the Anchorage Municipal Code (AMC) Sewer Service Ordinance requires significant industrial users to have a permit to discharge wastewater into the municipal sewer system. JBER is an indirect discharger of non-domestic wastewater and contributes more than five percent of AWWU total wastewater load per day; thus, JBER is classified as a significant industrial user. AWWU Industrial Wastewater Discharge Permit #11 (JBER AWWU Permit) to describe how activities are managed at JBER in order to minimize the chance of discharging toxic and/or hazardous pollutants into the municipal sewer system.

4.2.2 The contractor is required to prevent the discharge of any substance that may upset or degrade the municipal sewer system, cause health or safety problems, or exceed JBER AWWU Permit effluent limits. The applicable regulations that help ensure JBER’s wastewater discharges comply with the permit requirements are:

a. United States Environmental Protection Agency (EPA) Title 40, Code of Federal Regulations (CFR), Part 112 – Oil Pollution Prevention, (2015)

b. United States Environmental Protection Agency (EPA) Title 40, Code of Federal Regulations (CFR), Part 403 – Pretreatment Standards

c. Alaska Department of Environmental Conservation (ADEC) Title 18, Alaska Administrative Code (AAC), Part 75 – Oil and Other Hazardous Substances Pollution Control, (18 AAC 75), (2016)

d. Chapter 26.50 Anchorage Municipal Code (AMC) - Sewer Service Ordinance, (2016)

4.2.3 Notification for Discharges to the system

AWWU notification requirements are defined in the JBER AWWU Permit. Slug discharges are defined as any substance released at a rate or concentration that could cause a violation of the discharge standards, or any discharge of a non-routine, episodic nature. Slug discharges include, but are not limited to, accidental spills or a non-customary batch discharge. The contractor shall immediately notify the Contracting Officer and 673 CEIEC Water Quality Manager of a discharge in the following situations:

a. Any discharge to the sewer system of substances prohibited by AMC 26.50.050, FXSB 12-1223 Construct Enclosed Exit Stairways B 9443 JBER-E, AK

01120-5 or which may endanger public health.

b. Any spill of material prohibited by AMC 26.50.050 or slug discharge which may enter the sanitary sewer system.

c. Any unanticipated treatment bypass or upset which may exceed effluent limitations outlined in the JBER AWWU Permit Sections 1.C. & 1.D.

The notifications will include the following: location of the discharge; date and time of discharge; type of material/waste; concentration and volume of discharge; and corrective actions taken.

5. PROTECTION FROM TOXIC OR HAZARDOUS MATERIALS

5.1 HAZARDOUS MATERIALS

Reference: Title 29, Part 1910, Code of Federal Regulations, Alaska Statutes Section 18.60.010, and Federal Standard 313.

5.1.1 General

All materials used by the Contractor, or removed or handled as a part of Contractor operations will be stored, handled, utilized and disposed of in a manner designed to prevent any reasonable possibility of exposures to both Contractor and non-contractor personnel, pollution or damage to Government property or facilities, or to the environment.

5.1.2 Manufacturer supplied and product specific Safety Data Sheets

Any and all known or potentially toxic or hazardous materials to be brought by the Contractor onto the military installation and or job site will require the submission of a properly completed Safety Data Sheet (SDS) as directed by 29 CFR 1910.1200 (OSHA Hazard Communications Standard), Federal Standard 313E (Fed Std 313E, 2014), and Alaska Statutes Section 18.60.010.

Guidance as to what constitutes a potentially toxic or hazardous material may be found in these references. These listings are for guidance only, and do not release the Contractor from his responsibility for identification, proper handling, use, storage and disposal of these materials.

5.1.2.1 A copy of each SDS shall be provided to the Contracting Officer a minimum of 10 working days prior to the materials being brought onto the installation. A second complete copy will be maintained on the job site at all times for employee and inspector reference IAW 29 CFR 1910.1200 and Fed Std 313E.

5.1.2.2 SDSs must contain complete information. SDSs must be available for review by the Bioenvironmental Engineering function and other authorized Medical Authorities

IAW 29 CFR 1910.1200 and Fed Std 313E. Bioenvironmental Engineering is authorized to review SDSs containing proprietary information. All SDSs must be clearly marked to indicate the installation on which the project is being performed, the title of the project and the contract number for the project. Material lists must be updated every 90 days and submitted to the Contracting Officer and 673 LRS (Hazmart Pharmacy).

5.1.3 Hazardous Materials Listing

A listing of all hazardous materials and known or potentially toxic materials under the Contractor's control and currently on the installation will be maintained at the job site. The listing will include the item description and the manufacturer's name as it appears on the SDS, the quantity on hand, and where the material is stored/located. This listing will be updated not less than quarterly to account for usage and receipt of new or replacement materials. The total quantity used for each hazardous material must be recorded and submitted to Contracting Officer at end of the project or calendar year, whichever comes first. This information is required for EPCRA reporting.

5.1.4 Labeling of Products

All known or potentially hazardous materials as described in paragraphs 5.1.1 through 5.1.3 above will be transported and stored in the original manufacturer's containers. These containers shall be provided with manufacturer's labels meeting the information requirements of 29 CFR 1910.1200, Alaska Statues Section 18.60.010, and AFI 90-821. Bulk materials and materials that must be re-packaged or placed into different containers at the job site will be clearly labeled by the Contractor with durable labels, meeting the above requirements. Final use containers, such as paint pots, vats, solvent tanks, etc., shall be appropriately labeled with their contents. Materials without appropriate SDSs and proper, legible labeling will not be allowed on the installation. Any materials/containers belonging to or under the control of the Contractor found not meeting these requirements will have all deficiencies corrected within 24 hours or the materials will be removed from the installation by the Contractor within the same 24-hour limit. This time limit applies regardless of time of day or day of week, and includes holidays and weekends. All corrective action costs and/or removal costs will be borne by the Contractor.

5.1.5 Safety Data Sheets relating to Government supplied materials, and hazards presented by Government operations at or in the Contractor's job site may be obtained through the Contracting Officer. Requests for information must be provided to the Contracting Officer a minimum of 20 working days prior to the date this information is required.

5.2 HAZARD COMMUNICATION

Hazard Communication Program.

5.2.1 The Contractor shall establish and implement a written hazard communication program meeting the requirement of 29 CFR 1910.1200 and Alaska Statutes Section

18.60.010 Subchapter 15. This program shall be complete and fully implemented prior to start of work and shall be updated as necessary to reflect changes in working conditions or materials used. A complete copy of the Contractor's program shall be submitted to the Contracting Officer for approval a minimum of 20 working days prior to the start of work.

5.2.2 The Contractor shall, at no cost to the Government, provide workplace hazard training to all non-contractor personnel, including Government inspectors, who will be working at or on the Contractor's job site where known or potentially toxic or hazardous materials are to be used by the Contractor. Bioenvironmental Engineering shall be present when Government personnel receive hazard training.

This training shall meet the requirements of 29 CFR 1910.1200. This training program shall be complete, and all affected personnel shall be fully trained prior to the start of work. Training shall be updated or re-accomplished as necessary to reflect changes in working conditions, materials used or new personnel requiring training. This training shall be separately documented for each individual in writing, and signed by the individual and the person providing the training. One copy will be provided to the individual, one to the individual's supervisor, one to the Contracting Officer and one maintained on-site for review by both Contracting and outside agency inspectors.

5.2.3 Hazard Communications information relating to Government supplied materials and hazards presented by Government operations at or in the Contractor's job site may be obtained through the Contracting Officer. The Contracting Officer may obtain this information from Bioenvironmental Engineering. Requests for information must be made in writing to the Contracting Officer with sufficient lead time to allow Bioenvironmental Engineering a minimum of 20 working days to process the request.

6. HAZARDOUS NOISE

6.1 All equipment utilized by the Contractor that produces noise levels in excess of 84 dBA ("A" weighted decibels) must be identified as a hazardous noise source by the Contractor. This equipment will be utilized in a manner that precludes exposure of non-contractor personnel to levels exceeding 84 dBA.

7. [RESERVED (RADIOACTIVE MATERIALS MGMT)]

8. POL SPILLS, FUEL SPILLS, PROPANE SPILLS, ASPHALT CEMENT SPILLS, etc.

8.1 The Contractor shall immediately report any spill to the Fire Protection Flight at 911, and the Contracting Officer. The Contractor shall take steps to confine, contain, report and clean up any leak or spills that they cause. The contractor shall comply with EPA and ADEC procedures. The contractor shall ensure that items found currently leaking are drained, externally cleaned and contained prior to moving so that transporting them allows no further spillage. Contractor shall bear all costs associated with spills occurring during the project.

8.2 Contractor shall provide a Fuel Spill Prevention and Clean-Up Plan to the Contracting Officer for approval. Contractor shall have spill kits and fuel absorption materials immediately available for fuel spills. The Fuel Spill clean Up Plan shall include the following, at a minimum:

1. Description of Contractor’s proposed methods of spill prevention.

2. Description of Contractor’s proposed methods for spill response.

3. Descriptions of Contractor’s qualifications to perform emergency spill response.

4. Listing of proposed equipment, materials, and supplies to be maintained on site for spill response.

5. Any other information required under Section 01121.

8.3 If free phase fuel is encountered during excavation the Contractor shall recover the fuel and report event as outlined in section 8.2.

8.4 The Contractor shall immediately stop excavation and report any previous spills by others, or any containers of unknown content left by others that are discovered during excavation, to the Fire Protection Flight at 911 and to the Contracting Officer.

Discontinue work in the immediate area (100-foot radius) until approved by the Contracting Officer. Rope off the contaminated area. Costs associated with existing contamination discovered during construction will be borne by the Base.

8.5. Contractor shall comply with the most recent ADEC regulations and guidance pertaining to spill response and cleanup of contaminated sites.

9. STORM WATER DISCHARGES

9.1 GENERAL

The contractor shall obtain all permits required by the applicable State and Federal regulations regarding protection of water resources.

9.2 APDES

Work shall comply with ADEC Alaska Pollutant Discharge Elimination System (APDES), General Permit for construction activities.

9.2.1 Storm Water Pollution Prevention Plan

The contractor shall provide the JBER Environmental Office (673 CEIEC), via the Contracting Office, with a Draft copy of their Storm Water Pollutant Prevention Plan (SWPPP) 7-days before they submit them to ADEC for approval by the Environmental Quality Department. This SWPPP shall be written to comply with the requirements as identified within the 201 Alaska Construction General Permit.

9.2.2 Notice of Intent

The contractor shall provide the Contracting Officer with an ADEC approved Construction General Permit Notice of Intent (NOI) form.

9.2.3 Notice of Termination

Upon final stabilization and completion of the project work, the Contractor shall provide the Contracting Officer with a copy of the Notice of Termination of Coverage.

10. CONTROL AND MANAGEMENT OF ASBESTOS-CONTAINING MATERIAL (ACM)

Manage and dispose of asbestos- containing waste in accordance with 40 CFR 61. Manifest asbestos-containing waste and provide the manifest to the Contracting Officer. Notifications to the Alaska and Installation Air Program Manager are required before starting any asbestos work. Asbestos-containing materials shall not be brought on or used in any project at JBER. If asbestos abatement work is being completed at JBER, the contractor must prepare/submit an NOI to the EPA regardless of quantity. In addition, an asbestos abatement plan must be prepared that includes, but is not limited to, a description of the work, methods of containment and airborne fiber mitigation, management of waste, disposal, air testing and copies of certifications for workers. Contractor shall submit copies of notifications to USEPA required under 40 CFR 61.145(a)(1), 61.145(a)(3), and 61.145(b) to the Contracting Officer (CO), Asbestos Program Officer (APO), and the Asbestos Operating Officer (AOO). In addition, contractor shall coordinate with 673 CES/CEC and CES/CEOI on ongoing projects to ensure all asbestos abatement is captured.

10.1 All asbestos waste manifests shall be signed by CEO/CEOI prior to removal of such

01120-10 waste from the base. A copy of the completed manifest (signed by the receiving landfill) shall be submitted to CEO/CEOI. The Contractor shall follow the current JBER Asbestos Management and Operations Plan which states:

– Contractor is responsible for identifying asbestos containing material (ACM) prior to conducting maintenance, abatement, renovation, or demolition activities.

– Responsible for contacting CES/CEOI shop to ascertain presence or absence of ACM.

– Responsible for making proper notification and providing copies to CES/CEIE and

CES/CEOI.

11. CONTROL AND MANAGEMENT OF LEAD-BASED PAINT (LBP)

Manage and dispose of lead-contaminated waste in accordance with 40 CFR 745. Manifest any lead-contaminated waste and provide the manifest to the Contracting Officer. No paint with a lead content of 0.06 percent or greater shall be used in any capacity on JBER, unless specifically approved in advance by the Bioenvironmental, 673 MDSS/SGB, 384-3985; and Environmental Compliance, 673 CES/CEIEC, 384-7854.
