COMBINED SYNOPSIS/SOLICIATION:

Sodium Acetate Runway in Grannular Form

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

(ii) Solicitation FA5000-17-T-0049 is issued as a Request for Quotation (RFQ).

(iii) A statement that the solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-94, effective 19 Jan 2017. The DFARS provisions and clauses are those in effect to DPN 20161222, effective 22 Dec 2016. The AFFARS provisions and clauses are those in effect to AFAC 2017-0127, effective 27 Jun 2017.

(iv) This requirement is solicited under Full and Open. The North American Industrial Classification System (NAICS) code associated with this procurement is 325199, which has a small business size standard of 1,250 employees.

(v) The Pricing Schedule is incorporated as Attachment 1. Vendors shall complete Attachment 1 in its entirety and return with any other documentation/data as required by this Combo.

(vi) The government intends to award a firm-fixed price Purchase Order contract for the following:

(vii) Delivery shall be FOB Destination. Vendor shall include delivery schedule information on the Pricing Schedule, Attachment 1. All items shall be delivered to:

Bldg 9361, Joint Base Elmendorf-Richardson, Anchorage Alaska, 99506

(viii) FAR 52.212-1 Instructions to Offerors -- Commercial Items (Jan 2017) is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following have been tailored to this procurement and are hereby added via addendum:

(a) To assure timely and equitable evaluation of the quotes, the Offerors must follow the instructions contained herein. The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

(b) Specific Instructions: The response shall consist of two (2) separate parts:

(1) Technical Acceptability - Submit one (1) copy of technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation listed in Attachment 1.

(2) Price – Submit one (1) copy of price schedule listed in Attachment 1.

(ix) FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014) this provision has been tailored to this procurement and is provided in full-text below:

1. The Government will award a contract resulting from this solicitation to the responsible Offeror whose quote conforming to the solicitation is the lowest price technically acceptable. The following factors shall be used to evaluate quotes:

(1) Technical capability. For an offer to be considered technically acceptable it must provide Cryotech brand NaAc Sodium Acetate that is certified to meet or exceed

SAE AMS 1431 standards as specified in attachment 1.

(2) Price. Price analysis will be conducted using the pricing schedule (see attachment 1) to evaluate the reasonableness of the offer.

2. The lowest priced quote will be evaluated for technical acceptability. If the quote is found technically acceptable, award will be made without further consideration. If it is found technically unacceptable, the Government will evaluate the next lowest quote for technical acceptability until award can be made to the lowest priced technically acceptable Offeror. Quotes that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be considered non-responsive and excluded from consideration. This does not limit the Government’s rights as stated in provision 52.212-1(g).

(x) Each offeror shall ensure the provision at FAR 52.212-3 including its Alternate I, Offeror Representations and Certifications--Commercial Items (April 2016), are updated at www.sam.gov. Failure to obtain SAM registration may result in submissions not being considered for award.

(xi) The clause at FAR 52.212-4, Contract Terms and Conditions – Commercial Items (Jan 2017), is hereby incorporated by reference, with the same force and effect as if it were given in full text.

(xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders – Commercial Items (Jan 2017), is hereby incorporated by reference, with the same force and effect as if it were given in full text. 2.203-7994 Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements—Representation.

Include the following provision in all solicitations, including solicitations for the acquisition of commercial items under FAR part 12, that will use funds made available by the Continuing Appropriations Act, 2017 (Pub. L. 114-223) or any other Act that extends to fiscal year 2017 funds the same prohibitions as contained in section 743, division E, title VII, of the Consolidated Appropriations Act, 2016 (Pub. L. 114-113). Section 103 of the Continuing Appropriations Act, 2017 subjects the funding by that Act for FY 2017 to the same conditions set forth in section 743:

PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS—REPRESENTATION (DEVIATION 2017-O0001)(NOV 2016)

(a) In accordance with Continuing Appropriations Act, 2017 (Pub. L. 114-223), or any other Act that extends to fiscal year 2017 funds the same prohibitions as contained in section 743, division E, title VII, of the Consolidated Appropriations Act, 2016 (Pub. L. 114-113), none of the funds appropriated (or otherwise made available) by this or any other Act may be used for a contract with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(d)(1) Use of funds appropriated (or otherwise made available) by the Continuing Appropriations Act, 2017 (Pub. L. 114-223), or any other Act that extends to fiscal year 2017 funds the same prohibitions as contained in section 743, division E, title VII, of the Consolidated Appropriations Act, 2016 (Pub. L. 114-113) may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.

(2) The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.
