Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

673d Contracting Squadron 10480 Sijan Avenue

JBER, AK 99506

II. Nature and/or description of the action being processed.

This is an Individual J&A for the purpose of purchasing brand name Cryotech Sodium Acetate Solid Deicer (NaAc) for the Joint Base Elmendorf-Richardson (JBER) runways and taxiways through a one-time Purchase Order as a Firm Fixed Price contract.

III. Description of supplies/services required to meet agency needs.

773 CES requires 76 metric tons of Cryotech brand sodium acetate (NaAc) solid deicer for the runways and taxiways at JBER, AK. 773 CES is charged with keeping the runways and taxiways clear of snow and ice throughout the winter. They are required to use deicing products that are approved for use on Air Force aircraft. Per AFI 32-1002, sodium acetate is approved for use for deicing of runways and taxiways. It conforms to the requirements mandated for safe use during winter conditions.

Required Sodium Acetate specifications are below:

• Able to melt ice at temperatures as low as -12.2ºC (10ºF)

• Must be approved for use by the F-22 Primary Aircraft Authorization (See Section C of the Market Research)

• Must be certified to meet the requirements set by SAE AMS 1431

• pH range: 8-10.5 in a 15% solution

• Size: Super Sacks 1,000kg (1 metric ton)

The Brand Name items of this acquisition are valued at: $185,668.00

IV. Statutory authority permitting Other than Full and Open Competition.

10 U.S.C. §2304(c)(1) states "Only one responsible source and no other supplies or services will satisfy agency requirements." This authority is referenced in 41 USC 1901, which is implemented by FAR 6.302-1(a)(1).

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Airframe Approval:

AFI 32-1002 para 2.4.5. states, “Before using any airfield anti-icing/deicing products, the installation will obtain approval for their primary aircraft authorization (PAA) from the appropriate PM(s), coordinated through AFCEC/ COO.” Therefore, any deicers must be approved for use on aircraft by the PAA. Dan Steffens, the PAA for the F-22 aircraft, and Mr. Matt Behm, Materials Engineer Staff of Lockheed Martin F-22 Materials and Processes Engineering (M&PE) department, compiled a list of approved F-22 deicing fluids. The only AMS 1431 Sodium Acetate deicer approved for use on the F-22 is Cryotech NaAc Sodium Acetate.

On 22 Feb, 2017, Dan Steffens, the F-22 LO Maintainability Subject Matter Expert at AFLCMC, was contacted and asked for a list of approved deicers for the F-22 Aircraft. He is also the PAA for the F-22 aircraft. He confirmed the following information that he had provided in the previous acquisition: "Mr. Ryan Osysko, of AFRL/RX F-22 Co- Locate, and Mr. Matt Behm, Materials Engineer Staff of Lockheed Martin F-22 Materials and Processes Engineering (M&PE) department, were discussing the products located in the current material specifications as well as additional materials that have been tested and approved for F-22 use. Mr. Behm provided the below list of tested and approved deicers for the F-22:" See Attachment 1 of the Market Research for the list of approved deicers from Mr. Behm.

JBER uses and maintains the F-22 aircraft. Since the PAA has only approved Cryotech NaAc Sodium Acetate for use on the F-22, Cryotech NaAc is the only Sodium Acetate deicer that will fulfill JBER's need.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

FAR 6.302-2(c)(2) requires that agencies shall request offers from as many potential sources as is practicable under the circumstances. The requirement will posted as a combined synopsis/solicitation on FBO.gov for the most time practicable in order to generate more competition. FBO.gov will be used in order to maximize potential competition. Any Cryotech NaAc distributor who accesses FBO.gov will be able to quote on the solicitation. Since Cryotech has multiple distributors, it may be possible to receive multiple quotes on FBO.gov. Cryotech NaAc is the only AMS 1431 sodium acetate runway deicer tested and approved for use on the F-22 airframe. The use of any other sodium acetate product requires testing and approval. This indicates this requirement should remain a brand name only requirement.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated cost to the Government will be fair and reasonable in accordance with FAR 13.106-3(a)(1) - Competitive quotations.

In the event that competition is insufficient to determine a price's fairness and reasonableness, the following have been identified as potential methods to aid in the process:

• FAR 13.106-3(2)(i) - Market Research

• FAR 13.106-3(2)(ii) - Comparison of the proposed price with prices found reasonable on previous purchases

• FAR 13.106-3(2)(iv) - A comparison with similar items in a related industry

• FAR 13.106-3(2)(vii) - Any other reasonable basis

DLA also supplies this item; however, it would not be reasonable to use them as a supplier here in Anchorage, Alaska (see Market Research). Pricing data was collected from DLA for supplying this product to JBER. This information could also be used to help determine the fair and reasonableness of a quote price.

This product has been purchased consistently over the last 20 years. Historical data along with supply schedules will allow for adequate price fair and reasonable determination.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Joshua Jordan of the 673d Contracting Squadron completed market research by searching the commercial market for commercial standards, practices and procedures. Internet searches for relevant items, as well as a search of all mandatory and optional supply sources were conducted as well. The government contacted multiple businesses regarding their capability to supply the required engines and to inquire about their interest in this acquisition. The market research also considered information that was collected by the customer and previous acquisitions made by JBER.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

According to the 3 MXS Operations Officer, Mr. David Johnson, and the previous 3 MXS OO, Mr. Anthony McKee, Cryotech brand NaAc Sodium acetate is the only known solid deicer approved by the F-22 Integration Office and Lockheed Martin for use with the F-22 airframe. Mr. Johnson highly recommended the continued use of this product, as using any other deicer product could significantly degrade F-22 coatings and cause maintenance or operational issues with the aircraft.

David Nielson of AFMC was contacted in regards to approved sodium acetate deicers for the F-22 to confirm the information he had provided the year before, which is as follows: Potassium acetate is the liquid deicer used for runway and taxiway deicing. It is used congruently with sodium acetate to clear runways and taxiways of ice. David Nielson works with the F-22 Airframe manager and is knowledgeable on the approved deicers for the F-22. He stated that regardless of manufacturer, only SAE AMS 1431 certified sodium acetates were approved for use on the F-22, but was not aware of any airframe specific requirements in addition to SAE AMS 1431.

X. List of sources, if any, that expressed interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
