This is a solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

This solicitation is issued as a Request For Quotes. A Firm Fixed Price type contract will be awarded.
The solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95, effective 19 Jan 2017.
This solicitation is being issued as a Service-Disabled Veteran-Owned Small Business set aside.

CLIN 0001 Base Year– Provide all management, tools, equipment, and labor necessary to ensure that water sampling services are performed at Creech and NTTR, in a manner that will maintain a satisfactory facility condition and present a clean, neat and professional appearance. The contractor shall accomplish water sampling tasks and be required to provide result that identified in Appendices B in order to meet the requirements of this PWS and the Service Summary (SS). Maximum Sampling frequencies and Travel are established in Appendix C of the Performance Work Statement. All work performed by the contractor shall be performed in accordance with (IAW) Public Law 93-523, 88 Stat. 1660 (1974), As Amended, Safe Drinking Water Act, Public Law 95-217 and all applicable laws, regulations, American Water Works Association (AWWA) guidelines, Nevada Administrative Code (NAC 445A), AFI 48-144, AFI 32-1066, Drinking Water Surveillance Technical Guide (WSTG), high AF standards, instructions, and commercial practices.

i. Vendors must note that separate Contract Line Item Numbers (CLINs), are not prescribed for purpose of associated costs entailing taxes, fees, etc.
Accordingly, quoted unit pricing for requirements at the CLIN level under this solicitation, shall be all inclusive of all associated costs (i.e. all material, transportation, labor, delivery, etc.)
b) Discount for prompt payment – if any

4. Quotes must be valid for a period of no less than 60 days
5. IAW FAR 52.204-7 and DFARS 252.204-7004 Alt A, prospective vendors must be registered in the SAM database prior to contract award. Prospective vendors should visit the SAM website at https://www.sam.gov/portal/public/SAM/ to register.
FAR 52.212-2 – Evaluation – Commercial Items:
FAR 52.212-2 ADDENDUM:
EVALUATION
(a) Basis of Award: First, the Government will rank the quotations from lowest price to highest price, in order to establish the Total Evaluated Price (TEP). The TEP will be calculated as the sum of the contractor’s prices submitted for the base period and all option periods including the 6-month Option to Extend Services (FAR 52.217-8). The Government will determine the 6-month option pricing by taking half the cost of the 4th option period and adding it to the total proposed price which will result in the Total Evaluated Price. Next, the Government will evaluate the technical volumes on an acceptable or unacceptable basis, starting with the quotation with the lowest TEP. Any sub-factor evaluated as “Unacceptable” will render the entire quotation unacceptable and, therefore not awardable. If the quotation with the lowest TEP is determined technically acceptable, the Government will evaluate the contractor’s price, to include all options, for price completeness and reasonableness, as described above.
If the lowest priced quotation is technically acceptable and the TEP is complete and reasonable, this contractor’s quotation represents the best value to the Government and award will be made to that contractor. If the lowest priced quotation is not technically acceptable, the Government will consider the correction potential and may enter into interchanges with that contractor. If after interchanges with that contractor, their quotation is technically acceptable and remains the lowest priced (with the TEP complete and reasonable), the award would be made to that contractor. If the Government deems the quotation not https://www.sam.gov/portal/public/SAM/ easily correctable, or if at any time it becomes other than the lowest priced quotation, the next lowest priced quotation will be evaluated for technical acceptability, followed by an analysis of their TEP to verify reasonableness and completeness. Interchanges will take place as necessary or deemed appropriate by the Government. The evaluation process will continue until reaching a technically acceptable quotation with a TEP that is reasonable and complete, or until all quotations are evaluated. The Government intends to make award based on the initial quotation submissions without conducting interchanges. Therefore, each offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to hold interchanges if, during the evaluation, it is determined to be in the best interest of the Government. Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the contractors that may address any aspect of the quotation and may or may not be documented in real time. However, the Government reserves the right to conduct interchanges using Interchange Notices (IN). Offeror responses to INs will be considered in making the order selection decision. Interchanges may be conducted with one, some or all offerors as the Government is not required to conduct interchanges with any or all contractors responding to this solicitation. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer is the lowest price, technically acceptable. This is an “all or none” requirement and will be awarded on one contract. Multiple contracts will not be issued. Vendors who do not quote the entire package requested will be considered non-responsive and their quotes will not be evaluated. The following factors shall be used to evaluate quotations:
1. Technical Capability: The offeror’s technical approach describes, in detail, the offeror’s technical approach and overall ability to perform and understand the mission, challenges, scope of work, and purpose of the requirement from a technical standpoint;
The offeror’s technical approach reflects an understanding of the Performance Work Statement (PWS) and describe a technical approach that demonstrates how the offeror will achieve timely and acceptable performance of tasks and how the offeror will ensure standards and deadlines will be met.
The offeror’s technical approach reflects an understanding of each of the key task areas and offer a specific approach for accomplishing each of the sub tasks in a way that reflects timely, cost effective, and quality deliverables;
The offeror’s technical approach includes training certificates or proof of experience to meet the training requirement.
The following ratings will be utilized:

Rating Description
Acceptable Quotation demonstrates a clear understanding of the requirement and meets the minimum requirements listed for all Technical Capability Factors.
Unacceptable Quotation does not demonstrate a clear understanding of the requirement and/or does not meet the minimum requirements of the Technical Capability Factors.
2. Price Quotation: Price quotations should support the proposed technical approach and will be evaluated for Total Evaluated Price (TEP), completeness, reasonableness and unbalanced pricing.
Offerors whose price is determined to be incomplete or unreasonable will not be considered for award.
A) The TEP will be calculated as the sum of the contractor’s quoted prices for the base period and all option periods plus the 6-month Option to Extend Services. For evaluation purposes only the Government will determine the 6-month option pricing by taking half the cost of the 4th option period and adding it to the total proposed price which will result in the Total Evaluated Price.
Evaluation of options shall not obligate the Government to exercise such options.
B) Completeness. The quotation will be reviewed to determine the extent to which all the price elements have been addressed. The contractor’s proposed price and other information entered into Attachment 4, Bid Schedule will be evaluated to ensure continuity and traceability of prices to the technical volume and between the initial quotation and any revisions thereto. The review will determine the adequacy of the contractor’s quotation in addressing and fulfilling the solicitation requirements.
C) Reasonableness. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices fair and reasonable through the use of one or more of the price analysis techniques at FAR 15.404-1(b)(2).
D) Unbalanced pricing. Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one (1) or more contract line items is significantly over or understated. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items or sub-line items. An offer that is determined to be unbalanced may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
In accordance with FAR 13.004 -- Legal Effect of Quotations the following information is provided in regards to quotations.
A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.
When appropriate, the contracting officer may ask the supplier to indicate acceptance of an order by notification to the Government, preferably in writing. In other circumstances, the supplier may indicate acceptance by furnishing the supplies or services ordered or by proceeding with the work to the point where substantial performance has occurred.
If the Government issues an order resulting from a quotation, the Government may (by written notice to the supplier, at any time before acceptance occurs) withdraw, amend, or cancel its offer.
FAR 52.212-3 – Offeror Representations and Certifications – Commercial Items: An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (m) of this provision and must submit these paragraphs with their quotes.
FAR 52.212-4 – Terms and Condition – Commercial Items: Applies to this acquisition.
FAR 52.212-5 – Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items (July 2014): Applies to this acquisition. The following FAR clauses cited are applicable to this acquisition: FAR 52.219-28, 52.222-3, 52.222-19, 52.222-21, 52.222-37, 52.225-13, and 52.232-33.
52.217-8 -- Option to Extend Services.
As prescribed in 17.208(f), insert a clause substantially the same as the following:
Option to Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
(End of Clause) 52.217-9 -- Option to Extend the Term of the Contract.
As prescribed in 17.208(g), insert a clause substantially the same as the following:
Option to Extend the Term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.

FAR 52.219-1 -- Small Business Program Representations.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the http://www.acquisition.gov/ http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/17.htm#P185_30617 http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/17.htm#P185_30617
United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.
“Service-disabled veteran-owned small business concern”--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and the size standard in paragraph (b) of this provision.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States, and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13 CFR 124.106) by individuals who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Veteran-owned small business concern” means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C.
101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned small business concern” means a small business concern--
(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

FAR 52-232-18 – Availability of Funds: Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause.
(b) The use in this solicitation or contract of any DFARS (48 CFR Chp 2) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the name of the regulation.
252.232-7006 Wide Area WorkFlow Payment Instructions.
As prescribed in 232.7004(b), use the following clause:
WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)
(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(4) Payment request and supporting documentation. The Contractor shall ensure a payment request includes appropriate contract line item and subline item descriptions of the work performed or supplies delivered, unit price/cost per unit, fee (if applicable), and all relevant back-up documentation, as defined in DFARS Appendix F, (e.g. timesheets) in support of each payment request.
(5) WAWF email notifications. The Contractor shall enter the e-mail address identified below in the “Send Additional Email Notifications” field of WAWF once a document is submitted in the system.

AFFARS 5352.201-9101 – Ombudsman
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of quotations, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM or AFISRA ombudsmen, [Insert names, addresses, telephone numbers, facsimile numbers, and e-mail addresses]. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU or ARISRA level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067.
(d) The ombudsman has no authority to render a decision that binds the agency.
