CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Award will be made on the basis of the total lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Technical and Past Performance when combined are equal to price. The following factors shall be used to evaluate offers in accordance with FAR 15.101-2 Lowest Price Technically Acceptable (LPTA). The following factors shall be used to evaluate offers:
i.) Price ii.) Technical Capability iii.) Past Performance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The Government will make the determination that an offer is unacceptable if the prices are significantly unbalanced based upon the procedures in FAR 15.404-1(g). Evaluation of options shall not obligate the Government to exercise the option(s). FAR 52.217-8, Option to Extend Services, shall be evaluated by adding six (6) months of service utilizing the pricing indicated by the final option year. The final option year shall be Option Year One (1).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM TO FAR 52.212-2 EVALUATION—COMMERCIAL ITEMS (Oct 2014)
Only the solicitation package of responsive Offerors shall be evaluated. Award will be made using a Lowest Price Technically Acceptable (LPTA) approach; the Government will award to the lowest priced offeror that is determined technically acceptable. The following factors shall be used to evaluate offers:
(1) Factor 1: Price. Price will be evaluated in order to determine if it is reasonable in accordance with FAR Parts 13.106-3. Offers should be sufficiently detailed to demonstrate their reasonableness.
(2) Factor 2: Technical Capability. Technical Capability is determined based on the documentation identified in Addendum to FAR 52.212-1, section (5)(b) as provided by the Offeror. Technical capability will be based on an evaluation of the Technical Capability Factor (see Addendum to FAR 52.212-1, section (6)(b)). The factor will be rated as Acceptable or Unacceptable. Acceptable is defined as the quote clearly meets the minimum requirements of the solicitation. Unacceptable is defined as the quote does not clearly meet the minimum requirements of the solicitation.
(3) Factor 3: Past Performance. Only references for relevant (packing and crating) and recent (5 Years) type contracts are desired. Submit original and two (2) copies. Limited to no more than 20 pages.
TABLE 2 – PAST PERFORMANCE RELEVANCY Definitions Rating Definition
RELEVANT
Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
NOT RELEVANT Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
1) Performance Surveys: The Government will evaluate the quality and extent of offeror's performance with the same or similar size and scope to the requirements of this RFP.
Provide a list of no more than five (5) contracts performed for Federal agencies and commercial customers within the last five (5) years. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problem such as cost overruns, extended performance periods, etc. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. From the list of contracts provided, questionnaires will be utilized by the government to evaluate past performance. These questionnaires are included as attachment 15 in the solicitation and will be filled out by the offeror and should contain, at a minimum the information requested in paragraph 2 of this section. The Government will use information submitted by the offeror and other sources such as other federal Government offices and commercial sources, to assess performance.
2) Furnish the following information for contract listed:
- Company/Division name
- Product/Service
- Contracting Agency/Customer
- Contract Number
- Email Address
- Contract Dollar Value Period of Performance
- Verified, up-to-date name, address, FAX & telephone number of the Contracting officer, if applicable.
- Comments regarding compliance with contract terms and conditions
- Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.
If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any past performance information on previous teaming arrangements with same partner within the past five years. If this is a first time joint effort, each party to the arrangement must provide a list of past and present contracts.
3) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor‘s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
4) Ratings. The Past Performance factor will receive one of the ratings described below.
TABLE 1- PAST PERFORMANCE EVALUATION RATINGS
Rating Description Acceptable Based on the offeror’s performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).
Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JAN 2017)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
(a) Definitions. As used in this provision --
“Administrative merits determination” means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
