The Government has awarded a blanket purchase agreement to O'Connor Funeral home (O'Connor). O'Connor is the only contractor currently in Great Fall, MT capable and authorized to provide mortuary services in accordance with (IAW) the Air Force Mortuary Affairs Program (AFI 34-501). IAW AFI 34-501, mortuary Service contracts shall only be awarded to contractors with fully qualified personnel, licensed facilities, authorized transportation, and professional funeral directors to perform mortuary services. A search was conducted 14 January 2020 and indicated two mortuary service companies other than the suggested source capable of meeting the requirements; one of which is owned by O'Connor. The second company does not currently meet the requirements within AFI 34-501. In addition, the vendor is not actively registered System Award Management.

Other supporting facts: FAR 13.303-2(b)(2) Consider suppliers whose past performance has shown them to be dependable, who offer quality supplies or services at consistently lower prices, and who have provided numerous purchases at or below the simplified acquisition threshold. O'Connor has been the previous BPA holder and has proven themselves to be dependable and have provided exceptional services at fair and reasonable prices. Furthermore, a Notice of Intent to Sole Source was published through the Government Point of Entry instructing capable vendors to provide capability statements. The Notice further stated the Government will use that data to potentially award additional blanket purchase agreements. No response has been received to-date.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

The Contracting Squadron requested the identified vendor to register in System Award Management, provide clearances/certifications, and make contact with the Mortuary Affairs Office to cure the deficiencies of their facility within AFI 34-501 in order to be considered for a blanket purchase agreement. These instructions hold true for all potential vendors. Until such time, all mortuary requirements will be obtained through O'Connor Funeral home.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
