DETERMINATION AND FINDINGS
BRAND NAME DETERMINATION
341st CONTRACTING SQUADRON
MALMSTROM AFB MT
1. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED
A Purchase Request for pre-painted galvanized steel coils was received on 08 December 2015 from the 819th Red Horse Squadron. The grade of the steel coils must be ASTM A653, SS, grade 50, and G-90 cream tan with external lubricant. The dimensions of the steel are .043 coil stock, 24” wide. The coil must have an average weight of 4600 lbs per coil. The total weight must equal 36,000.00.
2. JUSTIFICATION FOR SOLICITING FOR A BRAND NAME
Due to system compatibility, the pre-painted galvanized steel manufactured by Drexel Metal is the only technically acceptable steel for the MIC Industries Ultimate Building Machine (UMB). According to our technical expert, Capt Jacob Bright, Drexel Metal and MIC Industries, a supplier of Drexel Metal, are the only two technically acceptable providers. Other manufactured steel has not been tested on the UBM and will cause damage to the $850K machine. Furthermore, the UBM only recommends use of Drexel steel and use of any other steel will void extended warranties on manufacturer parts.
3. EFFORTS TO OBTAIN COMPETITION
This requirement will be posted on FedBizOpps, the Government point of entry. A combine synopsis solicitation will be issued IAW 12.603 to additional open market vendors accompanied by this Determination and Finding to obtain adequate competition.
4. STEPS TO PRECLUDE FUTURE BRAND NAME AWARDS
Unless the 819th Red Horse Squadron stops using the Ultimate Building Machine, there are no other steps to preclude future brand name awards.
5. CONTRACTING OFFICER’S DETERMINATION
I have determined, IAW FAR 13.106-1(b)(1), that the circumstances of this contract action deem only one brand of steel, Drexel, is acceptable for the MIC Ultimate Building Machine.
