SUMMARY OF CHANGES
SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
PROPOSAL PREP INSTRUCTIONS
Section L - Instructions, Conditions and Notices to Bidders
L-1 GENERAL INSTRUCTIONS
1.0 This section provides general guidance for preparing proposals, as wells as specific instructions on the format and content of the proposal. Throughout this section, the term “offeror” means the prime contractor submitting the proposal. The offeror’s proposal must include all data and information requested by this Section L and must be submitted in accordance with (IAW) these instructions. Any offeror who submits an incomplete package may be considered non-responsive. The offer shall be compliant with the requirements as stated in the Request for Proposal (RFP). A proposal that is sufficiently documented to support cost/price and technical requirements in a complete, orderly and detailed manner will enable the Government to perform a thorough and fair evaluation. Non-compliance with the instructions and RFP may result in an unfavorable proposal evaluation and may be grounds to eliminate the proposal from consideration for contract award. Offerors are cautioned that the Government does not assume the duty to search for data to cure inconsistencies or discrepancies identified in the offeror’s proposal.
2.0. Type of Acquisition. This acquisition is a geographically competitive 8(a) set-aside award limited to 8(a) Program Participants with an SBA bona-fide place of business in the State of California. For this acquisition, selection of the best value offeror will be made using lowest priced technically acceptable (LPTA) procedures. This solicitation will result in a single award Firm-Fixed-Price (FFP), Indefinite-Delivery/Indefinite-Quantity (IDIQ) contracts. Proposals may only be submitted by Small Business Certified 8(a) Small Business firms listed under the 238320 North American Industry Classification System Code (NAICS).
3.0. Discrepancies and Ambiguities. If an offeror believes the requirements in these instructions contain an error, omission, ambiguity, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer (CO) in writing with supporting rationale No Later Than (NLT) seven (7) calendar days after the RFP release date. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussions.
4.0. Mistakes. Mistakes in an offeror’s proposal shall be handled IAW FAR 14.407-4 as referenced in FAR 15.508.
5.0. Exchanges With Offerors After Receipt of Proposals.
5.1. Award without discussions. IAW FAR 15.306(a), offerors may be given the opportunity to clarify certain aspects of the proposal or resolve minor or clerical errors. Clarifications shall be documented on, and conducted via transmittal of, Evaluation Notices (EN) to the applicable offeror. Each EN shall clearly indicate that the type of exchange being conducted is “Clarification”.
5.2. Communications with offerors before establishment of the Competitive Range. After the decision to conduct discussions has been made and prior to establishment of the Competitive Range, the CO may enter into limited “Communications” with offerors only as described in FAR 15.306(b). Communications shall be documented on, and conducted via transmittal of, ENs to the applicable offeror. Each EN shall clearly indicated that the type of exchange being conducted is “Communications”.
5.3. Competitive Range. If discussions are to be conducted, the CO shall establish the Competitive Range comprised of all the most highly rated proposals based on the ratings of each proposal against all evaluation criteria, unless the range is further reduced for purposes of efficiency. IAW FAR 15.306(c), the CO may limit the number of proposals in the Competitive Range to the greatest number that will permit an efficient competition among the most highly rated proposals. IAW FAR 15.503(a)(1), the CO shall provide written notification to unsuccessful offerors of exclusion from the Competitive Range and/or elimination from the competition.
5.4. Exchanges with offerors after establishment of the Competitive Range. Discussions, negotiations in a competitive acquisition, are tailored to each offeror’s proposal and will be conducted by the CO with every offeror within the Competitive Range. At a minimum, during discussions, the CO shall indicate to, or discuss with, each offeror in the Competitive Range any deficiencies or significant weaknesses that have been identified during the evaluation. Discussions shall be documented on, and conducted via transmittal of, ENs to the applicable offeror.
Each EN shall clearly indicate that the type of exchange being conducted is “Discussions”.
5.5. Discussions. The Government intends to award without discussions. However, the Government reserves the right to conduct discussions if determined necessary. If discussions or requests for revised proposals conducted or requested by the Government, the coefficient prices identified in Schedule B of the Final Proposal Revision (FPR) shall be valid through the proposal acceptance period stated in Block 13. D. of the SF1442, RFP.
6.0. Contract Documents. Sections K, L and M apply only to the solicitation phase of this acquisition. These sections will be removed and will not be included in the resulting contract documents.

SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
EVALUATION FACTORS FOR AWARD
BASIS FOR CONTRACT AWARD
M-1 SOURCE SELECTION
1.0. Basis for Contract Award.
1.1. This acquisition is being conducted as a Lowest Price Technically Acceptable (LPTA) source selection in accordance with (IAW) Federal Acquisition Regulation (FAR) Part 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures Appendix C, and AFFARS Mandatory Procedures (MP)
5315.3. These regulations are available electronically at the Air Force FARSite, http://farsite.hill.af.mil or http://acquisition.gov/far. The Government will select the proposal(s) with the lowest evaluated price from among those rated as “technically acceptable” for all sub-factors of the Technical Factor.
1.2. Contracts may be awarded to the offerors who are determined to be responsible IAW FAR Subpart 9.1, as supplemented, and are determined eligible by the Small Business Administration (SBA) IAW FAR 19.8, whose proposals conform to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and are judged, based on the evaluation factors and sub-factors, to represent the Lowest Price Technically Acceptable (LPTA) proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective;
therefore, professional judgment is implicit throughout the entire process.
2.0. Number of Contracts to be Awarded. The Government intends to award one (1) Firm-Fixed-Price (FFP), Indefinite-Delivery/Indefinite-Quantity (IDIQ) contract for the Base Paint and Corrosion Control Requirement.
http://farsite.hill.af.mil/ http://acquisition.gov/far
3.0. Distribution. Distributed material will be identified as source selection sensitive and distribution will be strictly limited to appropriate personnel, and shall be encrypted where practicable. Should any offeror object to its proprietary information being shared between source selection evaluators and advisors via commercial email as described above, advise the Contracting Officer using the contact information above.
4.0. Discussions. The Government intends to award without discussions. However, the Government reserves the right to conduct discussions if determined necessary. The offeror’s proposal should represents the offeror’s best efforts and most complete responses to this solicitation. If during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the FPR are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.
5.0. Evaluation Process. The evaluation process to be used is as follows:
Step 1. Perform compliance review on all proposals to assess compliance with terms and conditions of the solicitation. Non-compliance with the terms and conditions of the solicitation may result in an unfavorable proposal evaluation and may be grounds to eliminate the proposal from consideration for contract award.
Step 2. Perform price evaluations on all proposals and rank them from lowest to highest;
Step 3. Conduct technical evaluations beginning with the lowest priced offeror. If the lowest priced Offeror is determined to be technically unacceptable, then the next lowest priced Offeror will be evaluated. This process will be repeated until the government has identified the lowest priced technically acceptable offeror. The government reserves the right to open discussions. The offeror determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.
Step 4. Perform a responsibility determination on the lowest priced technically acceptable offeror. In order to be determined as responsible, an offeror must meet the following conditions:
• Offeror must provide a letter from the Small Business Administration (SBA) showing proof of Section 8(a) status evidencing a SBA bona-fide office located within California
• Offeror must meet the standards identified in FAR 9.104-1;
• Offeror must possess an active California General Building Contractor’s License, Type B, or
California Specialty Contractor’s License Type C-33 registered in the prime contractor’s name;
• Offeror must provide evidence that it is able to obtain a minimum single project bonding capacity of
$500K and an aggregate bonding capacity of $1M from an approved surety listed in the Department of the Treasury Circular 570 (http://www.fms.treas.gov/c570/) or other security permitted by FAR Subpart 28.2, unless prohibited by law or regulation;
• Offeror must provide a letter detailing how the offeror intends to perform within its organization to meet the requirements of FAR clause 52.219-14, Limitations on Subcontracting;
• Offeror must provide a letter of authorization permitting the Contracting Officer to verify offeror’s financial responsibility. Include name, address and phone numbers for financial institution including a point of contact.
Offerors who are determined to be non-responsible will be referred to the Small Business Administration (SBA) for a Certificate of Competency (COC). If a COC is denied by the SBA, the Government will resume technical evaluations as detailed in Step 3. Technical evaluations will continue until the Government identifies the Lowest Priced Technically Acceptable (LPTA) responsible offeror.
Following the completion of Steps 3 and 4; the Contracting Officer, with the approval of the Source Selection Authority (SSA), will determine if it is in the Government’s best interest to open discussions. If the determination is made to open discussions, the Government will conduct discussions with all offerors considered technically acceptable. The Government reserves the right to award without discussions. The Government also reserves the right to perform both price and technical evaluations on non-responsive Offerors to determine if it is in the http://www.fms.treas.gov/c570/
Government’s best interest to open discussions. Only those Offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.
M-2: EVALUATION FACTORS AND SUB-FACTORS
1.0. Evaluation of Proposals. The following evaluation factors and sub-factors will be used to evaluate each proposal. The Government will evaluate proposals for technical acceptability, but will not rank the proposals by non-price factors or sub-factors.
Factor I - Price Factor II - Technical Subfactor 1: Corrosion Control Plan Subfactor 2: Organizational Experience Subfactor 3: Demonstration Project
2.0. Evaluation Factors and Standards
2.1. Factor 1 - Price Factor. Offerors whose price is determined to be unreasonable or unbalanced will not be considered for award. The offeror’s price proposal will be evaluated by reviewing the proposed pricing from completed the SF1442, Section “B” Schedule. A completed price proposal shall consist of completed “Exhibit A” (Attachment 2) sub-line items for the based period and each option period. The sum will be identified in Block 22 of SF1442.
a. Schedule B: Contract Line Item Numbers: Insert offeror’s totals derived from “Exhibit A, Pricing Schedule” for the base year and all option years:
b. “Exhibit A, Pricing Schedule” (Attachment 2): For each sub-line/reference number, enter a unit price; multiply the estimated quantity by the unit price for an estimated total price. The contractor shall sum all corresponding sub-line items and enter the total price in the “Basic Period Est Total” column for the base year and each option year.
The contractor shall transfer each estimated total price from “Exhibit A, Pricing Schedule” to the corresponding CLIN in Section B. Prices shall be firm-fixed price and include labor and materials, overhead and profit.
The Government may determine that an offer is unacceptable if unit prices are significantly unbalanced. Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated by the application of cost or price analysis techniques. The Government will analyze offers to determine whether they are unbalanced with respect to separately priced line items or subline items. Offers that are determined to be unbalanced may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
2.2. Factor 2 - Technical Factor. The Government’s technical evaluation team shall evaluate the technical proposals on an “Acceptable” or “Unacceptable” basis, assigning one of the ratings described below for each sub-factor. Any sub-factor evaluated as “Unacceptable” will render the entire proposal unacceptable and, therefore, not eligible for award. Only those proposals determined to be “technically acceptable”, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussions.
