I. Contracting Activity.

US Air Force 2d Contracting Squadron 801 Kenney Ave, Suite 2301 Barksdale AFB, LA 71110

II. Nature and/or description of the action being processed.

This requirement will be competed under other than full and open competition as a brand-name or equal requirement. This will be a new, firm-fixed-price (FFP) contract, consisting of a base year plus four (4) option years.

III. Description of supplies/services required to meet agency needs.

The services required to be performed by this acquisition include the following that will take place at the Combat Arms Training and Maintenance (CATM) Range located on Barksdale AFB, LA:

Provide preventative maintenance/inspection on a quarterly basis, collecting all projectiles from the bullet trap; collecting lead dust particles from the bullet trap and Dust Collector Unit; providing periodic scheduled maintenance to the system components proprietary to Action Target, Inc.; and performing de-leading of the firing line and range target areas to include walls and floors.

The bullet trap system was manufactured and installed by Action Target on a previous contract and the system is proprietary to Action Target. Market research indicated third-party vendors can purchase Action Target parts, and thus this requirement will be solicited as a brand name requirement.

IV. Statutory authority permitting Other than Full and Open Competition.

10 USC 2304(c)(1), as implemented by FAR 6.302-1(c) (1), required by FAR 6.303-2(b)(4).

This is a brand-name requirement IAW FAR 13.501(a)(1)(i) and falls under the authority of the FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The applicability of FAR 6.302-1(c) meets this requirement due to the unique nature of the supplies and services necessary to maintain and repair the bullet trap system at the CATM Range. Action Target, Inc. is the sole proprietor and manufacturer for the equipment necessary to maintain the system. Third party vendors are capable of purchasing the proprietary equipment and therefore, this brand-name justification will allow for appropriate competition.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

In order to maximize competition, a sources sought was posted on FBO on 10 February 2016. A capabilities statement was received from multiple interested parties which also provided documentation that Action Target has sold their proprietary parts to third party vendors previously. Action Target has also stated that any qualified contractor can perform the required service, and that they have acted as a subcontractor on similar requirements in the past.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated cost to the Government will be determined to be fair and reasonable by utilizing techniques in FAR 15.404-1(b). Techniques to be used include the comparison of proposed prices received in response to the solicitation, proposed cost to the independent government estimate (IGE), and if necessary, to other government contracts awarded for the same or similar requirements.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

See Market Research conducted in Section VI above. Based on these results, the Government has determined that the best course of action is to issue a solicitation utilizing FAR 6.302-1(c), Only one Responsible Source and No Other Supplies or Services Will Satisfy Agency requirements, Application for Brand-name Descriptions.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

See Section VI above.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

There are no cost effective methods to remove or overcome barriers to competition with the purchase of brand name parts for this requirement at this time due to the reasons stated previously in Section V above. This J&A will be posted with the solicitation IAW FAR 6.305(c).
