I. Contracting Activity.
55 Contracting Squadron, Offutt AFB
II. Nature and/or description of the action being processed.
The requested scissor lifts were required to be delivered by 15 September 2016 in order for the Joint Navigational Warfare Center (JNWC) to meet a real world navigational warfare equipment deployment to .
Failure to have secured these requested items by the delivery date would have resulted in the Geographical Commander not being able to achieve the required navigational warfare effect for mission success. The requested scissor lifts were required to satisfy
III. Description of supplies/services required to meet agency needs.
The JNWC required four (4) all-terrain scissor lifts by 15 September 2016 as directed by , to deploy real world navigational warfare equipment to a classified location.
IV. Statutory authority permitting Other than Full and Open Competition.
Citations: 10 U.S.C. 2304(c)(2) or 41 U.S.C. 3304(a)(2), as implemented by FAR 6.302-2, authority for the use of other than full and open competition is required to enable the JNWC to deploy NAVWAR equipment.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
In accordance with FAR 6.302(a)(2), the agency's need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Time permitted that only a source that can provide the required scissor lifts within the required time-frame be awarded the contract. Due to the restrictive time-frame, award was required to be made the same day of notification in order to ensure that the items were delivered by the requested date. These all-terrain scissor lifts are required for a real world deployment to a classified location and failure to have provided them by the required date would have resulted in the Geographical Commander not being able to achieve the required Navigational Warfare effect needed for the mission.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
In effort to find vendors who could supply the scissor lifts within the required time-frame a nationwide search was conducted for prospective vendors. The methods used for these searches are listed below:
a. Contacting vendors found on the Small Business Administration (SBA) website under NAICS code 333923
b. Searching and contacting vendors who provide scissor lifts found on GSA Advantage
c. Contacting vendors found on the JLG industries and Genie Lift distributors websites
d. Conducting Google searches for local vendors, and contacting those that were found
e. Contacting the Kirtland AFB Contracting Office for any recommended sources From these searches nine (9) companies were contacted with only three companies stating they could provide the required items within the time-frame. Of the three companies, one was not able to provide a quote prior to the deadline and one was deemed technically unacceptable by the customer.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
H&E was the only vendor to provide a technically acceptable quote with pricing and can meet the required time frame. H&E quoted a price of per scissor lift. This pricing provided was per item lower than that of pricing found from GSIRON , whose website listed a price of per scissor lift.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted for this requirement by methods listed below:
a. Contacting vendors found on the Small Business Administration (SBA) website under NAICS code 333923
b. Searching and contacting vendors who provide scissor lifts found on GSA Advantage
c. Contacting vendors found on the JLG industries and Genie Lift distributors websites
d. Conducting Google searches for local vendors
e. Contacting the Kirtland AFB Contracting Office for any recommended sources
IX. Any other facts supporting the use of Other Than Full and Open Competition.
N/A
X. List of sources, if any, that expressed interest in the acquisition.
- H&E Equipment Inc. - Wining quote
- A-Hern Rentals - Was unable to provide quote with-in time frame
- FMH Inc. - Offered item was technically unacceptable
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Due to the nature and purpose of this requirement, barriers to competition were unavoidable. JNWC better understands the complexity of acquiring last minute items and will continuously seek to practice early recognition and engagement with contracting to ensure maximum competition.
