1.1 The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants. The Contractor shall be responsible for implementing the terms and requirements of NPDES PERMIT REQUIREMENTS FOR STORM WATER DISCHARGES FROM

CONSTRUCTION SITES.

1.2 IMPLEMENTATION: Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:

1.2.1 Detail his proposal for implementing the requirements for environmental pollution control specified herein.

1.2.2 Meeting: Meet with representatives of the Contracting Officer to review and alter his proposal as needed for compliance with the environmental pollution control program.

2. PRODUCTS: (Not Used)

3. EXECUTION:

3.1 PRECONSTRUCTION SURVEY: Prior to start of any on-site construction activities, the Contractor and the Contracting Officer shall make a joint condition survey after which the Contractor shall prepare a brief report indicating on a layout plan the condition of trees, shrubs and grassed areas immediately adjacent to the site of the work and adjacent to his assigned storage area and access route as applicable. This report will be signed by both the Contracting Officer and Contractor upon mutual agreement as to its accuracy and completeness.

3.2 PROTECTION OF LAND AREAS: Except for work areas, storage areas, or access routes specifically assigned for the use of the Contractor under this contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition. The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.

01430-2

3.3 PROTECTION OF TREES AND SHRUBS: Except for trees or shrubs marked on the plans to be removed, the Contractor shall not deface, injure or destroy trees or shrubs, nor remove or cut them without special authority. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorage.

3.3.1 Tree Protective Structures: Where, in the opinion of the Contracting Officer, trees may possibly be defaced, bruised, injured, or otherwise damaged by the Contractor's equipment or by his other operations, he may direct the Contractor to provide temporary protection of such trees by placing boards, planks, or poles around them.

3.3.2 Restoration of Damaged Trees: Any tree scarred or damaged by the Contractor's equipment or operations shall be restored as nearly as possible to its original condition at the Contractor's expense. All scars made on trees not designated on the plans to be removed by construction operations shall be coated as soon as possible with an approved tree wound dressing. Trees that are to remain, either within or outside established clearing limits, that are damaged by the Contractor so as to be beyond saving in the opinion of the Contracting Officer shall be immediately removed, if so directed, and replaced with a nursery-grown tree of the same species and size.

3.4. PROTECTION OF WATER RESOURCES: The Contractor shall control the disposal of fuels, oils, bitumens, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable Federal, State, County and Municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract.

Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.

3.4.1 Disposal of Water generated during construction dewatering.

3.4.1.1 Dewatering of Groundwater: For temporary dewatering

of groundwater encountered during construction, the Contractor shall land apply all water generated at the locations indicated on drawings in accordance with Paragraph: LAND APPLICATION or surface discharge all generated water in accordance with Paragraph: SURFACE DISCHARGE.

3.4.2 Criteria For Disposal: Prior to dewatering, hydrostatic testing, disinfecting or flushing of lines, the Contractor shall submit a disposal plan detailing the method of disposal for approval. The disposal plan for Land Application shall include a sketch showing the construction site

01430-3 and the proposed location of the disposal of generated water. The disposal plan for Land Application shall also include a description of the equipment that will be used for the removal of water and a description of filtration methods to be implemented as needed. In addition, the date the discharge will begin, then of duration of discharge, and the rate of discharge shall be provided. If the method of disposal is Surface Discharge requiring a state issued permit, the documentation required for the application and issued permit will suffice as the disposal plan. For Sanitary Sewer discharge the disposal plan shall include the rate and location of discharge into the sewer.

3.4.2.1 Land Application: Land Application shall follow

State requirements, however no permit will be necessary. "Land application" implies that the Contractor shall discharge water at a rate that allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, defined drainage areas, or discharge into the "waters of the State" shall occur. The Contractor shall contact the State of North Dakota, Division of Water Quality, Water Quality and Permit Program to discuss the water quality parameters for chemical contaminants (such as chlorine), oil, grease and total suspended solids and shall ensure that all water intended for land application will meet the State requirements.

3.4.2.2 Surface Discharge: Surface discharge shall be in

accordance with North Dakota's National Pollutant Discharge Elimination System (NPDES) General Permit for Construction Dewatering and/or Hydrostatic Testing #NDG-070000. "Surface discharge" implies that the water is discharged with possible sheeting action and subsequent soil erosion may occur. Waters that are surface discharged may terminate in drainage ditches, creeks, or "waters of the State" and require a discharge permit. The State of North Dakota requires a minimum of 30 days to process the permit application. Prior to dewatering, the Contractor shall submit a copy of the completed application form, a copy of the North Dakota NPDES General Permit for Construction Dewatering and /or Hydrostatic Testing #NDG-070000 issued by the State of North Dakota for this contract any subsequent reports and/or information required by the permit or State.

3.5 WASTE DISPOSAL: As part of his proposed implementation under paragraph 1.2, and prior to on-site construction, the Contractor shall submit a description of his scheme for handling and disposing of all waste resulting from the work under this contract. If any waste is dumped in unauthorized areas, the Contractor shall remove the waste and restore the area to the condition of the adjacent undisturbed areas. Where directed, soil which is contaminated by the Contractor shall be excavated, disposed of as approved by the Contracting Officer, and replaced with suitable fill material, all at the expense of the Contractor.

3.6 BURNING: Burning shall be prohibited on the Government premises.

01430-4

3.7 DUST CONTROL: The Contractor shall maintain all excavations, embankments, stockpiles, access roads, plant sites, waste areas, borrow areas, and all other work areas free from excess dust to such reasonable degree as to avoid causing a hazard or nuisance. Temporary methods consisting of sprinkling, chemical treatment, light bituminous treatment or similar methods will be permitted to control dust. Dust control shall be performed as the work proceeds and whenever a dust nuisance or hazard occurs.

3.8 EROSION AND SEDIMENT CONTROL: The Contractor shall be responsible for providing erosion and sediment control measures in accordance with local, state, and federal regulations. The erosion and sediment controls selected and maintained by the Contractor shall be such that local, state, and federal water quality standards are not violated as a result of the Contractor's construction activities. The area of bare soil exposed at any one time by construction operations should be held to a minimum. For areas subject to erosion including, but not limited to, steep slopes, soils spreading areas, and stockpile areas, the Contractor shall disturb as little vegetation as possible, minimize the period of time that the soil is exposed, prevent surface water runoff from flowing across disturbed areas, stabilize disturbed soils as soon as possible, and provide adequate drainage for the increased runoff. Sedimentation/erosion control features may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. Runoff management practices should be employed in areas where the potential for storm water contamination exists that can not be addressed by a prevention or source reduction measure. Runoff management procedures may include vegetative swales, reuse of collected storm water, infiltration devices, and detention/sedimentation basins. Any erosion and sediment control measures which are damaged or found to be ineffective shall be remedied by the Contractor at no additional cost to the Government. Any areas damaged by erosion shall be repaired by the Contractor at no additional cost to the Government.

3.9 CORRECTIVE ACTION: The Contractor shall, upon receipt of a notice in writing of any noncompliance with the foregoing provisions, take immediate corrective action. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of a claim for extension of time or for excess costs of damages by the Contractor unless it was latter determined that the Contractor was in compliance.

3.10 POST-CONSTRUCTION CLEANUP OR OBLITERATION: The Contractor shall, unless otherwise instructed in writing by the Contracting Officer, obliterate all signs of temporary construction facilities such as haul roads, work areas, structures, foundations of temporary structures, stockpiles of excess or waste

01430-5 materials, and other vestiges of construction prior to final acceptance of the work. The disturbed areas shall be graded and filled and the entire area seeded.

The certification shall be submitted within 90 days after the coverage under the permit begins.

A copy of all submissions to the State shall be furnished to the Contracting Officer.

3.14 ENVIRONMENTAL REQUIREMENTS FOR HAZARDOUS MATERIAL AND HAZARDOUS

WASTE: This section specifies requirements/procedures for hazardous material authorization/use, hazardous waste management, spill procedures, and reporting.

3.14 1 Hazardous Materials (HM): This contract may require the Contractor to procure and use hazardous materials. HM is products and chemicals that pose a risk to human health and the environment. HM may be flammable, combustible, toxic or corrosive. HM will be tracked from the time it is brought on base until it has been dispositioned into one of four possible conditions: completely consumed, turned in to a recycler, removed from the base for reuse, or turned in as hazardous waste. Strict adherence to Government regulations concerning the use of HM must be observed. Additional USAF requirements exist for the procurement, storage, usage, and disposal of HM. The Contractor is expected to be familiar with and comply with applicable regulations. The following sections outline USAF requirements for procurement, usage, storage, and disposal, but are not complete with respect to Contractor obligations for worker safety. These environmental requirements are not intended to describe all OSHA requirements.

3.14.1.1 Selection of Materials: Environmentally friendly

materials are preferred when possible. Environmentally friendly chemicals do not contain metals such as lead, chromium, cadmium, barium, arsenic, mercury, selenium, or silver. Environmentally friendly chemicals do not contain flammable solvents such as Methyl Ethyl Ketone, Acetone, Xylene, or Toluene.

Chemicals that contain metals or flammable solvents will generate hazardous waste (HW) when the HM is no longer usable. Brushes, rollers, and other painting applicators that come in contact with hazardous characteristic material will also become hazardous waste when no longer usable. Mineral spirit, turpene, and oil based paints are acceptable; however, the resulting thinners/solvents might be flammable and may result in HW. Therefore, these must be handled and disposed as HW in accordance with federal regulations. In most cases, non-flammable or water-based products are non-hazardous and are the preferred type of product. When selecting a product for a given

01430-7 application, consider performance as a major factor when making a selection, but strike a balance between environmental impact and performance of the product. Environmentally friendly material should not result in poor deliverables.

3.14.1.2 Hazardous Material (HM) Authorization: The

Contractor is required to have and maintain Material Safety Data Sheets (MSDS) on all HM. The Contractor will provide the CONTRACTING OFFICER OR HIS AUTHORIZED REPRESENTATIVE with a copy of the MSDS, an estimate on the quantity of the HM expected to be used during the projected work/service, and anticipated storage location for each HM intended for use before it is brought on base. Civil Engineering Environmental (5 CES/CEV), Wing Safety, and Bio- Environmental Engineering will review the MSDS to authorize the use of that chemical at Minot Air Force Base (MAFB). Materials inconsistent with the philosophy described above will be rejected. The MSDS will be kept in a book and placed on file at HAZMART. It is the Contractor's responsibility to forward any MSDS changes (new version or formula) to the CONTRACTING OFFICER OR HIS AUTHORIZED REPRESENTATIVE so that the copy on file at HAZMART remains current.

3.14.1.3 Hazardous Material Storage: The contract will not

allow any HM storage on Government property.

3.14.1.4 Hazardous Material Usage and Inventory: The

Contractor will track HM usage and inventory amounts. The Contractor will report this information to the CONTRACTING OFFICER OR HIS AUTHORIZED REPRESENTATIVE at a minimum of quarterly. The report will consist of material name (or MSDS book cross-reference), unit of issue (e.g., 16-oz can, 55-gal drum, 50-lb bag), and number of units used in that month. (See attachment at the end of this section.) Reports must be submitted to the CONTRACTING OFFICER OR HIS AUTHORIZED REPRESENTATIVE within 5 days after the end of each period. Reports are reviewed by 5 CES/CEV and maintained at HAZMART.

3.14.1.5 Excess or Unused Hazardous Materials: Any unused

or excess HM that is brought on base by the Contractor will remain the property of the Contractor. The Contractor will remove all excess materials from the work area when the work is complete. The excess/unused HM is a material and is not considered a hazardous waste. Examples of this would be a sealant that has remaining material in the cartridge or paint that remains in the can. The Contractor can reuse this HM at a future project. Should these materials expire at a later date after the work is complete, it will be the responsibility of the Contractor to properly dispose of the expired HM as Hazardous Waste. The Contractor will not dispose of or flush any HM or HW down sinks, toilets, or drains.

01430-8

3.14.1.6 Government Provided Hazardous Material: Any

excess or unused HM provided by the Government shall remain the property of the Government unless some other agreement was made between the Government and the Contractor. Excess Government provided materials must be turned in to the CONTRACTING OFFICER OR HIS AUTHORIZED REPRESENTATIVE or at a designated location (i.e., DRMO).

3.14.2 Hazardous Waste (HW): Hazardous waste is waste that has the characteristic of ignitability, corrosivity, reactivity, and/or toxicity as defined in 40 CFR 261. Consult 40 CFR 261 for complete descriptions of HW.

The Contractor must be knowledgeable of the processes and materials that will generate/create HW. The following list is not a complete list, but provides a brief description of material with common hazardous characteristics that may result in the generation of HW. A renovation project that requires the removal of lead based painted wood trim would be a toxic HW. Combustible or flammable liquid such as waste paint, spent thinner, and spent solvent is ignitable HW. Unusable/spent corrosive liquid such as hydrochloric acid, sodium hydroxide, or battery acid is HW. Unusable/spent chemicals that contain lead, chromium, mercury, arsenic, cadmium, benzene, or methyl ethyl ketone are toxic HW. Brushes, cups, and rollers that come in contact with the above may be HW and must be collected/turned in for proper disposal. In all instances where a hazardous material used in a work process on MAFB generates a HW, disposal of the HW is the responsibility of the contractor.

3.14.2.1 Hazardous Waste Disposal: All HW will be turned

in to the designated waste storage facility (HAZMART) on the day that the waste is generated/created. The Contractor will place all HW in an appropriate container, label the container with its name and the words "HAZARDOUS WASTE", and coordinate turn-in of the waste to HAZMART. It is the Contractor's responsibility to transport the waste to HAZMART. No storage of HW by the Contractor is allowed on MAFB. The Contractor will not dispose of or flush any hazardous waste down sinks, toilets, or drains. Any waste generated off base that is the result of a project for the USAF will be considered Contractor Generated HW and the Contractor must properly dispose of that waste as described below. The USAF will ensure proper disposal of HW generated by the Contractor on MAFB.

3.14.2.2 Contractor Generated Hazardous Waste. Any waste

generated off base that is the result of a USAF project is considered contractor generated HW. The Contractor must dispose of HW only to a permitted hazardous waste hauler/disposal facility. Hazardous Waste disposal guidance is available from the North Dakota State Department of Health at http://www.health.state.nd.us/ndhd/environ/wm/pubs.htm. The North Dakota State Department of Health can provide a list of waste disposal Contractors and haulers.

01430-9

3.14.2.3 Non-Hazardous Wastes: Non-hazardous wastes do not

exhibit the characteristics of HW. Examples are materials with flash point above140 degrees F such as latex paint, water-based sealants, and petroleum-based products. These items are excluded from HW regulations, but still must meet certain conditions before being discarded. No liquids are allowed in the dumpsters. Any products that have free liquids must be solidified prior to disposal. Empty cans with no free liquid (does not drip when turned upside down) may be disposed in the dumpster. Proper disposal of non-hazardous waste is the responsibility of the Contractor. Disposal shall conform to all local, state, USAF, and federal guidelines and regulations. The Contractor shall dispose of all trash, debris, refuse, and garbage daily. Contact the CONTRACTING OFFICER OR HIS AUTHORIZED REPRESENTATIVE with any questions on proper disposal of non-hazardous waste.

3.14.2.4 Empty Containers: Empty containers are normally

exempt from HW regulations. Any HM container not meeting the definition of empty (as defined below) is managed as material. Remove HM that is no longer needed from the base for reuse. HM that is no longer usable due to shelf life or condition is considered Contractor generated HW as described in section

3.14.2.2 above. A HM container is considered empty if all material has been removed that can be removed using the practices commonly employed to remove materials from that type of container (pouring, pumping, aspirating). No more than an inch or 3 percent of the original volume, whichever is less, may remain in the bottom of the container. Removal to this standard is not sufficient to qualify as empty if additional removal is possible. For example, a drum that has been hand-pumped must also have the residual poured out by inverting the drum, if possible. A gas cylinder or aerosol can is considered empty when the pressure in the cylinder/container approaches atmospheric and no free liquid is felt when the item is shaken. Empties can be discarded into the trash.

3.14.2.5 Waste Minimization: The Contractor will endeavor

to minimize waste by utilizing appropriate work practices. Mix or pour only the amount of material needed for the task. Select products that do not generate HW (latex instead of enamel paint). Ensure cans/cartridges are properly closed to avoid drying of paints/sealants. Clean equipment with rags first, using solvent sparingly and only when needed to get the item clean.

Use launderable rags whenever possible (laundered rags are not a waste). The goal is to minimize these materials, reduce toxicity, and minimize waste generation.

3.14.3 Other Regulated Waste: There are other regulated waste items that require special handling. This includes Asbestos-Containing Material (ACM) and Polychlorinated Biphenyl (PCB) light ballasts.

01430-10

3.14.4 Environmental Spills: Upon occurrence of any spill that could enter the storm sewer system or could cause any harmful environmental effects, the Contractor or his authorized representative shall immediately call 911 (Base Fire Department) and report the incident. The type of material and quantity spilled shall also be reported to the Environmental Flight (5 CES/CEV) at 723-4847. The Contractor shall be liable for the cleanup cost of any spill, which occurs through Contractor negligence. If the spill can be cleaned up without outside help, the material spilled and the amount spilled shall still be reported to 5 CES/CEV at 723-4847.

13.15 LEAD BASED PAINT:

3.15.1 Employee Awareness. The Contractor will make all workers aware of the LBP dangers inherent in the operations under this contract. The Contractor shall ensure workers are trained in LBP awareness as outlined in the Occupational Safety and Health Administration (OSHA) standards 29 CFR §1910.1001, General Industry, 29 CFR §1910.1025 General Industry Lead Standard, and 29 CFR §1926.58, Construction Industry.

3.15.2 LBP Waste Disposal. Environmental regulations, as

promulgated by the Resource and Recovery Act (RCRA), currently require the characterization of lead containing wastes to determine proper disposal criteria. Removed paint and used abrasive shall be tested in accordance with 40 CFR Part 261 for hazardous waste. Disposal of removed paint chips and associated waste shall be completed in accordance with Federal, State, Air Force and local requirements. The Contractor has the responsibility to ensure that all lead-based paint (LBP) wastes are disposed of properly. The Contractor shall properly dispose of all waste generated during the course of the project. The Contractor shall submit to the government copies of the waste analysis results, waste profiles, waste manifests and certificates of disposal. Quality Assurance / Quality Control (QA/QC) shall be performed throughout this process.
