1.1 SUBMITTALS

SUPPLEMENTARY CONDITIONS FOR AZORES PROJECTS

Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for Contractor Quality Control approval. Submit the following in accordance with Section 01 33 00 and shall be sent via AF Form 3000. The schedule of submittals shall be done using AF Form 66, Schedule of Materials submittals.
1.2 PHYSICAL DATA
Data referred to below is furnished for the Contractor's information.
However, it is expressly understood that the Government will not be responsible for interpretation or conclusion drawn therefrom by the Contractor.
a. The physical conditions indicated on the drawings and in the specifications are the result of site investigations.
b. Geographic Conditions
(1) The Azores are comprised of a group of nine small islands, politically an integral part of Portugal, lying in the North Atlantic, about 2,300 miles east of New York and about 980 miles west of Lisbon, Portugal. The islands have a total area of 1,581 square miles with a total population of about 360,000. The economic mainstays of the Azores are fishing and agriculture.
There is no heavy industry, and facilities for repairing machinery are limited. Most tools, implements, and farm utensils are handmade.
(2) The climate is mild and the humidity high. Average annual temperature is 63 degrees F. Diuranal fluctuation in temperature is approximately 10 degrees. Highest recorded temperature, 80 degrees F, lowest recorded temperature, 40 degrees F. The yearly average rainfall is 44.80 inches; the monthly average rainfall and probability of rain is as follows:

High winds occur from December through March. Average winds during this period are 11.6 knots. The recorded high winds are: November 90 knots, December 72 knots, January 90 knots, February 128 knots, March 106 knots, April 89 knots.
1 Terceira Island measures roughly 11 by 18 miles, almost entirely bordered by high cliffs. The terrain is hilly and dominated by volcanic ranges, including two extinct craters. The airfield is located on the northeast side of the island. The total population of Terceira Island is approximately 80,000. The city of Angra do Heroismo, capitol of the district, has a population of about 30,000; and the nearest town to the airfield, Praia da Vitoria, has a population of about 11,000.
c. Transportation Facilities for Lajes Field. Lajes Field is defined as the U.S. Forces Azores operational area on Terceira Island.
1 Railroads: There are no railroads on the island.
2 Highways and Roads: The majority of the roads are paved. A asphalt highway links Praia da Vitoria and Angra do Heroismo. The use or construction of haul roads and bridges shall be subject to prior approval of the Contracting Officer.
3 Ports: The island has two ports capable of handling deep draft ocean freighters, Praia da Vitoria and Angra do Heroismo. There are no regularly scheduled commercial vessels arriving or departing Terceira Island.
4 Air: Lajes Field is served by the commercial two Portuguese airline s TAP & SATA.

1.4 CONDUCT OF CONTRACTOR PERSONNEL
The Contractor shall report to the Contracting Officer, immediately upon receipt or discovery of any information, whether or not verified, relating to physical security incidents, misconduct, crimes, and misdemeanors, including but not limited to murder, arson, larceny of any weapon, ammunition, or explosives, larceny of other property, robbery, burglary, narcotics and dangerous drugs, destruction of Government property, fraud, malfeasance, sabotage, subversions, disaffections, treasons, or espionage. The Contractor shall recognize and comply with the rules and regulations promulgated by the foreign country where the work is performed to the extent required by international agreements.
1.5 EMPLOYEE RECRUITING (PORTUGUESE NATIONALS)
a. The Contractor, using the Contractor's own contracting forms, may contract directly or request assistance from the Civilian Personnel Office, Civilian Recruitment Section Headquarters Azores Air Zone (SRPC, HAAZ), in contracting Portuguese National employees. The Contractor's contract form shall include, as a minimum, the following: Organization or firm (name and address), contract and project numbers; contract start and expiration dates; and the following information concerning the employee: name, social welfare number, date and place of birth, residence (village and council), parents' name, marital status, spouse's maiden name, professional degree or skill, salary, and meal and transportation allowances.
b. It will be the Contractor's responsibility once employees have been hired, to clear them through SRPC, HAAZ to gain access to the installation.
c. The Contractor shall request base access through 65th CONF, for all employees and vehicles. The contractor shall also request base access through 65th Contracting Flight (65th CONF) for subcontractors, and shall specifically indicate in the request sheets, the subcontract's full name, civilian identification number and subcontractor companies legal designation.
1.6 INVESTIGATION OF DAMAGE OR INJURY
The U.S. Government will have the right to conduct an investigation, or participate in the Contractor's investigation, of any damage or injury to U.S. Government property, equipment, or personnel.
1.7 PROCESSING OF CONTRACTOR'S PERSONNEL AND PROPERTY
The Contractor shall process Contractor personnel and property through 56th CONF prior to commencement and at the completion of work under this contract. This processing shall include such things as registering and deregistering vehicles, arranging for the issuance and turn-in of identification and passes, and clearing liabilities incurred such as clubs, billeting, and loans.
1.8 RADIO FREQUENCIES FOR MOBILE AND PORTABLE RADIOS
Contractors requiring the use of mobile and portable radios on the project shall obtain Government of Portugal approval via the HAAZ Frequency Coordinator. Information needed by the Radio Frequency coordinator coordinator from the Contractor includes type of equipment, type of
DOCUMENT 00 73 03 Page 6 emission, frequency desired, power, geographical coordinates of the project site, hours of radio operation, and start and end dates of frequency requirement. For planning purposes, the frequency coordination process normally requires 60 to 90 days for completion. The Government of Portugal closely monitors frequency usage and unauthorized users are subject to severe fines. COMUSFORAZINST 2410.1D pertains.
1.9 SPECIAL REQUIREMENTS FOR OUTDOOR SIGNS
In accordance with USFORAZINST 5710.2D outdoor signs displayed on local military facilities are mandatory to be in both Portuguese and English languages. Identical size lettering shall be used for both languages, with Portuguese on top. The same requirement applies to project signs and safety and warning signs as used by the Contractor, project signs shall be according Lajes Facilities Construction Standards.
1.10 WRITTEN CORRESPONDENCE
Written correspondence from the Contractor to 65th CONF shall be in English language, including but not limited to Contractor's invoice, Contractor's Monthly Estimate for Voucher, Contractor's schedules, samples and submittals, reports, and as-built drawing markups, this correspondence shall be digital signed and sended by email.
1.11 PORTUGUESE EQUIVALENT
Where equipment, materials, or installations are to be in accordance with American standards, the equivalent Portuguese standard may be used subject to the approval of the Contracting Officer. The Contractor shall be responsible for proving the equivalency of the Portuguese standard.
1.12 SOURCE REQUIREMENTS CLAUSE (01 MAY 86)
The requirements of this clause are material conditions of this contract.
The Contractor shall, in the performance of this contract, use Portuguese sources to the maximum extent feasible for the goods and services required to perform the contract including labor, materials, supplies, services, equipment, and subcontracts provided such goods and services meet the contract specifications and standards, will be available at the required locale within the required time limits and are equal or lower in cost than those from other sources. The Contractor shall demonstrate compliance with this requirement.
The requirement to use Portuguese sources to the maximum extent feasible does not apply when not in accordance with requirements, standards, or specifications specifically set forth elsewhere in this contract.
Consistent with the foregoing, the Contractor shall submit a four-part written "Report of Sources" to the Contracting Officer as follows:
PART I. The Contractor shall prepare a listing indicating for each category of expenditures anticipated under the contract the U.S. dollar value estimated to be paid to Portuguese sources and the U.S. dollar value estimated to be paid to other sources. The categories shall include as a minimum those shown in the following sample format:

(1) Items that are included in subcontracts, such as labor and materials, should be reported only as subcontracts and shall not be included with other categories.
(2) Overhead and profit must be prorated among the categories.
PART II. The Contractor shall prepare a list of subcontracts indicating the purpose of the subcontract, the name of the subcontractor, and whether Portuguese or other source.
PART III. The Contractor shall prepare a list of each item or subcontract not procured from a Portuguese source, indicating the reason for not procuring the item or subcontract from a Portuguese source.
PART IV. The Contractor shall indicate the approximate percentage of the total contract price that he will pay collectively to Portuguese sources.
The initial four-part "Report of Sources" shall be submitted by the Contractor to the Contracting Officer not later than 30 calendar days after contract award. In addition, the Contractor shall submit an updated report in the same four-part format every 30 calendar days thereafter. If no changes have occurred since the last report, the Contractor may submit a negative report by letter.

1.2 WORK COVERED BY CONTRACT DOCUMENTS
The following list of principal features is intended as a guide only and should in no way be considered an all-inclusive description of the work and does not relieve the Contractor from the responsibility to complete the work in accordance with the applicable construction drawings, schedules, and specifications.
1.2.1 Project Description:
1.2.1.1 Demolition Work
A. Demolish and dispose of entire facility building T-717, including foundations. All drainage grids, lids and existing utilities that are beneath the building shall be removed and disposed, with the exceptions indicated in the Government Drawings and this Statement of Work.
IMPORTANT NOTE: ALL ELCTRIC PANELS, CIRCUIT BREAKERS, MONACO FIRE PANNELS AT
T-715 SHALL BE RETURNED TO THE GOVERNMENT.
B. The fire alarm disconnection of building T-717 shall be coordinated with the fire department. The disconnection shall no occur more than 30 days prior the demolition process.
C. Remove/demolish existing power cables all the way to their main lines.
D. Remove/demolish existing water line, all the way to the main line valve and install a cap.
E. Remove and dispose turf and soil in order to prepare sub base and base to receive new asphalt or concrete, as per attached drawings.
F. Remove and dispose all concrete pavements, foundations and other buried structures (approximately 3500 CM), asphalt pavements (approximately 462 CM), rock and CMU walls (approximately 120 CM) and Building/fire hydrant/Dumpster Enclosure as defined on the Government Drawings.
G. Excavate trenches to accommodate new electrical conduits for the parking area light poles (approximate total of 1910 M).
H. Remove and dispose all concrete curbs (approximately 70 M) as per
Government Drawings.
I. Excavate trenches to accommodate new storm drain system at the parking area (approximately 120 M).

J. Remove and dispose existing traffic light pole (1 EA). Contractor shall cover the reminiscent hole.
K. Remove and dispose existing utility pole (1 EA) near T-717.
L. Contractor shall perform the lead abatement of: paint from all concrete walls, paint from concrete masonry unit (CMU) (total cement based surfaces approximately 2200.00 m2), wall paint from steel structure, wall paint from steel structure above offices and bays and wall paint from steel structure columns and façade plates and gates (total metal surfaces approximately 2800.00 m2). Note: Roof tiles don’t require lead abatement.
M. Abatement shall be performed by Chemical Stripping.
Demolition - General notes
1 - Demolition materials shall be properly disposed.
2 - Use appropriate equipment and techniques for demolition or removal work in order to avoid damages on surrounding area.
3 - The fire alarm disconnection shall be coordinated with the fire department.
The disconnection shall occur no more than 30 days prior the demolition process.
4 - Concrete barriers/fencing shall be placed on the airfield side at any stretch left unsecure during demolition or construction stage so it prevents unauthorized vehicle/personnel access. Concrete barriers shall be applied by CE Operations Flight in coordination with Security Forces Squadron, upon Contractor request.
5 - The demolition of the existing ECP shall only occur when the new ECP is built and capable of performing the same functions of the existing one, in order to avoid any constrains regarding airfield access. This will imply that a significant portion of T-717 demolition has already been performed upon existing ECP demolition.
1.2.1.2 New Work
A. Contractor shall prepare base and build:
- Approximately 9000 SM of asphalt pavement with 0.15 M thickness for traffic on GOV and POV parking. The classification of the asphalt shall be “Desgaste – Betão Betuminoso – AC 14 Surf ligante (BB)” in accordance with “EN 13108-1 (Anexo Nacional)”. Apply asphalt in two layers (minimum) with tack coat in between;
- Paved Areas on the POV and GOV parking lots identified on the Government Drawings;
B. Contractor is responsible to properly re-arrange base material
SECTION 01 11 00 Page 4 of removed pavement areas to create the necessary slopes to assure drainage to new drainage grids. Sloping the terrain appropriately to avoid any and all ponding is of the Contractor’s responsibility. Earth movement shall be kept to a minimum and new base materials to eventually be added shall match the characteristics of the existing.
C. Contractor shall assure compaction of base at 95% of modified proctor before applying new paving material, sidewalks included.
Any necessary backfill shall be accomplished with 0,20 M maximum thickness lifts, all compacted at 95% modified proctor in accordance with ASTM 1557.
D. Contractor shall backfill all existing man-holes that are currently in the T-717 surrounding concrete pavement.
E. Contractor shall adjust existing manholes tops and apply new D- 400 cast iron with anti-theft system lids on the five (3 EA) existing manholes of the parking currently serving building T-
715. Lids shall be “Capa Easyflex RD600” or equivalent. As per figure 1.

F. Install new precast concrete storm water drainage boxes, with
706mm x 380mm, grating and frames made of spheroidal graphite cast iron D400 class, with anti-theft system, manufacturer “CAPA Drain”, model “Grelhas Sumidouro”, Ref:. 924114, or equivalent, (19 EA).

G. Install new Ø200mm underground, PVC schedule 40, drainage pipe interconnecting new drainage boxes and connecting them to the existing storm water box, located on the airfield side, (approximately 150 M).
H. Contractor shall perform all trench work and connection to existing manholes for the new drainage system. After performing new drainage pipe connection, the Contractor shall seal the perforation locations of the existing storm manholes, and re-establish all pavements as previously existing – “massas frias” or cold asphalt is not permitted.
I. Supply and assemble new ECP plates (see figure 2), same as existing. The supporting poles for each plate shall be metallic and galvanized. The final location of these plates shall be the equivalent and proportional of the currently existing ECP, over new sidewalk to be built by the Contractor.

J. Paint all road markings on the new ECP location as the ones on the currently existing, including the STOP sign, with thermoplastic paint. Apply reflective beads in accordance with
SECTION 32 17 23 – PAVEMENT MARKINGS.
K. Paint all road markings in accordance with the Government Drawings on the new POV and GOV parking lots. Apply reflective beads in accordance with SECTION 32 17 23 – PAVEMENT MARKINGS.
L. Supply and assemble a new Electromechanical Crash Arm Rated for a PU-50 Criteria with a P-2 Penetration Rating as tested in accordance with ASTM F2656-07 (5070 Vehicle Traveling at 50mph
SECTION 01 11 00 Page 6 with a penetration less than 7M), and in accordance with the Government Drawings. The crash shall be mechanically operated, and activated with a compatible manual code pad. “BSP - AVBD-500 PU50/P2 Electromechanical Anti-Ram Drop Arm, 8.2’ Clear Opening
– Operators and local Push button Controls Included” or equivalent.
M. The Crash arm will have the capability of being manually operated in case of electrical malfunction. Manual operating function shall be protected by lock with key.
N. Contractor provide training for 4 people (CES – Operations) to perform all maintenance and operation procedures for the Crash Arm.
O. The contractor shall submit a shop drawing for the New ECP, including Crash Arm location, for approval before performing any work.
P. Perform removal of one fire hydrant and relocate another, as indicated in the Government’s Drawings. The removal of the fire hydrant includes capping of the existing pipe with all necessary accessories.
Q. Construct new 1.22m CMU (concrete masonry unit) wall with stone facing (see Government Drawings for details) and install 1.50m decorative fence on top of wall to match existing Nylofor 3D, or equivalent, RAL 6005 (approximately 200 M). Stucco side not to be painted.
R. Install new lighting poles (10 single-head and 9 double-head).
Lamps shall be 4000K, LED, "M4 classified roads" Voltana 3, or equivalent. Aluminum conical pole, length above ground of 6.0 meters, base diameter 120mm, top diameter 76/60mm, with welded aluminum base plate (270mmx270mm, holes at 200x200mm), with double bracket length 700mm, surface brush finish, powder coated in RAL 7038. Poles shall be Voltana 3 or equivalent. System shall be equipped with a photoelectric cell activating system.
S. Power supply shall be provided from the T-715 building's Mechanical Room. All materials including, piping, wiring and electrical panel board, among others, shall be provided and assembled. Wiring and piping shall be assembled appropriately over the ceiling tiles (inside T-715, as per figure 3), embedded in the concrete walls (facade of T-715) and in trench (outside T-715). Contractor shall re-establish all T-715 conditions as initially existing, namely walls and ceiling tiles.

GG. Contractor shall supply and install (3 EA) B4 vertical signs (2 EA) C1 vertical signs and (1 EA) and “2.22 - Deficiente” (according to DGV), all with appropriate galvanized poles. All signs and poles (2 meter free height from ground to bottom of the plate) shall comply with the “Disposições Normativas” of the “Instituto de Infra-Estruturas Rodoviárias IP”.
HH. All vertical sign poles (traffic and ECP) shall be galvanized steel with a thickness of 2.9 mm and diameter of 60 mm. The clamps, bolts, nuts and washers (hex bolts), must be galvanized steel. The poles cover cap must be plastic.
II. All vertical traffic sign poles shall have a “free height” of
2.20 M, from its foundation to the lower edge of the sign plate.
JJ. Concrete for the foundation for the vertical sign poles shall be a 2,500 psi class concrete. Finish shall be done so water accumulation does not occur.
KK. Concrete for all side-walks and dumpster area shall be a 2,500 psi class concrete.
LL. All vertical signage plates (traffic and ECP) shall be made out of aluminum, with level 3 of retro-reflection and simple edge.
New Work - General notes
1 - Because this project will occur next to the Airfield and close to the flight line, it’s the Contractor’s responsibility to perform timely coordination of all on site actions with Lajes Airfield Management (via Contracting Officer) prior to starting any work.
1.2.2 Location
The work will take place at the parking lot of building T-715, current Airfield Entry Control Point (ECP) and building T-717 and its surroundings as indicated in the Government’s Drawings, located at the Avenida do Imperio, AB Nº 4, Lajes Field, Azores, Portugal.

Buildings adjacent to the project area may be occupied during performance of work under this Contract.
Before work is started a phasing plan must be provided to the Contracting Officer with the sequence of procedure, means of access, space for storage of materials and equipment, and use of approaches, in order to minimize the impact on tenants daily operations.
1.4 EXISTING WORK
In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":
a. The contractor shall only remove or alter existing work, when specifically authorized to do so, or in manner that prevents injury or damage to any portion of existing work.
b. The contractor shall repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer.
At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.
1.5 LOCATION OF UNDERGROUND UTILITIES
Obtain AF Form 103 work clearance request approved by CEO chief prior to start job , and comply with Installation requirements for locating and marking underground utilities. Contact local utility locating service a minimum of 48 hours] prior to excavating, to mark utilities, and within sufficient time required if work occurs on a Monday or after a Holiday.] Verify existing utility locations indicated on contract drawings, within area of work.
Identify and mark all other utilities not managed and located by the local utility companies. Scan the construction site with Ground Penetrating Radar (GPR), electromagnetic, or sonic equipment, and mark the surface of the ground, pier deck or paved surface where existing underground utilities ]are discovered. Verify the elevations of existing piping, utilities,and any type of underground or encased obstruction not indicated, or specified to be removed, that is indicated or discovered during scanning, in locations to be traversed by piping, ducts, and other work to be conducted or installed.
1.6 PERIOD OF PERFORMANCE: Contractor required to complete work within 300 calendar days, including material acquisition.

1.2 SPECIAL SCHEDULING REQUIREMENTS
a. Project site access for personnel and vehicles must be submitted to the Contracting Officer and approved by HAAZ (Headquarters Azores Air Zone) before work is started.
b. Permission to interrupt any Activity roads, railroads, or utility service must be requested in writing a minimum of 21 calendar days prior to the desired date of interruption and approved by HAZZ or Base Group Commander.
1.3 CONTRACTOR ACCESS AND USE OF PREMISES
1.3.1 Activity Regulations
Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. 1.3.1.2 Identification Badges and Installation Access
Application for and use of badges will be as directed.
1.3.1.3 No Smoking Policy
Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.
1.3.2 Working Hours
Regular working hours must consist of an 8 hour period, between 8 a.m. and 5;00 p.m., Monday through Friday.
1.3.3 Work Outside Regular Hours
Work outside regular working hours requires Contracting Officer approval.
Make application 21 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work must be lighted in a manner approved by the Contracting Officer.

1.3 MINIMUM INSURANCE REQUIREMENTS
Provide the minimum insurance coverage required by FAR 28.307-2 LIABILITY, during the entire period of performance under this contract.
1.4 SUPERVISION
1.4.1 Minimum Communication Requirements
Have at least one qualified superintendent, or competent alternate, capable of reading, writing, and conversing fluently in the English language, on the job-site at all times during the performance of contract work. In addition, if a Quality Control (QC) representative is required on the contract, then that individual must also have fluent English communication skills.
1.4.2 Superintendent Qualifications
The project superintendent must have a minimum of 10 years experience in construction with at least 5 of those years as a superintendent on projects similar in size and complexity. The individual must be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance. The individual must be capable of interpreting a critical path schedule and construction drawings. The qualification requirements for the alternate superintendent are the same as for the project superintendent. The Contracting Officer may request proof of the superintendent's qualifications at any point in the project if the performance of the superintendent is in question.

1.4.2.1 Duties
The project superintendent is primarily responsible for managing and coordinating day-to-day production and schedule adherence on the project. The superintendent is required to attend partnering meetings, and quality control meetings. The superintendent or qualified alternative must be on-site at all times during the performance of this contract until the work is completed and accepted, and should have authority to make decisions on contractor behalf.
1.4.3 Non-Compliance Actions
The Project Superintendent is subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion.
Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken.
N o part of the time lost due to such stop orders is acceptable as the subject of claim for extension of time for excess costs or damages by the Contractor.
1.5 PRECONSTRUCTION
After award of the contract but prior to commencement of any work at the site, meet with the Contracting Officer to discuss and develop a mutual understanding relative to the administration of the value engineering and safety program, preparation of the schedule of prices or earned value report, shop drawings, and other submittals, scheduling programming, prosecution of the work, and clear expectations of the "Interim DD Form 1354" Submittal. Major subcontractors who will engage in the work must also attend.
1.6 ELECTRONIC MAIL (E-MAIL) ADDRESS
Establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments as text files, pdf files, and other similar formats. Within 10 days after contract award, provide the Contracting Officer a e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence, all correspondence shall be digitally send. The Contracting Officer may also use e-mail to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes or terrorist threats.
It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). Promptly notify the Contracting Officer, in writing, of any changes to this e-mail address.

1.3 SUBMITTAL CLASSIFICATION
Submittals are classified as follows:
1.3.1 Government Approved (G)
Within the terms of the Contract Clause SPECIFICATIONS AND DRAWINGS FOR CONSTRUCTION, they are considered to be "shop drawings."
1.4 PREPARATION

No set of Source Drawing files (DWG /AutoCAD) will be provided to the Contractor.
1.4.2.1 Terms and Conditions
Data contained on these electronic files must not be used for any purpose other than as a convenience in the preparation of construction data for the referenced project. Any other use or reuse shall be at the sole risk of the Contractor and without liability or legal exposure to the Government. The Contractor must make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files. The Contractor must, to the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic files.
These electronic Source Drawing files are not construction documents.
Differences may exist between the Source Drawing files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic Source Drawing files, nor does it make representation to the compatibility of these files with the Contractor hardware or software.
In the event that a conflict arises between the signed and sealed construction documents prepared by the Government and the furnished Source Drawing files, the signed and sealed construction documents govern. The Contractor is responsible for determining if any conflict exists. Use of these Source Drawing files does not relieve the Contractor of duty to fully comply with the contract documents, including and without limitation, the need to check, confirm and coordinate the work of all contractors for the project. If the Contractor uses, duplicates or modifies these electronic Source Drawing files for use in producing construction data related to this contract, remove all previous indicia of ownership (seals, logos, signatures, initials and dates).
1.4.3 Electronic File Format
Provide submittals in electronic format, with the exception of material samples required for Samples items. Compile the submittal file as a

Name the electronic submittal file specifically according to its contents, coordinate the file naming convention with the Contracting Officer. Electronic files must be of sufficient quality that all information is legible. Use PDF as the electronic format, unless otherwise specified or directed by the Contracting Officer. Generate PDF files from original documents with bookmarks so that the text included in the PDF file is both searchable and can be copied. If documents are scanned, Optical Character Resolution (OCR) routines are required. Index and bookmark files exceeding 30 pages to allow efficient navigation of the file. When required, the electronic file must include a valid electronic signature, or scan of a signature.
Email electronic submittal documents fewer than 10MB to an email address as directed by the Contracting Officer.
1.5 QUANTITY OF SUBMITTALS
1.5.1 Number of Samples (if applicable)
a. Submit two samples, or two- sets of samples showing range of variation, of each required item. One approved sample or set of samples will be retained by approving authority and one will be returned to Contractor.
