JUSTIFICATION AND APPROVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY: 87th Contracting Squadron, Joint Base McGuire-Dix- Lakehurst (JB MDL). This action is supported by Purchase Request Number
F3A3Q52090AQ04.
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED: The 87th Contracting Squadron intends to issue a new firm fixed price purchase order for Custodial services at JB MDL Lakehurst area.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS: Under the proposed purchase order, Starbright Cleaning Services, Inc.
will provide all personnel, labor, equipment, tools, materials, and other items necessary to perform custodial services at JB MDL, Lakehurst area. The period of performance will be 1-30 April 2012.
Total funding for this Justification for Other Than Full and Open Competition is estimated at
. Fiscal Year 2012 Operations and Maintenance funds will be utilized and the amount is included in the Civill Engineer Squadron execution plan for FY12.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION: The authority for this acquisition is 10 U.S.C. 2304(c)(2) as implemented by Federal Acquisition Regulation (FAR) 6.302-2, Unusual and Compelling Urgency.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY
CITED ABOVE (APPLICABILITY OF AUTHORITY): The proposed purchase order will be a sole source contract to Starbright Cleaning Services, Inc. to ensure custodial services are not interrupted during the reprocurement of new custodial contract at Lakehurst area. The Government anticipates the time required to re-compete this requirement, to include the time required to evaluate proposals and determine technical acceptability, would result in an unacceptable lapse for this mission critical service. Starbright Cleaning Services has performed these services under the previous Contract Number FA4484-09-C-0002 during the period of 29 May 2009 - 30 September 2011, as well as extended service under FAR Clause 52.217-8, Option to Extend Services, which expired 31 March 2012. Without this purchase order, no cleaning/custodial services will occur. Vital health, safety, and quality of life standards would deteriorate causing the closure of regulated base facilities to include the Child Development Centers, dining facilities and medical facilities. Infestation of rodents and other disease carrying animals would occur, placing mission essential workers and base occupants (specifically children) at risk. The Lakehurst area does not have the organic resources (manpower, specialized equipment) necessary to meet this requirement and must have continued contract support or the base’s operational mission could be significantly impacted. Only the current contractor can provide these services in the short term without a significant interruption that would be caused by a changeover from one contractor to another until a new contract is awarded.
For all the reasons discussed above, the incumbent is the only contractor who can reasonably provide these services during this period without service interruption, and significant health, quality of life and safety risk to base personnel.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
The contractor, Starbright Cleaning Services, Inc., agreed to abide by the pricing offered under Contract Number: FA4484-09-C-0002. These prices continue to be considered reasonable as they were negotiated at the time of award of the mentioned contract.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED: Extensive market research had been conducted in accordance with FAR Part 10 for the previous solicitation by issuing a sources sought notice, advising industry of the pending acquisition and several other methods. This market research revealed that custodial services are readily available in the commercial marketplace. However, due to time constraints and the urgent need for continued performance, additional market research was not performed.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION: Failure to award an urgent purchase order with Starbright Cleaning Services will result in immediate mission stoppage at JB MDL Lakehurst area. The purchase order is meant as a stop-gap measure until a new contract can be awarded. The incumbent contractor is fully mobilized, familiar with the requirement, and the only source available to provide these services during the interim period without mission degradation.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION: See Section VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING
SUBSEQUENT ACQUISITIONS FOR THE SUPPPLIES OR SERVICES REQUIRED:
87th Contracting Squadron will reprocure the requirement as previously advertised, as an 8(a) competitive.
XII. CONTRACTING OFFICER’S CERTIFICATION: The contracting officer’s signature on the Coordination and Approval Document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION: As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
