ADDENDUM TO 52.212-1
INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2005)
This is a competitive best value acquisition utilizing Simplified Acquisition Procedures IAW FAR 13.500. A request for quotation is being solicited for evaluation of issuing an award of a purchase order as an offer to the acceptable quote in accordance with the evaluation for award contained herein.
(b)(12)(Added) Site visit: A site visit will be held on Friday, 5 August, 2016 at 9:30a.m. (Central Standard Time).
The base is located directly off Highway 67/167 in Jacksonville, Arkansas. Interested parties shall enter the base using the front gate entrance and proceed to Building 642, located across from the base gymnasium. Offerors are cautioned that Little Rock AFB, Arkansas has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. Offerors should expect possible delays (30 – 45 minutes) at the main entrance of the Air Base.
SITE VISIT ATTENDANCE MUST BE COORDINATED WITH THE 19CONS
NO LATER THAN NOON. (CENTRAL STANDARD TIME) 1 AUGUST 2016
The purpose of the site visit will be to tour the work area on Little Rock AFB, AR. You are requested to submit your company name, address, telephone number, and the full name(s) of the individual(s) attending to SSgt Anthony Parsons at anthony.parsons.1@us.af.mil or call 501-987-3844 or the front desk at 501-987-3303. You will need a copy of your driver’s license, vehicle registration and vehicle insurance to obtain a base pass. Questions from the site visit must be submitted in writing to SSgt Anthony Parsons by 4:00PM. Central Standard Time the next business day following the site visit so that responses may be posted to FedBizOps in a timely manner.
(b)(13)(Added) POST AWARD CONFERENCE: Offerors are hereby advised that if they are awarded a contract as a result of this solicitation, they may be required to appear at the 19th Contracting Squadron, Building 642, Little Rock AFB, and Arkansas to attend a pre-performance conference prior to commencement of any work on the military installation. This conference may also be conducted via telecon.
(c) Period of acceptance of offers: The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for the receipt of offers.
INFORMATION REGARDING SUBMISSION OF OFFER:
1. To assure timely and equitable evaluation of the offers, the offeror must follow the instructions contained herein.
The offer must be complete, self-sufficient, and respond directly to the requirements of this solicitation. The response shall consist of the price and past performance information requested.
2. Competition: The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists no additional cost information will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit information other than cost or pricing data to support a determination of price reasonableness.
3. General Information
(a) Complete blocks 12, 17a, 30a, b, and c of the SF 1449, and any amendments with attachments.
4. PART I – PRICE
A price must be submitted for all years requested.
5. PART II – PAST PERFORMANCE INFORMATION -
(a) Quality and Satisfaction Rating for Contracts Completed in the Past Three Years: Provide information currently available (letters, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc. Only references for same or similar type contracts are desired. Relevant performance includes performance of efforts involving processing and collecting of refuse and recyclables and that are similar or greater in scope, magnitude, and complexity of the effort described in this solicitation. Recent performance is work that is currently being accomplished or has been accomplished in the last three (3) years.
(b) Past Performance Surveys: Provide a list of no more than six (6), of the most relevant contracts performed for Federal agencies and commercial customers within the last 3 years. Furnish the following information for each contract referenced:
(i) Company/Division name
(ii) Product/Service
(iii) Contracting Agency/Customer
(iv) Contract Number
(v) Contract Dollar Value
(vi) Period of Performance
(vii) Verified, up-to-date name, address, and telephone number of the contracting officer
(viii) Comments regarding compliance with contract terms and conditions
(ix) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.
(c) Past Performance Questionnaire (PPQ) The Offeror shall send the questionnaire shown at Attachment 3 to those Government agencies or private sector companies identified by the offeror. These agencies or companies must have detailed information concerning contracts considered relevant in demonstrating ability to perform the proposed effort. Performance shall be within the last three years.
(d) It is the responsibility of the offeror to send out the Past Performance Questionnaires. Completed PPQs shall be e-mailed, by the agency/private sector company, directly to the point of contact identified on the PPQ questionnaire.
It would be beneficial to provide a list of the proposed respondents to the Contracting Officer. The completed questionnaires should be received no later than the offer due date.
(e) If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past/present performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of past and present relevant contracts.
(f) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the offer a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
(g) Documents submitted in response to this solicitation must be fully responsive to and consistent with the following:
1. Requirements of the solicitation and Performance Work Statement (PWS), and government standards and regulations pertaining to the PWS.
2. Evaluation Factors for Award.
(h) General Information
The "original" offer shall be identified. Offers may be either hand carried, mailed (i.e. USPS, FEDEX, DHL, and UPS etc.) directly to the 19th Contracting Squadron, 642 Thomas Avenue, Little Rock AFB, AR 72099-4971. The sealed envelope/package used to submit your quote must show the time and date specified for receipt, the Solicitation Number, and the name and address of the offeror. Emailed quotes will not be accepted.
Offerors are cautioned that Little Rock AFB, AR has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. For visitor access for hand carried offers contact SSgt Anthony Parsons at 501-987-3844 or the front desk at 501-987-3303. SOME DELAY SHOULD BE ANTICIPATED WHEN HANDCARRYING OFFERS. Offerors should allow sufficient time to obtain a visitor pass and arrive at the 19th Contracting Squadron PRIOR to the time specified for receipt of offers. Late offers will be processed in accordance with FAR 52.212-1(f) “Late submission, modifications, revisions, and withdrawals of offers.”

JOINT VENTURE AGREEMENTS - Joint Ventures are allowable on competitive 8(a) set-asides, however, the joint venture agreement must be received by SBA prior to offer due date and approved before award of any resulting contract. If you are contemplating a joint venture on this project, you must advise your assigned SBA Business Opportunity Specialist (BOS) as soon as possible. It is also recommended that the agreement be submitted as soon as practicable to ensure compliance with established regulations. 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
BASIS FOR CONTRACT AWARD:
1. Evaluation factors will be past performance and price with past performance being approximately equal to price.
In order to be considered for award, the offer must be acceptable on the non cost factor.
2. Price: Initially, all offers will be ranked according to price, including option prices. An offeror's proposed prices will be determined by multiplying the quantities identified in the schedule by the proposed unit price for each Contract Line Item Number (CLIN) to confirm the extended amount for each. All extended CLIN amounts will be totaled for evaluation purposes. Individual pricing for each line must be completed. Price will be evaluated for reasonableness. Reasonableness will be determined based on prices submitted by the competition, current market conditions, and comparison to the Government estimate, if applicable. If the government deems this information is not sufficient to determine reasonableness, the government may use other techniques as appropriate to determine price reasonableness for the acquisition.
3. Past Performance: Starting with the lowest offer, the contracting officer will seek relevant and recent (within 3 years from the date of receipt of offers) performance information based on (1) the references provided by the offeror and (2) data independently obtained from other Government and commercial sources. Relevant performance includes performance of work efforts involving refuse/recycling services that are similar or greater in scope, magnitude and complexity than the effort described in this RFQ. The offeror shall submit a minimum of 3 references, but no more than 6 overall. The purpose of the past performance evaluation is to allow the Government to assess the offeror's ability to perform the effort described in this RFQ based on the offeror's demonstrated present and past performance. Relevant information will be determined based on the following table:

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
4. Offerors relevant past performance will then be evaluated on an acceptable or unacceptable basis according to the following:
Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (see note below).
Unacceptable: Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
5. Offerors may be asked to clarify certain aspects of their offer (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Clarifications conducted to resolve relevance of the past performance information, adverse past performance information, or minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for revisions.
6. The Government reserves the right to award a purchase order to other than the lowest priced offeror.
7. The Government intends to award a purchase order without discussions with respective offerors. Therefore, each initial offer must address information in accordance with the paragraphs above and should contain the offeror's best price and past performance reference list. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
8. Award will made to the lowest responsible quote with acceptable past performance who is responsive to the terms of the solicitation.

LITTLE ROCK AFB INFORMATION
Smoking in Air Force Facilities
Contractors are advised that the Wing Commander has placed restrictions on the smoking of tobacco products in Air Force facilities. AFI 40-102, Tobacco Use in the Air Force outlines the procedures used by the commander to control smoking in our facilities. Contractor employees and visitors are subject to the same restrictions as government personnel. Smoking is permitted only in designated smoking areas.
10 Year Felony Ban
Contractors are advised that the Wing Commander has established a policy denying all individuals convicted of a felony within the last 10 years from accessing Little Rock Air Force Base. Individuals will also be denied entry to the base if they fall under one of the items in the below table:

Availability of Utilities Services
Notwithstanding the provisions of contract clause FAR 52.236-14, Availability and Use of Utility Services, all reasonable required amounts of water, gas, electricity, etc., essential to contract performance shall be made available, at no cost to the contractor, from existing systems, outlets, and supplies. All temporary connections, outlets, and distribution lines as may be required will be installed by the contractor at the contractor’s own expense.

Utilities Conservation
The contractor will be required to participate in government energy conservation programs. 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JULY 2013)
(a) Definitions. As used in this provision--
Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a
Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
Federal contracts and grants with total value greater than $10,000,000 means--
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
(b) The offeror ( ) has ( ) does not have current active Federal contracts and grants with total value greater than $10,000,000.
(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:
(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:
(i) In a criminal proceeding, a conviction.
(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.
(iii) In an administrative proceeding, a finding of fault and liability that results in--
(A) The payment of a monetary fine or penalty of $5,000 or more; or
(B) The payment of a reimbursement, restitution, or damages in excess of $100,000.
(iv) In a criminal, civil, or administrative proceeding, a disposition of the matter by consent or compromise with an acknowledgment of fault by the Contractor if the proceeding could have led to any of the outcomes specified in paragraphs (c)(1)(i), (c)(1)(ii), or (c)(1)(iii) of this provision.
(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.
(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management database via https://www.acquisition.gov (see 52.204-7).

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A
FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--
(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factor considered. The following factors shall be used to evaluate offers:
1. Past Performance
2. Price
Past performance is approximately equal to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (APR 2016)
ALTERNATE I (OCT 2014)
The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
