52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The government may award up to four contracts resulting from this solicitation. Offerors will be required to submit a separate and complete Technical and Price proposal for each requirement they wish to compete for: Gulfstream III, IV, and V and G550; Boeing 757; Boeing 747-200; and Rodeo Support. Each proposal will be evaluated separately. The following factors shall be used to evaluate offers:

(1) Technical

a. Staffing Subfactor

b. Technical Subfactor

(2) Price

BASIS FOR CONTRACT AWARD: This acquisition will be conducted in accordance with (IAW) Federal Acquisition Regulation (FAR) Subpart 15.101-2, Lowest Price Technically Acceptable (LPTA) Source Selection Process, and DFARS 215.3. Technical and Price evaluation factors will be used. LPTA is a best value source selection where best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Past performance will be evaluated to assist in determining contractor responsibility in accordance with FAR 9.104-1 but will not be included as a subfactor or rated. The solicitation, representing four requirements, is broken down into four sets of CLINs, one set for each aircraft type and one set for Rodeo support. A “set” will be comprised of the base year plus option years for each separate CLIN. Offerors will submit a proposal for one, two, three, or all four sets of these CLINs. The price proposals for each CLIN set, all submitted on one conformed copy of the solicitation, shall be evaluated individually, and the lowest priced technically acceptable offer will be determined individually for each CLIN set. Contract award(s) for each CLIN set will be made to the offeror who submits the lowest total evaluated price proposal for that particular CLIN set achieving a rating of “Acceptable” for both subfactors under the Technical factor. The government will award up to four contracts resulting from this RFP to the offeror(s) whose offer(s) conforms to the RFP requirements, is considered technically acceptable, and will provide the best value to the government. There are five possibilities with respect to the number of contracts that can be awarded; (1) one contract if one offeror is awarded all four requirements; (2) two contracts if an offeror is awarded two of the requirements and another offeror is awarded two requirements; (3) two contracts if an offeror is awarded three of the requirements and another offeror is awarded one requirement; (4) three contracts if an offeror is awarded two of the requirements and two offerors are awarded one requirement each, and (5) four contracts if four separate offerors are each awarded one requirement. Failure to meet a requirement may result in an offer being determined technically unacceptable; however, technical unacceptability on one CLIN set will NOT cause the offeror to be technically unacceptable on any other CLIN set for which the offeror competes. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

1. Technical Acceptability

The government technical evaluation team will evaluate each separate and complete technical proposal for each CLIN set at the subfactor level, assigning ratings of Acceptable or Unacceptable as defined below.

Acceptable – The proposal clearly meets the minimum requirements of the solicitation.

Unacceptable – The proposal does not meet the minimum requirements of the solicitation.

Only those proposals determined acceptable (and unacceptable proposals that require minor clarifications) for each separate CLIN set will be considered for award. Proposals rated Unacceptable will be eliminated from further consideration. In order to be considered awardable, there must be an “acceptable” rating in every non-price factor/subfactor. Once deemed acceptable, all Technical proposals are considered to be equal. The proposals shall be evaluated against the following subfactors:

a. Subfactor 1 – Staffing Approach – Measures of merit for this subfactor are met when the offeror:

1. Provides a detailed and effective staffing plan, as reflected in a personnel matrix, which identifies the necessary personnel resources given the approach to perform the PWS tasks.

2. Provides a personnel matrix that properly correlates to the PWS training requirements.

3. Identifies the necessary key positions and provides generic resumes or job descriptions which demonstrate requisite education, experience, or special skills needed to perform PWS tasks.

4. Provides a detailed and effective plan indicating how the company will successfully recruit, train, and replace personnel throughout the life of the contract who have adequate knowledge, experience or special skills required to perform PWS tasks.

b. Subfactor 2 - Technical Approach – Measures of merit for this subfactor are met when the offeror:

1. Provides a detailed and effective plan that demonstrates the ability to accomplish the requirements of the PWS.

2. For the Simulator Training specifically, provides an informative course syllabus indicating, at a minimum, a detailed course description, the course length and the course outline curriculum for all classes corresponding to the offeror’s proposal. The syllabus must provide sufficient information to allow the government to develop a thorough understanding of the proposed courses.

3. Furnishes an operational aircraft simulator for conducting mock drills for unplanned ground evacuation procedures, fire fighting procedures, and sea survival procedures.

4. Furnishes a fire fighting simulator which resembles the enclosed environment of an aircraft, which has the ability to produce live fire and smoke, and which gives the student the effect of fighting a real fire in an enclosed environment.

5. Provides a plan that identifies quality checks to ensure the simulator training and Rodeo support meet all PWS requirements and includes proposed actions for correction of any defects.

2. Price Evaluation – The government will evaluate the offeror’s price proposal for each separate and complete technical proposal, to include all options, for price completeness and reasonableness as described below.

Completeness – The offeror’s price proposal will be evaluated for completeness by confirming the offeror has provided unit and extended prices for all CLINs.

Reasonableness - The offeror’s price will be evaluated for reasonableness through one or more of the methods specified in FAR 15.404-1(b)(2).

3. Past Performance - Although past performance will not be used as an evaluation factor, the offeror’s past performance will be reviewed to determine the offeror’s responsibility. The government reserves the right to obtain information relative to present and past performance on its own.

4. Small Business Subcontracting Plan - A Small Business Subcontracting Plan shall be submitted when required by FAR 52.219-9, incorporated by reference in this solicitation. A subcontracting plan is required as part of the initial proposal submission from all large businesses subcontracting any portion of this requirement. The government will review each plan to assure it is consistent with FAR clause 52.219-9, FAR part 19. Offeror’s Small Business Subcontracting Plan will be evaluated on a compliant or non-compliant basis.

5. Discussions - It is the government’s intent to evaluate proposals and award without discussions; however, the government reserves the right to hold discussions. If it is determined that discussions are necessary, the government will make a competitive range determination for purposes of holding discussions after the initial evaluation of proposals. The government will issue Evaluation Notices (ENs) to all offerors within the competitive range. ENs may be briefed orally to offerors prior to written release to ensure complete understanding of any discrepancies. Any necessary page changes to the offerors’ proposals will be obtained prior to concluding discussions. Throughout the discussion process, the government will document changes in ratings and total evaluated price. Discussions shall be conducted with prime offerors only. Offerors excluded at any time during the source selection process will be afforded the opportunity to request either a preaward or postaward debriefing. Information relating to other offerors’ proposals will not be disclosed. Proposals that are rated “Unacceptable” will be excluded from further consideration.

6. General Considerations – The proposal must comply in all material respects with the requirements of law, regulation and conditions set forth in the solicitation. To be eligible for award, the offeror must be determined responsible as defined in Federal Acquisition Regulation (FAR) 9.104-1. A Pre-Award Survey (PAS) may be conducted as part of this evaluation. Results of the PAS (if conducted) will be evaluated to determine whether the offeror meets the general standards of responsibility as defined in FAR 9.104-1.

7. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
