SOLICITATION NO. FA4417-16-R-0007

PROJECT NO. FTEV 15-1065, Repair Fire Suppression, Bldg 90028

QUESTIONS – ANSWERS – 1-2-3 5 April 2016

QUESTIONS:

Question 1: Can you please clarify for this solicitation as it relates to FAR 52.219-3; the classification of this solicitation as either "General Construction" or "Construction by special trade contractors"?

Answer 1: The classification for this solicitation is "General Construction."

Therefore, FAR 52.219-3(d)(3) applies to this solicitation.

Question 2: When working over the cage in the upstairs exercise area, can we remove the top section of the cage to demo the existing pipe and install the new pipe?

Answer 2: After proper coordination with the Contracting Officer’s Representative, the contractor can remove the top section of the cage to demo the existing pipe and installing the new pipe. The contractor shall reinstall the cage top once work in that section is completed.

Question 3: In the most recent posting of Q&A’s the following answer was provided. “Therefore, FAR 52.219-3(d)(3) applies to this solicitation.”

(3) General construction.

(i) At least 15 percent of the cost of contract performance to be incurred for personnel will be spent on the HUBZone prime contractor’s employees;

(ii) At least 50 percent of the cost of the contract performance to be incurred for personnel will be spent on the HUBZone prime contractor’s employees or on a combination of the HUBZone prime contractor’s employees and employees of HUBZone small business concern subcontractors; and

(iii) No more than 50 percent of the cost of contract performance to be incurred for personnel will be subcontracted to concerns that are not HUBZone small business concerns;

Question 3A. These subsections must be read as a whole (collectively) and as such this section states that a HUBZone company (or companies) must self-perform 50% of the work and that subcontracting to any non-HUBZone company cannot exceed 50%, is this correct?

Answer 3A. Yes. (i) and (ii) are clear in that at least 15% of the cost of contract performance to be incurred for personnel will be spent on the HUBZone prime contractor’s and at least 50 percent of the cost of the contract performance to be incurred for personnel will be spent on the HUBZone prime contractor’s employees or on a combination of the HUBZone prime contractor’s employees and employees of HUBZone small business concern subcontractors.

Question 3B. Sometimes looking only at subparagraph (i) can WRONGLY be interpreted as

HUBZone participation only has to be 15%. Is this correct?

Answer 3B. The Government has no opinion or comment on the precedence or frequency of contractor misinterpretations of FAR language or clauses.
