In accordance with FAR 46.709, Warranties of Commercial Items, it has been determined that the commercial extended warranty proposed for this requirement is in the best interest of the Government. Additionally, FAR 12.404(b), identifies that 41 U.S.C 3307(e)(5)(B) requires the contracting officer to take advantage of commercial express warranties as long as it is adequate to protect the needs of the Government, terms allow the Government effective post-award administration of the warranted items and the warranty is cost effective.

(4) Justification for restricting consideration to a brand-name item:

FAR 16.505(b)(1)(i) requires the Contracting Officer to provide each awardee under a multiple award contract, a fair opportunity to be considered for each order exceeding $3,500 unless a statutory exception applies. The specific exception that precludes the fair opportunity process for this acquisition is FAR 16.505(b)(2)(i)(B), "Only one awardee is capable of providing the supplies required at the level of quality required because the supplies ordered are unique or highly specialized."

AFTAC employs Forcepoint (formerly McAfee) security appliances and firewalls to protect multiple mission networks/enclaves at the Unclassified, Secret, and TS/SCI level. Defense Information Systems Agency (DISA) Security Technical Implementation Guidance (STIG) mandates continuous coverage for operational systems/assets to ensure currency with regard to security patching, operating systems updates, and signature file updates employed to detect and prevent impact from malicious and/or potentially malicious code. These assets were previously purchased and covered by an original equipment warranty and support plan. This effort extends coverage to meet network protection requirements and DoD guidance.

(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:

In accordance with FAR 16.202-2, this will be a firm fixed-price contract suitable for acquiring commercial items and allows fair and reasonable prices when there is adequate price competition and/or reasonable comparisons. FAR 15.404(b)(2)(i) allows adequate price competition to be used as a means for determining a price fair and reasonable.

As required by FAR 16.505(b)(3), the Contracting Officer will establish prices for this order using the policies and methods in Subpart 15.4. Specifically, the Contracting Officer anticipates sufficient competition to determine the resulting price fair and reasonable by comparing proposed prices received in response to the solicitation (see FAR 15.404(b)(2)(i) and 15.403-1(c)(1)(i)).

There is reason to believe that sufficient competition will be provided using NETCENTS-2, as this is only a brand name requirement and other similar equipment builds had several quotations.

(6) Other facts supporting the justification:

AFTAC standardized on Forcepoint firewalls and security appliances to maintain consistency with regard to knowledge base, support, component replacement, and interoperability between primary and remote systems locations. Forcepoint appliances are built around a unified software core that provides consistent capabilities, acceleration and centralized management across the network. Forcepoint firewalls use the Forcepoint Security Management Center (SMC) to configure, monitor and update all firewalls and appliances from a single console. This centralized management allow for ease of administration and firewall policy consistency.

(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:

The Program Manager performs a quarterly review of all technical aspects of the United States Atomic Energy Detection System (USAEDS). Information Technology system review is part of the overall program review.

(8) Program Manager's certification that supporting data is accurate and complete:

As evidenced by my signature below, I certify that any supporting data contained herein, which is my responsibility, is both accurate and complete.
