(4) Justification for restricting consideration to a brand-name item:
FAR 16.505(a)(4) requires the Contracting Officer to justify restricting consideration to an item(s) peculiar to one manufacturer.
However, the acquisition of these brand-name items will be placed as a full and open Request for Quote (RFQ) on NETCENTS-2, a mandatory source. Air Force Guidance Memorandum (AFGM) (2016-01) to AFI 63-101/20-101, Integrated Life Cycle Management states “The NETCENTS-2 contracts are the mandatory contract vehicles for all AF units purchasing IT products and solutions.”
The contracting officer and project manager have determined that this requirement is an IT product and solution and should be purchased through the NETCENTS-2 contracts as prescribed in AFGM 2016-01."
FlexPod is comprised of integrated hardware and software from vendors whose products allow seamless integration into the AFTAC operational network enterprise. FlexPod includes NetApp data storage devices that utilize proprietary data replication software. This software is essential for integration into the existing AFTAC NetApp data storage infrastructure currently supporting multiple operational mission systems and networks comprising the data storage and analytical component of AFTAC's world-wide US Atomic Energy Detection System (USAEDS). Flexpod converged networking services are provided by Cisco devices that are presently used through the AFTAC network enterprise. Continued use of Cisco hardware/software ensures compatibility with existing network topology, reduces network convergence time and meets Joint Interoperability Test Command certifications requirements. VMWare is utilized by the NetApp/Cisco partnership to provide the virtual server capabilities required to provide a converged infrastructure solution. VMware provides the complete Software Defined Data Center stack which is unique in the industry integrating software defined storage, software defined networking to include virtual switches, routers, and firewalls. VMware is the only vendor that supports all three key operating systems - Windows 201x Server, Red Hat Enterprise Linux, and Solaris x86 - used extensively throughout AFTAC. Oracle Database is unique in that it can provide the cell level data encryption, protection, and isolation that addresses data at rest concerns within the database and over database replication required to meet AFTAC security requirements.
(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:
In accordance with FAR 16.202-2, this will be a firm fixed-price contract suitable for acquiring commercial items and allows fair and reasonable prices when there is adequate price competition and/or reasonable comparisons. FAR 15.404(b)(2)(i) allows adequate price competition to be used as a means for determining a price fair and reasonable.
As required by FAR 16.505(b)(3), the contracting officer will establish prices for this order using the policies and methods in Subpart 15.4. Specifically, the contracting officer anticipates sufficient competition to determine the resulting price fair and reasonable by comparing proposed prices received in response to the solicitation (see FAR 15.404(b)(2)(i) and 15.403-1(c)(1)(i)).
There is reason to believe that sufficient competition will be provided using NETCENTS-2, as this is only a brand name requirement and other similar equipment builds had several quotations.
March 2018 FOR OFFICIAL USE ONLY Page 6 of 7
(6) Other facts supporting the justification:
Cisco components ensure seamless integration into existing AFTAC network infrastructure, and support reach-back capabilities and coverage provided under the Department of Defense (DoD) Cisco Joint Enterprise License Agreement (JELA). AFTAC selected Cisco components to provide mission critical and non-critical networking backbone and Local Area Network (LAN)/ Wide Area Network (WAN) capabilities under the 2012 Military Construction (MILCON) effort for the current facility and through a competitive design/build process for existing primary and alternate facilities. AFTAC selected Cisco through a similar competitive process for the world-wide USAEDS networks at initial installation for both WAN and LAN capabilities and for the AFTAC internal supporting network infrastructure. AFTAC is standardized on Cisco network components and monitoring systems to maintain consistency with regard to knowledge base, support, component replacement, and interoperability between primary and remote systems locations.
AFTAC storage requirements are currently met by a single, unified storage and backup strategy deployed globally on NetApp hardware/software components. To ensure seamless transition and sustainment of that strategy, replacement components and associated warranty support must be consistent with the current AFTAC installed base and integrate into the existing infrastructure without impacting mission operational status and maintaining the current support structure. Integrated hardware must support continued use of the current NetApp SnapMirror data replication streams without reinitializing. AFTAC already owns and covers under warranty support NetApp hardware at numerous locations around the world and uses their proprietary software to replicate mission critical data between sites. Changing to another vendor technology for a portion of this infrastructure would entail changing the language with which the current systems interact to provide these critical services, putting our global strategy at risk.
(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:
This is a brand name only solicitation in which the bill of materials required will be made available to all vendors that provide products through NETCENTS-2, a mandatory source, to large and small businesses. We anticipate that the brand name requirement will not limit any of the qualified Contractors from competing for this requirement. No additional actions are planned to overcome the barriers that led to the exception to fair opportunity because the system is being replaced in stages and they must be compatible with the remaining configuration. This will also ensure compatibility with future configurations and ensure mission readiness.
(8) Program Manager's certification that supporting data is accurate and complete:
As evidenced by my signature below, I certify that any supporting data contained herein, which is my responsibility, is both accurate and complete.
(9) Contracting Officer's certification that the justification is accurate and complete:
As evidenced by my signature below, I certify that the justification is accurate and complete to the best of my knowledge and belief.
(10) Approving Official's determination that FAR16.505(a)(4)(i) applies to the order:
As evidenced by my signature below, I hereby determine that the use of brand-name restriction applies.
