Justification and Approval (J&A) for Other Than Full and Open Competition

FOR OFFICIAL USE ONLY

March 2018 FOR OFFICIAL USE ONLY Page 2 of 3

I. Contracting Activity.

The 21st Contracting Squadron at Peterson AFB is the contracting activity for subject justification for Other Than Full and Open Competition for the extension of Mess Attendant services (PR# F3L3FC9091A001) in support of the 21st Force Support Squadron at Peterson AFB, Colorado.

II. Nature and/or description of the action being processed.

This modification to the existing contract, FA2517-14-P-6060, will result in an extension of services for six (6) months in accordance with (IAW) FAR 52.217-8 Option to Extend Services. It is vital that these mess attendant services for fixed-price labor (CLIN) and cost-reimbursable (CLIN) for repair services be extended to provide continuity of essential meal services while a follow-on reacquisition is being solicited. This J&A is for this current action only.

III. Description of supplies/services required to meet agency needs.

This requirement is to extend services under the terms and conditions of the existing contract for Mess Attendant services. Currently these services are being performed by JR Contract Services under contract FA2517-14-P-6060, which expires 31 August 2019. A follow-on contract is currently being solicited, and the contract will be awarded in sufficient time to ensure uninterrupted services. It is in the Government's best interest to continue services under the existing contract to prevent a lapse in these on-going and essential services.

The period of performance of this extension of services will be 1 September 2019 through 29 February 2020, with an estimated value of $392,026.00, increasing the total contract value, including this option, to $4,062,715.00. These are recurring services that will be funded by operational and maintenance (O&M) 3400 funds.

Services required include: Provide non-personal services to perform mess attendant services as well as preventative maintenance and equipment repair for all food service equipment in the facility. Contractor is responsible for providing cashiers, dishwashers, meal attendants and custodial staff during meal periods and IAW with the Performance Work Statement.

IV. Statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C. 1901, as the procedures in FAR

13.5 were used for the current acquisition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Current Mess Attendant services are being performed by JR Contract Services in a satisfactory manner under contract #FA2517-14-P-6060. Due to the period of performance of the current contract ending on 31 August 2019 and unexpected change in contract scope prior to solicitation issuance, it has been deemed appropriate to exercise the Option to Extend Services with JR Contract Services for six (6) months in accordance with FAR 52.217-8 in order to prevent a lapse in mission essential services. Failure to extend services would result in an unacceptable delay in mess attendant services in support of the war-fighter.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

For the follow-on acquisition, extensive market research will be conducted to ensure that the Government arrives at the most suitable approach to acquiring this service, market research results will also be used to determine sources

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer determined the price to be fair and reasonable IAW FAR 13.106-3(a). Pricing for the current contract, inclusive of all option years was evaluated and determined fair and reasonable at time of award. Therefore, the Contracting Officer has determined the estimated cost of $392,026.00 to be fair and reasonable because pricing for the extension is based upon the prevailing price of option year 4.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was not conducted for this extension of services requirement as the services will be performed under the existing contract and therefore may only be performed by the current contractor. The contractor, JR Contract Services, is performing satisfactorily under the current contract, and as of 1 July 2019, is not debarred, suspended, or otherwise ineligible for contract award.
