L-7.0 VOLUME II-PAST PERFORMANCE INFORMATION
L-7.1 GENERAL
a. Each offeror shall submit a past performance volume with its proposal containing past performance information in accordance with the format contained in Attachments 1-5 (as appropriate). This information is required for the offeror and all subcontractors, teaming partners, and/or joint venture partners who are proposed to perform 10 percent or more of the proposed effort based on the total proposed price or perform aspects of the effort the offeror considers critical to overall successful performance. Offerors are cautioned that the Government will use data provided by each offeror in this volume and data obtained from other sources in the evaluation of past performance.
PAGE L- 8 of 25
b. Along with the information required in this paragraph, the offeror shall submit a consent letter executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing the release of adverse past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.
The completed consent forms shall be submitted as part the Volume II, Past Performance, and will NOT be counted towards the page limitation.
L-7.2 EARLY PROPOSAL INFORMATION
Each offeror is requested to submit the information shown in Attachment 1 in accordance with the due date as required in paragraph 10. Failure to submit early proposal information will not result in offeror disqualification.
L-7.3 RELEVANT CONTRACTS
Offerors may submit information in accordance with Attachment 1: Past Performance on up to three (3) recent contracts considered most relevant in demonstrating their ability to perform the proposed effort. To be recent, the effort must have been performed during the past thirty years (30) years from the issue date of this solicitation. Relevant chambers shall be defined as those rated for at least 1,000 detonation events with TNT equivalence greater than or equal to 1Kg. Offerors may also include information on up to three (3) recent contracts performed by each of their teaming partners and significant subcontractors that they consider most relevant in demonstrating the partner’s/subcontractor’s ability to perform the proposed effort.
Please include rationale supporting your assertion of relevance. Based on the Government’s market research efforts, a 30 year recency parameter has been determined to be a reasonable time span to get the sufficient amount of information needed. For a description of the characteristics or aspects the Government will consider in determining recency and relevance, see Section M, paragraph M-4.0 - Past Performance.
L-7.3.1 SPECIFIC CONTENT
Offerors are required to explain what aspects of the contracts submitted for past performance consideration are deemed relevant to the proposed effort and identify what aspects of the proposed effort they relate to. Relevance includes not only chamber explosive performance (i.e net explosive weight) but also designed chamber lifetime and actual demonstrated/proven lifetimes. This explanation may also include a discussion of efforts accomplished by the offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. Issues/problems encountered on complex programs does not automatically rate the offeror’s past performance as having limited or no confidence especially if the offeror subsequently demonstrated the ability to overcome the issues/problems encountered. The offeror is required to clearly demonstrate management actions employed in overcoming problems and the effects of those actions in terms of improvements achieved or problems rectified. This may allow the offeror to be considered by the Government as a higher confidence candidate.
PAGE L- 9 of 25
L-7.3.2 ORGANIZATIONAL STRUCTURE CHANGE HISTORY
Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant past efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing any such changes in the organization of your company.
A pamphlet or other commercial document describing such reorganizations may suffice. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government intends to consider past performance information provided by other sources as well as what is provided by the offeror(s), your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.
L-8.0 VOLUME III-COST/PRICE (SECTION I) AND MODEL CONTRACT (SECTION II)
a. The 10Kg Detonation Chamber is contemplated under a fixed price incentive firm (FPIF) type contract which will utilize the following established elements: target profit rate of 10%, ceiling rate of 108%, an underrun ratio of 70/30, and an overrun ratio of 85/15. The Design, Hardware Build, and Test and Data (data NSP) CLINS will be FPIF and will utilize the aforementioned elements as indicated in the table below.
CLIN Description CLIN Type Design FPIF Hardware Build FPIF Test and Data (data NSP) FPIF Installation FFP Training FFP Travel CR (Budgetary Amount is $20,000) Onsite Support CR (Budgetary Amount is $60,000) Storage (Option) FFP
b. Offerors shall provide a Volume III-Cost/Price proposal that fully and clearly demonstrates reasonableness and balanced pricing and documents the Total Evaluated Price (TEP). The TEP will be the summation of all CLINS. Offerors are to use the budgetary amounts given by the Government for the Travel and Onsite Support CLINS; no deviations shall be permitted.
c. The price proposal shall include a completed copy of the 10Kg Detonation Chamber Pricing Spreadsheet (Section J of the solicitation, Attachment 2). The total evaluated price (TEP) which is the summation of all CLINS shall be derived by the Government utilizing Section J, Attachment 2 of the solicitation. The ceiling rate (108%) will be applied to the offeror’s proposed FPIF target costs to determine the ceiling price of the FPIF CLINS. The ceiling price of the FPIF CLINS will be used by the Government to calculate the TEP which will be composed of the sum of the following: FPIF ceiling
PAGE L- 10 of 25 prices, the FFP CLINS, and the CR CLINS. The Government derived TEP shall be the evaluated price for source selection purposes. Offerors shall identify profit rate (%) for all FPIF CLINS.
Offerors are encouraged (but not required) to go to the following Defense Acquisition University site to see the FPIF tool and training PowerPoint slides to utilize for proposal submission:
https://acc.dau.mil/CommunityBrowser.aspx?id=736006&lang=en-US (titled “AFMC FPIF Model v1 example Oct 2015.xlsx” and “AFMC Incentive Training Oct 2nd 15.pptx”). The training slides and tool provide a comprehensive explanation on each element of FPIF which will help develop offeror proposals.
A Government approved accounting system is required as per FAR Appendix 9903.201-1. Indicate whether you have Government approval of your accounting system and if so, provide evidence of such approval. The Offeror’s most recent DCAA audit report is considered the standard of proof. The report needs to include all numbered pages and not be redacted. Also, identify any deviations from standard procedures in preparing this proposal volume, if applicable.
The Offeror shall provide a copy of the most recent approved Cost Accounting Standards (CAS) Disclosure Statement, if applicable. Additionally, the Offeror shall provide a copy of the cognizant Federal agency official’s written determination regarding adequacy of the provided (and proposed in accordance with) Disclosure Statement in accordance with FAR 30.202-6.
L-8.1 COST/PRICE REASONABLENESS
This section is to assist you in submitting data other than certified cost or pricing data that is required to evaluate the reasonableness of your proposed price. Compliance with these requirements is mandatory and failure to comply may result in rejection of your proposal. Offers shall be sufficiently detailed to demonstrate their reasonableness and the burden of proof for credibility of proposed costs/prices rests with the Offeror. To facilitate the evaluation of proposal information of this solicitation, information may be obtained from other sources including, but not limited to, Defense Contract Management Agency (DCMA), Defense Contract Audit Agency (DCAA), U.S. Department of Labor, Global Insight Indices and any other resource available to the Government.
L-8.2 UNBALANCED PRICING
Unbalanced pricing poses an unacceptable risk to the Government and will be a reason to reject an Offeror’s proposal. Materially unbalanced pricing exists when, despite an acceptable TEP, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.
L-8.4 COST OR PRICING DATA REQUIREMENTS
In accordance with FAR 15.403-1(b) and 15.403-3(a), data other than certified cost or pricing data may be required to support a determination of price reasonableness. If required, data shall be provided in accordance with FAR 15.403-5. If, after receipt of proposals, the CO determines that there is insufficient data available to determine price reasonableness and none of the exceptions in FAR 15.403-1 apply, the offeror shall be required to submit additional cost or pricing data.
