Section C: Justification for Soliciting from a Single Source or Brand Name
Copyright Clearance Center, Inc. is the only known provider of the services embodied in CCC's annual copyright license agreements, transactional and other services. They provide Annual Copyright License Agreements and transactional services by contracting thousands of rights holders, located in all 50 states and dozens of countries around the world, and negotiating the terms of licenses unique to each rights holder. CCC provides the convenience of minimizing the time and expense involved in determining which rights are needed, finding each of the necessary rights holders and conducting necessary negotiations and obtaining necessary individual permissions, all required in order to comply with the U.S. Copyright Law. CCC is the only known source making these rights available in "bulk" through the Annual Copyright License Agreements and permissions available with rights holders across industries through on-line transactions to comply with copyright compliance obligations.
The copyright license affords users an efficient and economical approach to share content and collaborate freely while respecting copyright property of others. The license provides ease and convenience of a single, multi-use license (i.e.
photocopying, learning management system, CDs).
Section D: Efforts to Obtain Competition
An Intent to Sole Source (ISS) notice was posted to the Federal Business Opportunity website on 24 September 2019 with a response date of 1 October 2019. There were no responses received from the ISS notice posting.

There are no actions that can be taken by the Government to foster competition for future acquisitions, until other companies become available in the marketplace that can provide a similar service of providing a single, multi-use license for copyright name acquisitions of the same supplies/services (e.g., conducting a market survey to determine potential future sources).
Section F: Contracting Officer's Determination
