JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This requirement will be awarded as a new, firm fixed-price contract lease to M Space Holdings, LLC as a follow-on contract for continued lease of a modular facility put into place under contract FA2823-07-C-0008. The only difference in requirement is the need for a more stringent preventative and routine maintenance plan, especially in terms of the HVAC units in the modular facility.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

Under this contract M Space Holdings will provide the following supplies and services in sustainment of the existing modular facility:

a. An approximately 8500sq ft modular facility which is currently in place and is fulfilling the need for administrative space under the direction of the 46th Test Squadron.

b. Warranty and repair responsibility for roof structure, HVAC systems, plumbing and interior electrical.

c. Complete teardown and removal of the facility from the installation at the conclusion of the contract.

The contract period of performance for the base year will be 28 September 2011 to 28 August 2012. The new contract will also include four (4) twelve month option years and a priced option for demobilization and teardown at the conclusion of the lease.

This requirement will be accomplished by a new firm fixed-price contract and shall utilize 3600 Research, Development, Test, and Evaluation appropriations

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

Statutory authority is 10 USC 2304(c), as implemented by FAR 6.302-1.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE

ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

This is a follow-on contract to FA2823-07-C-0008 for a leased modular facility utilized as administrative, conference and test support space for the 46th Test Squadron on Eglin AFB. To engage in another source selection for this requirement would result in substantial duplication of cost to the government that is not expected to be recovered through competition.

The current Modular C2 Test Facility is administrative space authorized by AFMC, in 2007, in connection with approved MILCON project FTFA043002 Regional Precision Measurement Equipment Laboratory (PMEL) facility project. As this project continues to be delayed, at AFMC, the requirement to provide workspace to seventy five (75) 46th Test Squadron personnel continues to be valid.

Initial installation of the existing Modular facilities took eighteen (18) months and was a complicated construction effort involving substantial expenditures to provide facility footprint specific utility provisioning. This included $110K for Communications, $200K for custom furniture, $60K for site electrical and fire suppression sources, along with $225K in initial transport and setup fees from the original vendor. It would not be in the best interest of the government to issue a solicitation for similar supplies to another manufacturer and have to re-accomplish these initial actions in which we have already invested $595K. Based on the existing contract and previously accomplished effort the government would incur duplicative costs for modular delivery, assembly, teardown, communication, fire suppression and electrical restructure, furniture teardown, storage and reinstallation, temporary relocation of seventy five (75) employees and resulting mission degradation or failure. Adequate facilities to productively house the current occupants of the existing modular are non-existent and significant downtime of the mainly contractor populations (in which the government is obligated to house) could cost the government unnecessary expenditure and disrupt or prevent mission accomplishment. The locally approved space request granting use of this space is considered filled and any subsequent actions would need to start at the beginning – a time prohibitive process. Based on previous experience with manufacturing, scheduling, delivery and facility setup, and Certificate of Initial Occupancy award timelines for a project of this complexity there would be a minimum time period of six (6) months in which 46TS C4I Systems Test Flight operations and joint war fighter support would come to a complete stop.

This acquisition will be a follow on contract for the continued use of an in place modular facility. At the onset of the current contract (FA2823-07-C-0008), the need for the facility was determined to be no more than three (3) years;

however, with unexpected delays in construction of the PMEL MILCON, which is now ranked as the #1 Eglin project at AFMC, it is imperative that the facility be accessible through August 2016 to give consideration to current fiscal constraints which may continue to inject MILCON execution delays. Retention of the modular facility until the PMEL MILCON is completed, current PMEL occupants transition and facility reconfiguration requirements are completed will ensure a smooth and seamless transition from one facility to another while continuing to execute uninterrupted test efforts locally and support DoD efforts. It is expected that the requirement for the permanent PMEL facility will be competed, awarded and built during the contemplated lease period. Should MILCON be accelerated and move is executed earlier than contract expiration there would be substantial savings to the government.

There is a requirement for installations to submit a DD Form 1391 up to MAJCOM before site work can begin to prepare for the mobilization of a new modular facility. AFMC approval to lease a modular facility has been granted until December 2016. The existing site work was made specifically for the modular facility in place. If a new contract is solicited and awarded to a new vendor and they do not have the same precise measurements as the existing facility, modifications to the site must be performed. Previous site work cost the government $153,000.00.

Modifications to the site would need to be performed after the existing modular was removed. It would be an estimated three (3) months to remove the existing modular and complete modifications. Again, this is a duplication of effort and the quoted cost of removal for the existing modular is $25,200.00 in addition to anticipated site modification, personnel dislocation and furniture removal and storage costs.

The current contract will expire on 27 September 2011. The 46th Test Squadron approved space request cannot be met by current Eglin Real Property resources and uninterrupted retention of this modular is critical to continued mission success for the 46TS C4I Systems Test Flight operations. Award of the follow-on contract to the current vendor will ensure awaited MILCON process has adequate time to be executed, while allowing required transition time for a successful and economical move.
