S001 2/8/2017 Hensel Phelps 1 In the RFQ page 3 of 49 the period of performance dates were provided as 02/22/2017 to 08/16/2018, 540 calendar days. The RFP does not indicate the period of performance dates, only the 540 calendar days. Please provide the “anticipated Notice of Award or Notice to Proceed” date to be used in our technical response.

Anticipated Notice of Award is April 21, 2017.

2 Specification section 01 2900 PAYMENT PROCEDURES 1.4A3 notes that the contractor shall comply with regulated wages scales. Please provide the wage scale required for this project.

The wage scale in effect as of March 8, 2017 will be required for this project.

3 Please reference RFP section L. Proposal Submission: L.3 Media & Formatting. Please provide the electronic submission upload procedures and/or website information to be utilized.

Pdf copies may be submitted by email or by flash drive with your hard copy proposals.

4 The RFP notes that the proposal will be submitted in PDF format and time stamped to control timeliness, but we are also required to submit a hard copy proposal. Please confirm that both the electronic submission and hardcopies are all due by the required deadlines.

PDF & Hard copies are due on the same deadlines.

5 Please provide Volume 3 information identified in the Specification Table of Contents. Volume 3 (BOD, Appendix, Product Data

Sheets) has been provided.

6 Please reference RFP section L. Proposal Submission: L.1.a Past Performance. For projects that are not Federal/do not have PPIRS, is it acceptable to submit the attached Past Performance Questionnaire used on past SI projects? (Form Attached) The form submitted is acceptable. Please confirm that all data required by CPARS &

PPIRs is submitted with this form.

7 Please provide a specification for the drilled piers. ASG will provide the requesetd specification for issuance as addendum.

S002 2/10/2017 Whiting Turner 1 TOC in the Project Manual references Volume 3, but we were not given. Will that be provided soon? Volume 3 (BOD, Appendix, Product Data

Sheets) has been provided.

Technical Proposal – most sections of RFP note that there are 4 sections (evaluation factors) – Past performance, Key Personnel, Construction Schedule, Management Plan. Section M.3 also lists items d. Construction Approach, e. Interim Financial Capability Statement, f. Small Business Subcontracting Plan.

Should we use M.4 criteria as guideline and not M.3?

Please use M.4. Of note, we will be requesting a Small Business Subcontracting Plan with your

Cost Proposal.

Technical Proposal – L.3 states that there is a limit of 50 double-sided pages. Is it acceptable to go slightly over that? We recommend you stick to the page limit.

Technical Proposal – L.1.A. Are projects not in the PPIRS acceptable to submit? Yes, please see above.

Cost Proposal – is there a time of day on March 8 that this is due? Is it acceptable to submit cost proposal that day, and follow up with the binders the following day?

Please submit your proposals in pdf & hard copy format by 3 pm.

Cost Proposal – is Appendix A available as spreadsheet? And is this one page form all that is required for cost proposal? Yes. We will be requesting a subcontracting plan as well.

Section F. 52.222-6 indicates that this project will follow Davis-Bacon Act. Please provide wage scale. Please question 2 above.

SI RFI # Date Company Request for Information Response

S003 2/13/2017 Hensel Phelps 1 The RFP Section L.1d Management Plan asks the General Contractors to identify major subcontractors and indicate how they would fit into the organizational structure. Because the Technical Proposal is due a week before the Cost Proposal we will not know which subcontractors will be selected at the time we submit the technical response. Please confirm that a list of specific subcontractors is not required and we only need to provide information pertaining to general organizational structure.

We will be extending both the Technical

Proposal & Cost Proposal deadline to accommodate your concerns.

2 The RFP contains a Safe Harbor/Scope Validation Period typically used on a CM at Risk project. Since this project is fully designed please clarify the intent of the Safe Harbor Period in relation to a hard bid project.

Our primary goal is to underscore our commitment to meeting the budget on this project and communicate that commitment to our contractors.

3 In Specification Section 015000 Temporary Facilities and Controls 1.5G it states that SI will provide COTR office facility and furnishings but 2.2E asks the GC to provide a Field Office for the Owner and Architect. Please confirm all Owner/Architect Field Offices will be provided by SI.

The SI will provide thru our CM firm. ASG will revise spec section 2.2E referenced via addendum.

4 Please specify if there are any specific small business percentage requirements? Yes, please see above, question 6. The goals for the subcontracting plan are 1) a minimum of

37.5 of planned subcontracting dollars to be placed with small business concerns; the following are subsets of the small business subcontracting goal: a) a minimum of 7.5% to be placed with minority owned small businesses; b) a minimum of 10% to be placed with service disabled small businesses; c) a minimum of 7.5% veteran owned small businesses; d) a minimum of 7.5% to be placed with HubZone small businesses; and e) a minimum of 10% to be placed with women-owned small businesses.

5 Please specify the amount of daily liquidated damages? We have not included liquidated damages provisions in this agreement.

9 Please reference specification 01 1000 and drawing TN000SH. Specification section 01 1000.1.9.A states “Telephone/Data System: A separate contract will be awarded by the Smithsonian for the installation of a telephone/data system. The Contractor shall furnish and install empty conduits with pull wires, backboards, and other accessories where indicated on the Contract Documents.” However, General Note 1 on sheet TN000SH states “ALL IT CABLING, CONNECTORS, PATCH PANELS, AND ASSOCIATED COMMUNICATIONS WIRING AND HARDWARE IS NIC AND WILL BE OWNER PROVIDED / INSTALLED. THE

FOLLOWING IT COMMUNICATIIONS DRAWINGS AND SPECIFICATIONS ARE FOR INFORMATION ONLY AND ARE NIC.” Please confirm that the proposal should include all pathways required for the telephone/data system as indicated on the TN series of drawings.

Confirmed. SI OCIO will have their internal contractor install the copper and fiber cabling system but the GC needs to provide all the conduit, back-boxes, pull boxes, cable trays and other conveyance infrastructure systems that support the copper and fiber cabling installation. General Note 1 on TN000SH will be revised accordingly via addendum.

10 Refer to drawing C103 SP, there are (2) C-3 notes on the drawing showing location of new bollards. One of the notes shows location and number of bollards. The other note does points to a location but does not show any bollards. Please clarify.

The C-3 note that does not point to any bollards may be ignored. No bollards are intended at this location. The other C-3 points to 1 of 8 bollards adjacent to the generator.

11 Refer to drawing A-120 QP, please confirm we are to provide the PR-1 Pallet Racks and CR-1 Cantilever Racks as shown on level 2 that are shown with solid lines. Confirmed. Contractor to provide PR-1 Pallet

2 Specifications sections 07 5216.2.9.E indicates a thickness of 5/8” for Cover Board. Roof Types detail 10F/A-601DT indicates a thickness of ½”. Please clarify which thickness is correct for Cover Board.

Provide coverboard thickness that meets roofing manufacturer's system performance requirements and specified warranty duration.

Details noted in 10F/A-601DT represent the minimum performance requirements.

Drawings and specs to be revised to coordinate.

3 Please review the following: A. Typ Parapet Detail @ Cricket 3N/A-504DT shows the base flashing being terminated part way-up the wall and the coping is shown as a separate non-integral component. Typ Cap Plate Coping Detail 3N/A-504DT shows the base flashing continuing up and across the parapet and under the coping. ASG assumes the question concerns detiail

3J/A-504DT, not 3N. Provide membrane flashing termination under prefinished aluminum coping, similar to typical detail 3N/A-

504DT. Membrane should not stop at termination bar. Detail 3J/A-504DT will be clarified accordingly via addendum.

4 Please clarify which is the correct detail. B. Detail 3J/A-504DT shows a 3/8" bent plate with prefinished aluminum cladding on the exterior face. However, Detail 3N/A-504DT shown a 1/2" extruded aluminum. Please clarify. Bent plate to be 1/2" Prefinished extruded

Aluminum Trom; EPT-1 per 3N/A504DT. Detail

3J/A504DT will be updated via addendum.

5 Typ Cap Plate Coping Detail 3N/A-504DT shows the coping as an extrusion. The cap piece is made from a blank that is 24-1/2". The standard width of aluminum sheet is 48". The outside coping face is covered by the heavy gauge steel/aluminum piece and the hem has a return. Since there is a cleat holding it in place, the return need to be part of the coping. It would be beneficial from a sustainability and monetary stand point to shorten the rear face by 1/2", 4'1/2" instead of 5'0", in order to be able to get two pieces from a single sheet, instead of one piece. Please confirm if shortening the rear face of the coping by 1/2" is acceptable.

Refer to detail 4M/A-203EL, the break metal is intended to only cover the coping control joint.

If by "rear face" the reference is to the vertical leg of the extrusion then it could be shortened

1/2" or a combination of height and drip edge.

The detail will be revise via addendum.

6 Roofing contractors raised concerns regarding the SBS Modified roofing system from past experiences. Please confirm if the intent is to use SBS Modified.

Otherwise, please provide an alternate specification for the roofing system.

Roofing system remians as specified on the RFP construction documents. It has been approved by SI OFMR, NASM and ASG.

7 The specifications include a section 10 1423 – Panel Signage. However, drawings do not indicate locations of signage nor show a signage schedule. Please clarify.

ASG will provide a signage drawing to be issued as part of an addendum.

8 Under Section 051200, 1.3, C.8 specifies Submerged Arc Welding (SAW) is required for welding in the shop. Also, it was noted that Flux Core Arc Welding

(FCAW) shall be allowed only in special circumstances in the field. Can Flux Core Arc Welding (FCAW) be allowed for use in-shop?

Yes, this is acceptable. Spec to be revised via addendum.

9 Under Section 051200, 1.3, C.4, can the ISO 14001 requirement for fabricators be waived? Please advise.

Acceptable to the Engineer of Record. Spec to be revised via addendum.

10 The specifications include section 10 1423 – Panel Signage. However, drawings do not indicate locations of signage nor show a signage schedule. Please clarify.

ASG will provide a signage drawing to be issued as part of an addendum.

11 Please provide any Drawing References that correlate to specification section 124813, Entrance Floor Mats and Frames.

Entrance mats are to be located at Doors

120.C1.2 and 120.06.1 for the full width of the opening and ten feet in length to comply with

LEED requirements. Door S5.01.2 is intended for egress only so no mat is required at this location. Drawings will be updated via an addendum.

12 Per Specification Section 14 2400, the basis of design elevator product is listed as an 'Otis HydroFit Holeless Hydraulic or comparable', however the Design

Documents indicate the need for a hydraulic shaft opening below the pit (elevator jack hole on A-403EP, SB-300SC). Please confirm that the hydraulic shaft is the intended system, and if possible update the basis of design selection.

The hydraulic shaft is the intended system. The basis of design is MEI, borehole / in-ground jack freight elevator for use as an ADA passenger elevator. BOD will be updated accordingly via addendum.

13 There does not appear to be a basis of design model for the Rooftop 'Gravity Ventilator' or 'LouveredVentilated Penthouse'. Sheet A-601DT lists

Greenheck as a manufacturer under Finish EPT-4, and Detail 4A/A-505 DT refers to the M-drawings for spec. But Detail 2/M-106FP states the unit is "by others", and there is no Gravity Ventilator schedule on M-601SH or M-602SH, with no relevant spec sections that could be located

Refer to Roof Accessories 07 7200 - 2.5 for the specification.

SI RFI # Date Company Request for Information Response

10 In reference to the Safe Harbor Provision Article on page 111 in the Request for Proposal: The article gives the contractor 120 days after contract award to review the design and discover any defect, error or inconsistency in the documents and to bring to the project teams attention for resolution of the issues. The article goes on to say that any issues that are not discovered within the first 120 days that the Smithsonian expressly disclaims any responsibility, the contractor expressly waives its right to seek any increase in the contract price or schedule extension, and the contractor assumes and accepts all risks, costs, and responsibilities to resolve any scope issues discovered after that initial 120 days. This clause effectively delegates design responsibility to the contractor and far exceeds any industry standard of conflict notification that would be placed upon a contractor in which the designer of record is contractually tied to another entity. Inclusion of this clause will unnecessarily drive up costs for the Smithsonian Institution and appears to relieve the A/E from any and all design liability. If the goal is to flush out as many design issues as possible early in the project, we recommend requesting the contractor provide a “good faith” effort during this 120 day period. Relieving the designer of record of all responsibility after this initial

120 day period and placing that burden on the contractor is not acceptable. We respectfully request that this clause be deleted. Lacking significant modification or deletion, unfortunately, we will not be able to continue with our participation in this project.

Our goal is not to transfer design liability, but to communicate that our budgetary requirements on this project are firm. We can agree to your suggestion to require a 'good faith effort' to flush out design issues.

11 Article 01 3100-1.8G. allows the Owner the right to assess the Contractor for the cost of an RFI response performed by the Architect which is deemed frivolous or unnecessary. We request that this clause is removed due to the subjectivity of the statement.

This section to be removed from spec via addendum.

12 Please reference article 52.249 Delays and Extension of Time: This clause unfairly places the Contractor in the position of absorbing the potential costs related to foreseeable and unforeseeable causes placed upon the contractor by others beyond the customary force majeure related events. This clause fails to promote a collaborative partnership of all parties working towards an amicable outcome in a delay situation. We require modification to this clause to allow for both time and compensation for delays caused to the contractor by others. Lacking modification to this clause, unfortunately, we will not be able to continue with our participation in this project.

We regret that this section cannot be modified.

However, we note that while compensation for foreseeable delays is not permitted but that claims regarding unforeseeable delays are subject to compliance with the contract terms.

Please see the section on equitable adjustments at 52.243.

13 Article 01 3233-2.1 A. requires the Contractor to provide photographs throughout the progress of the Work, produced by a commercial photographer, acceptable to the Smithsonian Institution. Please provide a list of photographers that are acceptable to the Smithsonian.

Please submit your photographer for the

Smithsonian's review and approval.

14 Article 01 3250-3.11 A1 requires the contractor to deliver an as-built model to the Smithsonian. Are the RFP documents designed using a model, or is contractor required to create the model using the 2D documents from the RFP?

The RFP construction documents are available in BIM / Revit and can be provided to the successful contractor.

15 If the project was designed using modeling software, will the Smithsonian make it available to the contractors during the proposal process? See above.

16 Article 01 4000-1.8K. requires mockups. Can the mockups be part of the permanent installation or do they have to be separate from the permanent installation?

Mock-ups should be separate from the permanent installation.

F16SOL10064

SI RFI # Date Company Request for Information Response

17 Article 01 4000-1.8K: Are we required to build mockups that are subject to damage by the weather in a separate warehouse? If so, does the Smithsonian have available warehouse space that can be utilized to build these mockups?

No

18 Article 01 7839 2.1B. requires the contractor to prepare a full set of corrected CAD drawings for record drawings. Is this in addition to the model required? Will the project designers furnish their CAD files for the contractor to use?

Yes, CAD drawungs are erquired. Yes, CAD files will be provided to the successful contractor.

19 Section 01 8113 includes general requirements and procedures for compliance with prerequisites required for LEED Silver certification, will this project be certified? If so, who will be responsible for the certification?

This project has been submitted to USGBC for

LEED Silver certification. The successful contractor will be responsible for those portions of the certification process which normally fall upon the GC. Reference spec section 018113.

20 Article 01 1140-1.13.b states Contractor employees will not receive ID badges that fail to meet the security requirements. Please provide the security requirements that the Contractor employees will be required to meet.

OPS advises that for a contractor to obtain a photo ID contractor badge (longer term use) a standard background check applies. To obtain a non-photo day pass a government issued photo ID is required.

21 The inclusion of the Safe Harbor Provision and Article 52.249-S0048 (Delays and Extension of Time) places our firm in a position to not participate in this project. We respectfully request that if the Smithsonian Institution elects to delete or significantly modify these provisions that they provide 4 weeks to respond to the RFP from the time when questions 1.10 and 1.12 are answered.
