JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Defense Logistics Agency (DLA) Troop Support, Construction and Equipment (C&E) Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for supplies on an other than full and open competition basis.
3. The following item is required to meet DLA’s needs:
Item Description: SLING, EYE National Stock Number (NSN): 3940-01-341-4426 Manufacturer/Supplier Part Number: Breeze- Eastern, LLC (08484)/ Part Number 17209-3 Quantity: Annual Estimated Quantity: 140 each Estimated Unit Price: $4,989.83 each Estimated Dollar Value: $698,576.20 (One year Base) Number of one-year options: Four (4) Estimated Total Dollar Value, inclusive of the options: $3,492,881.00 Maximum Total Dollar Value: $5,000,000.00
4. The applicable statutory authority permitting other than full and open competition is 41 U.S.C.
1901, as implemented by FAR 13.501(a), Sole Source Acquisition.
5. This item is a critical safety item therefore the approved source, Breeze-Eastern, LLC, is the only source which meets engineering requirements for quality. Any other manufacturing source offering this item must go through the vetting process. Failure of this item being vetted can lead to loss of life due to the amount of weight the eye sling is subject to carry, therefore vetting the source is very important. Under no circumstances is it recommended to use an untested item off the shelf product in place of the approved manufacturers’ design.
The eye sling is a six (6) foot long, flat eye and eye (FEE) web-strapped sling, used for the hoisting and transport of equipment by hoist or winch. It is a proprietary product and a subassembly of a proprietary cargo suspension system designed to carry 20,000 pounds. The sling is a component to a complete cargo hook assembly which is designed, qualified and certified specifically for the CH-53E helicopter and V-22 aircraft. Part number17209-3 is proof tested to 43,200 pounds and is designed and rigorously tested specific for its environment. These critical safety items require further testing and must meet a specific load requirement before they can be approved and used in the field. Only the manufacturer or equivalent entity are permitted to proof test and certify.
Source Selection Information - FAR 2.101 and 3.104 mailto:Tiffany.Stoute@dla.mil
This part is unique because the seventy-three (73) inch eye sling is made up of polyester type 309 stitched in a webbing pattern to specifically fit in the complete proprietary cargo hook assembly, all manufactured by Breeze Eastern. It has been identified as a Mission Essential and Critical Safety Item, which means it has been inspected and deployed to the field in critical situations and high vibration environments like that of a helicopter. It is support equipment and failure may cause loss of personnel, permanent injury, major accident and loss of a system or significant equipment damage. Various similar six (6) foot eye slings, also made of polyester and capable of carrying heavy equipment are commercially available and sold to the general public.
Substituting a different eye sling in the cargo hook assembly would require the entire cargo hook assembly to be requalified.
Commercially available eye slings are used for general purposes such as material handling, rigging, overhead hoisting, and crane lifting used in vertical, choker, and basket hitches. The commercial eye slings are:
- Generally made out of polyester or nylon
- Lightweight
- Carry heavy loads/equipment
- Strong
- Flexible
- Safety standard front load testing and sling proof testing certification available
The minor modifications which make the eye sling under this acquisition modified commercial are:
- Specifically designed to fit to two different hook assemblies on either end, CH-53E Helicopter and V-22 Aircraft (Osprey)
- Designed for heavier weight; Proof tested to 43,200 lbs for performance
- Polyester type 309 stitched in a webbing pattern to reinforce strength, withstand higher vibration, resist water absorption so it does not weaken, rot, or mildew when used in wet or damp environments, and resistant to most chemicals.
6. The solicitation will be posted to the DLA Internet Bid Board System (DIBBS) and will be synopsized in Contract Opportunities in accordance with FAR 5.2. In addition, this J&A will be posted with the solicitation in accordance with FAR 5.102(a)(6) and FAR 6.305(c).
7. As the Contracting Officer, I hereby determine the anticipated cost to the Government will be fair and reasonable based on price analysis techniques in accordance with FAR 15.403-3(a) requiring data other than certified cost or pricing data, such as an informal cost breakdown or a comparison to a similar item commercially available and sold to the general public.
8. On February 25, 2021, a Sources Sought Notice was issued for a period of thirty (30) days, through the Contract Opportunities website. No responses to this Sources Sought notice were received.
