FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Mission Installation Contracting Command (MICC) – Fort Eustis, 705 Washington Blvd., Fort Eustis, VA 23604
2. Description of Action: TRADOC G-6 requests a firm-fixed priced modification to extend the period of performance of delivery order # W911S018F0256 under Contract # W52P1J17G0012 with Distributed Computing System Solutions Provider Inc. (DCSSP), 43644 Catton Pl., Ashburn, Virginia 20147-4790. The Government projects award for May 2020 and Fiscal Year 2020, Operations and Maintenance, Army (OMA) funds will be used.
3. Description of Supplies/Services: TRADOC has a requirement for an unclassified commercial cloud subscription. TRADOC requires a contract for services consisting of integrated environments that support all change and interoperability activities for the TRADOC commercial cloud environment. This Government cloud environment will contain all required security, service delivery, and capabilities necessary to effectively support this environment.
The objective of this effort is to provide products consisting of a TRADOC enterprise cloud based public facing website environment to support cloud migration activities. This environment will contain all required security, service delivery, and capabilities necessary to effectively support cloud migration needs. In addition, TRADOC has a requirement for training of technical staff in order to successfully migrate essential services to cloud providers. These services are requested in order to allow system administrators throughout TRADOC to conduct change and interoperability analysis of organizational applications in an Army approved commercial cloud hosting platform.
The current requirement for TRADOC Microsoft Azure Cloud Services was competed amongst the Computer Hardware, Enterprise Software and Solutions (CHESS) Army Cloud Computing Enterprise Transformation (ACCENT) Basic Ordering Agreement (BOA) holders and was awarded to DCSSP on 26 September 2018. The period of performance for this order expires on 26 May 2020.
The proposed period of performance for this non-competitive action is as follows:
One-month base period – 27 May 2020 to 26 June 2020 One-month option period – 27 June 2020 to 26 July 2020
Value: $638,355.82

5. Reason for Authority Cited:
As described at FAR 6.302-2, when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
a. The Army has an urgent and compelling need to ensure the continuation of critical commercial cloud hosting services being provided by the incumbent contractor, DCSSP Inc., given the circumstances presented below. On 26 September 2018, MICC-Fort Eustis awarded delivery order #W911S018F0256 under the CHESS ACCENT BOA vehicle to DCSSP, Inc. This requirement was awarded using a brand-name requirement for Microsoft Azure. The period of performance for the delivery order was 27 September 2018 through 26 September 2019. On 10 September 2019, MICC-Fort Eustis issued a Request for Proposal (RFP) #298511 under the CHESS ACCENT BOA vehicle for the follow-on requirement. This effort was solicited as a brand-name requirement for Microsoft Azure. The original closing date of the RFP was 18 September 2019. MICC- Fort Eustis issued three amendments to answer industry questions and extended the closing date to 23 September 2019. Before closing date of the RFP, a timely pre-award protest with the Contracting Officer was received challenging the brand-name requirement for Microsoft Azure. On October 25, 2019, the Defense Information Systems Agency (DISA) awarded the Joint Enterprise Defense Infrastructure (JEDI) contract to Microsoft.
The JEDI contract was established to become the Department of Defense’s (DoD) mandatory vehicle for Army Cloud Computing. This would provide an enterprise-level contract for the DoD’s cloud computing services. The JEDI contract was protested in November 2019 at the Court of Federal Claims by Amazon Web Services. While the Army was in the process of developing the best procurement strategy for this requirement based on the evolving circumstances, on February 13, 2020, the Court of Federal Claims judge granted the protester’s motion for a preliminary injunction, which barred the DoD from issuing any task orders under this vehicle pending resolution of the protest.
The period of performance for the current services expires on 26 May 2020. The Government solicited the requirement on 15 May 2020 using a full and open basis under the CHESS Information Technology Enterprise Solutions – Three Services (ITES-3S) contract vehicle with the proposals due on 20 May 2020. On 18 May 2020, communication revealed that MS Azure does not have direct resellers on this vehicle. MS can submit quotes, however, it would be through a third party. Unfortunately, MS has changed their policy for this action and have incorporated an extensive vetting process that will take more than a week. There is also a possibility that only one proposal will be submitted within the current submittal period. In accordance with (IAW) Defense Federal Acquisition Regulation (DFARS) 205.203(S-70), “When using competitive procedures, if a solicitation allowed fewer than 30 days for receipt of offers and resulted in only one offer, the contracting officer shall resolicit, allowing an additional period of at least 30 days for receipt of offers.” This two-month extension is necessary to allow Industry sufficient time to submit proposals and enhance competition, and allows the Army to re-compete the follow-on task order in a manner that promotes the fair opportunity process.
In turn, this will allow for the orderly transition to that task order without disrupting

Version – September 2018 FOR OFFICIAL USE ONLY ongoing mission essential services. The anticipated award date for the follow-on task order is 27 July 2020.
Only the current contractor, DCSSP Inc., can satisfy the continuation effort to avoid a catastrophic lapse in service from Microsoft Azure Cloud Services for this two-month period. The current contractor is the only contractor that can provide the required service level Enterprise Agreement without delay for continued operations so that the four-star command does not experience a lapse in service. TRADOC Cloud Services are crucial to maintaining the effective operation of TRADOC and the Army at large. There are over forty (40) applications and web pages operating in the TRADOC cloud.
Coordinated migration to another Cyber Security Service Provider (CSSP) will take more than 60 days in order to prevent breakage of the existing systems. If the applications were forced to move to another cloud, it could take over six months to migrate and test all of the applications. Additionally, the mission readiness of the Army’s institutional and operational forces will be catastrophically affected if the Cloud Services incur a “break” or loss of functionality. The Army Training sites would be without key information assets, interrupting the flow through training. This would impact the flow of Soldiers to operational units. There is no other vendor available that can continue to provide uninterrupted cloud support, without a lengthy migration (60-120 days). There is currently no other source that can provide the immediate capabilities necessary for this two-month period to meet the requirements provided by the incumbent contractor. Therefore, based on the facts as presented above, the Army has an urgent and compelling need to ensure the continuation of critical commercial cloud hosting services being provided by the incumbent contractor, DCSSP Inc.
b. Alternatives.
(1) Suspend Operations. Suspending work is not a viable option. This will result in serious disruption of TRADOC’s institutional training and education mission and have an adverse impact on the readiness of Army troops. (See paragraph 5c.)
(2) Use of In-House Personnel/Expertise. This is not a viable option because TRADOC does not own enough servers to support their Critical Mission Applications including HQ TRADOC, the 32 Army schools, eight Centers of Excellence (COEs), and other subordinate training support commands, staffs, and activities. This would also not be in compliance with Army and the DoD cloud policy.
c. Impact. There will be severe mission impacts if this J&A is not approved. TRADOC will experience a catastrophic lapse in Cloud Services affecting TRADOC Critical Mission Applications including HQ TRADOC, the 32 Army schools, eight COEs, and other subordinate training support commands, staffs, and activities. This will result in serious disruption of TRADOC’s institutional training and education mission and will have an adverse impact on the readiness of Army troops. Additionally, 40 Public Facing Websites will also be shut down. This includes public services like the “Army Mad Scientist”, Family and Friends access to TRADOC Graduation Ceremonies via the internet, and access to resources such as Center for Army Professional Ethics (CAPE) and the Army University. This cloud environment also provides access to critical non-public

Version – September 2018 FOR OFFICIAL USE ONLY services including 14 production applications across the TRADOC command. This includes access to TRADOC tools like classroom scheduling used by the Fires COE, Maneuver Support COE and Cyber COE, TRADOC Enterprise Survey used by all COEs and HQ TRADOC, the Army’s Multi- Source Assessment and Feedback (MSAF) used by all Army and Joint, and Cyber COE virtual classrooms and servers for training. If the cloud requirement is shut down, TRADOC will suffer the loss of critical business functionality directly impacting every COE. This includes systems like the Aviation COE classroom virtualization; 128th AV migration from 14-year old failing hardware; G-2 Big Data effort; and migration of TRADOC’s SharePoint systems to an integrated offering in the cloud (including TRADOC Knowledge Environment (TKE), Combined Arms Command (CAC), ACOE, Intelligence COE, and MSCOE).
6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(2), this action will not be synopsized.
7. Actions to Increase Competition: As indicated in the preceding paragraphs, this is an interim action for two months to allow for continued performance pending the award of the follow-on contract. The follow-on contract will be awarded on a full and open basis as a task order under the CHESS ITES-3S contract vehicle.
8. Market Research: This effort is for a contract modification to ensure continuation of services pending the full and open solicitation. Market research was performed with the original procurement package from March to August of 2018. Market research was also conducted for the follow-on requirement from April to August of 2019.
