About this file
This document is a Justification for an Exception to Fair Opportunity for placement of an order exceeding $3,500 under a Multiple Award Contract (MAC).
The Southwest Regional Maintenance Center (SWRMC), Department of the Navy, is justifying a sole-source order to Marine Group Boat Works (MGBW) under MAC-IDIQ number N55236-21-D-0015, with delivery order N55236-25-F-9903 for Landing Craft Unit (LCU)-1632 Fiscal Year 2025 Continuous Maintenance Availability (CMAV). The work consists of replacing 1,400 square feet of main deck plating including 33 quantity deck lashing sockets (Work Item 631-30-003). The estimated requirement value is based on an Independent Government Estimate from the SWRMC Project Manager, with funding allocated in FY26 OM&N and D6. The justification invokes FAR 16.507-6(b)(3), establishing that the order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to the original order, provided all awardees received fair opportunity consideration initially. The Government's cost analysis will employ parametric methods to determine reasonableness of labor hours, materials, and times, supplemented by rough yardsticks and historical pricing comparisons. The document indicates estimated cost savings exceeding $150,000 from conducting repairs in dry dock versus at-sea, plus an additional $180,000 in avoided temporary service costs. All MAC-IDIQ offerors were given fair opportunity on the basic work package, and this critical maintenance work is necessary to address severe deck degradation discovered during ultrasonic testing that jeopardizes vessel structural integrity and crew safety.

Exception to Fair Opportunity Template Update AUG 2018
5. Determination of Fair and Reasonable Cost. A thorough review and analysis, with regard to price and scope, of the pricing information provided by MGBW will be conducted by the Project Team (PT) and verified by the Contracting Officer. Determination of fair and reasonable costs will primarily be accomplished by use of parametric methods used to determine reasonableness of labor hours, materials, and times proposed by MGBW, in accordance with FAR 15.404- 1(b)(2)(iii). Furthermore, application of rough yardsticks will be utilized for significant inconsistencies that warrant additional pricing inquiries in addition to reviewing any historical pricing information for MGBW that is available, as well as similar work accomplished by other Contractors. This analysis will be accomplished in conjunction with comparison of all proposed labor hours and material by the PT with verification by the Contracting Officer.
6. Any Other Facts Supporting the Justification: All offerors under the MAC-IDIQ were given fair opportunity to submit a proposal in response to the solicitation for the basic work package.
As this is new work, there would be unrealistic contractual expectations to overcome barriers that have led to this exception. Furthermore, if the work is not performed during this window of availability, the LCU-1632 will not fulfill its current operational obligation and would thus incur mission risk to the Government.
7. Actions Taken to Remove or Overcome Barriers that Led to the Exception to Fair Opportunity:
As noted above, this work item could not have been identified earlier. During UT, the technician discovered that the material loss of deck no longer meets the required strength criteria. Once identified, continued operations in the degraded state would cause further damage and jeopardize the crew’s safety. While standard procedures would follow the typical solicitation process providing fair opportunity to the MAC-IDIQ contract holders, it is in the Government’s best interest to incorporate this critical maintenance work to meet and support the LCU-1632 operational readiness. This is an atypical event and could not be planned or forecasted, accordingly, the ACO determined that this course of action is the most prudent way forward in this unique instance.
