JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

41 U.S.C. 253(c)(1)and 10 U.S.C. 2304(c) (1)

In accordance with Federal Acquisition Regulation 13.106-1(b) (1), I hereby determine that the CMD Forecast Product listed on (EQPCBBA-17-0010) is required through a sole source procurement and competition is precluded for the reasons indicated below.

Please select the appropriate statutory authorities in accordance with FAR Part 6.302, Circumstance Permitting Other Than Full and Open Competition:

◆ FAR 6.302-1 Only one responsible sources and no other supplies or services will satisfy agency requirements;

FAR 6.302-2 Unusual and Compelling Urgency;

FAR6.302-3 Industrial Mobilization; Engineering, Development, or Research

Capability; or Expert Services;

FAR 6.302-4 International Agreement;

FAR 6.302-5 Authorized or Required by Statute;

FAR 6.302-6 National Security; or FAR 6.302-7 Public Interest.

1. Identification of the Agency and the Contracting Activity This requirement is in support of the General Services Administration (GSA), Public Buildings Services (PBS), Office of Design and Construction (ODC) 1800 F Street, NW Washington, D.C.

20405.

2. Nature and/or description of the action being approved Pursuant to the authority of the Competition In Contracting Act (CICA) as implemented by Federal Acquisition Regulation (FAR) Subpart 6.302 and GSA Acquisition Manual (GSAM) 506.3 for justifying other than full and open competition, the GSA intends to award a contract to CMD

GROUP.

3. A description of the supplies or services required to meet the agency’s needs (including the estimate value) The CMD Product delivers a Forecast software which provides a detailed view of construction activity including historical data, current-year projects and a five-year forecast – all developed by industry-leading economists and sourced from the industry’s most-trusted project news database.

This product provides PBS with exactly the information wanted from a trusted source for multiple geographic areas in the United States. PBS will now have a source of information that gives a trusted look at the markets of multiple areas and whether those areas are cultivating construction projects or not. The IGE value is $16,700 https://easi.pbs.gsa.gov/suite/rest/a/content/latest/isBinLDeHJegYbgj4xW0BXRSLWAPF8kk6XmIAFnf0A0REdgcp3mubzX_LcU/o

4. An identification of the statutory authority permitting other than full and open competition In accordance with 41 U.S.C. 253(c) and/or 10 U.S.C. 2304(c), GSA has determined that the procurement requires a sole source in order to satisfy the Agency’s need. Specifically, the basis for other than full and open competition is that GSA could find no other responsible source that would satisfy the agency’s requirements in accordance with FAR 6.302-1.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited The tool needs to be a user friendly, online system that can be used by up to five people.

Additionally, in order for the tool to meet the necessary requirements for data, it needs to always be up to date and monitored by the contractor.

Background: In order to track construction market expansion, the Cost Management Division of ODC was using a free page from the CMD website. Unfortunately, the page stopped being updated regularly so it was deemed unreliable. The Cost Management team looked for other free sources for the information, but couldn’t find anything up to the standard of what was needed to provide an accurate estimate of market expansion in multiple cities around the United States. Thus, the determination was made to explore commercial products to get the information needed. The office wanted one product for all regions of the United States that would be online, consistently updated, and focused on construction market expansion or lack there-of.

Alternatives:

Dodge Market Research Intelligence - Dodge is well known for having solid construction data. This tool would allow us to forecast and do analysis with accurate and relevant data. However, a lot of the tool is based on finding target markets for construction areas, and I feel like we don’t necessarily need that functionality, as a lot of our construction is not based on where we want to go, but on where we are being told to go. Additionally, this tool is not online, it would be a hard copy document that would be harder to share.

Marshall & Swift Construction Cost Data - Beyond its use as an independent method to determine property value, the cost approach presents a highly effective way to verify market and income-based valuations, project construction costs and adjust estimates to account for unique physical property features. The cost approach can be used for the extraction method to determine land values in highly populated areas, when comparable open land isn't available. This was not as user friendly as the CMD tool. Additionally, this tool focused more on construction cost data and not on construction market forecasts.

CLMA 20/20 Foresight Report: This report focuses on skilled labor shortages and project data. Since it is based mostly on labor markets and not construction markets, this would not be ideal for the construction market requirement.

Justification:

CMD Forecasting Tool: CMD is the only commercial construction information provider with the combination of true national U.S. coverage of construction projects. CMD uses that project information, including the plans and specifications, to help customers drive business results. This includes high level forecasting information and market and specification analysis. CMD partners with

Oxford Economics RS Means and AEC Cares to provide the best analysis. No other product provided this much depth for specific building categories like labs, offices, warehouses and government buildings. CMD’s forecasting tool is user friendly and is online so that it is updated constantly. CMD controls the data flow into the program so GSA can be confident that the data is being monitored and kept up to date.

Prior Acquisitions: None

Impact: The CMD Forecasting Tool will help every region determine estimates that are based on where the construction markets are expected to expand and shrink. This tool will help GSA give more accurate estimates to customers which will increase customer satisfaction and will help GSA not to over or under budget.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Including whether a notice was or will be publicized as required by Subpart

5.2 and, if not, which exception under 5.202 applies Even though CMD is one source, the product GSA would be using utilizes information from various sources to provide an accurate depiction of different markets all over the United States. GSA believes this product will provide equal information to all areas and regions regardless of where they are located. A notice will be publicized as required by Subpart 5.2.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable The following IGE $16,700, represents a fair and reasonable value to the government based on market research, historical procurement data, and/or specific industry knowledge by the technical representative.

8. A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted Timeframe – February 27, 2017 – March 3, 2017 by Hillary Dunn, Operations Research Analyst for

ODC.

Technique – Online Market Research and then live demos of online tools to determine viability.

Additionally, possible product providers were discussed with estimators from Central Office to determine if the contractor had a product that GSA could use. Many products were found through an online search engine for construction market products. The final viable list was limited to products that most closely resembled the agreed upon requirements.
