JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

RICHARD BOLLING FEDERAL BUILDING

CONTRACTING AGENCY

General Services Administration (GSA), Public Buildings Services is the agency responsible for this action.

IDENTIFICATION AND DESCRIPTION OF ACTION

This justification and approval documents the procurement action for other than full and open competition in support of the community improvement district services for the Richard Bolling Federal Building, 601 E. 12th Street and the Charles E. Whittaker U.S. Courthouse, 400 E. 9th Street, Kansas City, Missouri.

The following justification for other than full and open competition is submitted for justifying a noncompetitive procurement between GSA and the Downtown Kansas City Community Improvement District in the amount of approximately $550,000.00 - $645,000.00 for a base year and four one year option years.

DESCRIPTION OF SUPPLIES FOR SERVICES REQUIRED

The following services will be made available to the Government on a prorated cost basis by the Downtown Kansas City Community Improvement District; a non-profit Business Improvement District established under Missouri State Charter. The estimated value for the base year and options is $550,000.00 - $645,000.00.

The Contractor shall provide all management, supervision, labor, materials, supplies, and equipment necessary to provide community improvement district services described herein:

ENHANCED SERVICES

Ambassador services

Contractor is to provide all labor, tools, equipment, materials and supervision to perform the work described in this Scope of Work.

Safety Services to be performed daily:

• Deployment of 2 Safety Ambassadors around Bolling Federal Building and Whitaker Federal Courthouse, Monday through Friday to patrol properties and escort employees. Patrol schedules will concur with peak activity times between the hours of 6:30 AM — 9:00 AM and 4:00 PM — 6:00 PM,

• Deployment of 1 Safety Ambassador at the parking lot for Bolling Federal Building, Monday through Friday to patrol properties and escort employees. Patrol schedules will concur with peak activity times between the hours of 6:30 AM — 9:00 AM and 4:00 PM — 6:00 PM,

• Patrol, observe and report any illegal or unusual activity that may require attention,

• Provide assistance as needed (within the scope of the employee's responsibility) to Federal Employees and those visitors to the Federal facilities,

• Provide immediate information to Kansas City Missouri Police Department (KCPD).

• Collect scattered trash and litter from all sidewalks between the hours of 6:00 AM — 9:00 PM, Monday through Friday, Services to be provided as needed or upon request:

• Inspect external surfaces of property for graffiti and remove with proper authorization,

• Remove drug paraphernalia, human and animal feces, dead animals, etc.,

• Remove tree branches or other debris that has fallen onto property,

• Use Tennant Sweeper to remove gravel, leaves, cigarette butts and other foreign matter,

• Remove weeds from sidewalks, landscape borders, tree grates and any additional areas directly adjacent to property, (601 and 701 and 400 and 300 E. 9th) Current custodial and landscaping contract doesn’t cover our parking lots for federal properties

• Power wash sidewalks to remove gum, dirt, grime, graffiti and debris,

• Meet with representatives of the East Village Development to mitigate parking concerns and develop short

& long term parking strategies for Federal Employees,

• Meet with the KCPD Chief of Police to discuss Panhandling Ordinance in the Federal District,

• Partner with KCPD on parking lot surveillance and sting operations,

• Meet with representatives of the County on the relocation of city inmates to the Jackson County Detention

Center located adjacent to Federal Property,

• Participate in Federal employee meetings to address security and safety concerns,

• Provide employee escorts to vehicles,

• Clear land adjacent to Interstate of tree limbs and low hanging vegetation,

• Remove encampments along Interstate and direct homeless to appropriate services,

• Participate in and provide support for the Combined Federal Campaign,

• Provide power point presentation about DCID services to Federal employees,

• Be the liaison between the GSA and the City as it relates to the removal of blighted structures and the redevelopment of adjacent real estate.

IDENTIFICATION OF STATUTORY AUTHORITY

Statutory authority for this action is provided in FAR 13.106-1(b), 13.106-3(b)(3)(i) and 41 U.S.C. 3304(a)(1) as implemented in FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

DEMONSTRATION THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED

The Downtown Kansas City Community Improvement District, a non-profit improvement district, offers a broad package of amenities, services and security to property owners in downtown Kansas City, MO which would otherwise not be possible for property owners to procure individually from an affordable Kansas City business standpoint. In many ways it serves the same purpose as homeowners associations in residential neighborhoods which contract for services that serve the common interest of all property owners in a given area. Such services would be too costly or complicated to be contracted by each owner individually. Instead, the homeowner associations and improvement districts contract for needed services in aggregate with homeowners paying only their fair share of the cost on a prorated basis. Both downtown improvement districts and homeowners associations offer pragmatic solutions to meeting the common needs of the property owners in a given area; and in doing so, tend to make the neighborhoods more desirable; resulting in the maintenance, or even increasing of property values.

The Downtown Kansas City Community Improvement District addresses the concerns expressed by GSA’s customers when we are marketing office space in our buildings located in downtown Kansas City, MO; which primarily relate to aesthetics, available amenities and safety. Due to the effort/existence of the Downtown Kansas City Community Improvement District, GSA can “sell” the neighborhood as well as the available federally owned office space to prospective tenants. The “membership”/contractual relationship with the Downtown Kansas City Community Improvement District will give GSA marketing possibilities for backfilling its vacant office space which was previously unobtainable. We can now effectively market the neighborhood as well as our Government buildings; both factors are the key to any private sector-marketing plan for leasing out office space. Federal tenants have the same concerns about neighborhoods as private sector tenants; and neighborhood concerns need to be addressed if GSA is to effectively market its space, especially now that customer agencies have more choice than ever before about the buildings they will occupy. It is our goal to offer a quality building; and a means of overcoming barriers to marketing our space relating to neighborhood problems. Our contract with the Downtown Kansas City Community Improvement District is the solution being proposed to meet this objective.

The Downtown Kansas City Community Improvement District is the only contracting source known in downtown Kansas City, MO that can offer the services that the Government requires to address neighborhood problems. It would simply not be a good business decision for GSA to contract for these services individually, when we can share the cost of such services with other property owners in downtown Kansas City through the Downtown Kansas City Community Improvement District (DID).

These services would be cost prohibitive or not otherwise practical for the Government to contract for individually.

DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICABLE

The opportunity is included in the forecast of contracting opportunities posted on www.gsa.gov/smbusforecast along with contact information so contractors can express interest in the procurement, however the Government will not solicit offers from more than one vendor. In accordance with FAR 6.302-1, the Government is permitted to limit the number of sources from which it solicits proposals for reasons explained in the above item.

DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE

The Offeror’s proposed price will be compared to the Government’s Independent Government Estimate prepared by the Occupancy Administrative Branch in order for the Contracting Officer to make a fair and reasonable determination. In addition, the proposed prices may be compared to the current contract price and other CID contracts in other cities.

DESCRIPTION OF THE MARKET SURVEY CONDUCTED

Market research was conducted by searching:

(i) The internet for community improvement district services for Kansas City, MO which returned various results; however, not for any contractor other than incumbent contractor.

(ii) The Small Business Administration’s Small Business Dynamic Search returned no results for the searches “community improvement district services or community improvement district services in Missouri”.

(iii) In addition other acquisition alternatives were considered pursuant to FAR 8.002 which states agencies shall satisfy requirements for supplies and services from or through the sources and publications listed in order of priority. For services, the following order of precedence applies:

Services which are on the Procurement List maintained by the Committee for Purchase from People Who Are Blind or Severely Disabled (see FAR 8.7). A search on the Ability One procurement search for “community improvement district services” returned no results.

OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

The Federal Buildings are located in Downtown Kansas City. The City of Kansas City, MO and large private sector business interest (primarily sports related) have invested in the downtown infrastructure which sets the stage for a viable rebirth of Kansas City’s downtown business area. The Downtown Kansas City Community Improvement District, a non-profit business improvement district, takes up where the City of Kansas City and private sector large business interest leave off by contracting for services that makes the area viable to small businesses and individual people who shop and work in the downtown.

The Downtown Kansas City Community Improvement District, a Community Improvement District is chartered by Missouri State Law to perform certain urban/community improvement maintenance services. No other business entity has these rights under state law.

This package of services offers a marketing tool to the Government, makes our assets more viable for customer agencies, enhances our ability to keep our office space rented/income producing, and ultimately should help maintain/increase the value of the impacted federal assets. The Downtown Kansas City Community Improvement District is the only practicable source available due to the cost sharing aspects afforded to the Federal Government.

No actions are being taken at this time. Should this contractual avenue prove unsuccessful, other contractual/marking avenues will be pursued at that time.
