About this file

The document is a Controlling Board request from the Ohio Department of Education and Workforce seeking approval for a waiver of competitive selection for a memorandum of understanding (MOU) with the University of California, Los Angeles (UCLA). The contract is part of the English Language Proficiency Assessment for the 21st Century (ELPA21), a consortium that includes nine states: Ohio, Arizona, Arkansas, Iowa, Louisiana, Mississippi, Nebraska, Oregon, Tennessee, and West Virginia.

The MOU covers English language proficiency assessment services for fiscal years 2026 and 2027, with funding of $1,500,000 per year from the General Revenue Fund (GRF). The contract allows Ohio to measure the performance of approximately 100,000-115,000 English learner students annually. Basic membership services include administration, scoring, research and reporting, membership engagement, vendor-to-vendor support, and maintenance and development of test items. The Department chose to continue participation in the consortium to leverage economies of scale and avoid higher costs associated with developing assessments independently, with the contract start dates of 10/20/2025 for FY 2026 and 7/1/2026 for FY 2027.

Meeting Date 10/20/2025

Request Summary The Department of Education and Workforce respectfully requests Controlling Board approval to waive of competitive selection in an amount up to $1,500,000 in FY 2026 and up to $1,500,000 in FY 2027 from GRF, ALI 200437 (Student Assessment), to renew a memorandum of understanding with the University of California, Los Angeles (UCLA) for the English Language Proficiency Assessment for the 21st Century (ELPA21) which allows Ohio to measure the performance of English learners (EL) as they progress through their K-12 education and achieve college and career readiness.

Funding Fiscal Year Fund ALI Amount

2026 GRF - General Revenue (GRF) 200437 - Student Assessment $1,500,000.00 2027 GRF - General Revenue (GRF) 200437 - Student Assessment $1,500,000.00

Explanation Students who are identified as English learners (EL) are required to be assessed annually in English language proficiency.

Approximately 100,000-115,000 Ohio students take English language proficiency assessments each year.

The Department of Education and Workforce, through its membership in the English Language Proficiency Assessment for the 21st Century (ELPA21), is able to collaborate with other states and leverage economies of scale to develop and implement new and cost-effective English language proficiency assessments. The eight other states that participate in the ELPA21 are Arizona, Arkansas, Iowa, Louisiana, Mississippi, Nebraska, Oregon, Tennessee, and West Virginia.

The Department is seeking a to continue its participation in the ELPA21 as a basic member. Services included in the basic membership are administration, scoring, research and reporting services, membership engagement, and vendor-to-vendor support. The MOU also allows for maintenance and development to update test items.

While the Department previously explored partnering with an Ohio college or university to support item development, it found that it would incur a much higher cost without the scale provided through the collaboration with other states.

Contract Amendment

1. Why is the contract being amended?

Contract extended beyond original contract end date Ohio is a member of a consortium of states to reduce the cost of developing assessments for English learners. The other states participating in ELPA21 are Arizona, Arkansas, Iowa, Louisiana, Nebraska, Oregon, and West Virginia. The original agreement was for FY 2017, and the Department extended the agreement with subsequent amendments each biennium because of the cost efficiencies realized from being a member of the consortium.
